MADURAI: The Madras High Court Bench here has directed the State Government to pay a monthly pension of Rs.1,000 to the widow of a Dalit who was allegedly murdered by Caste Hindus within the Somarasampettai police station limits in Tiruchi district in 2007. The government was also ordered to provide educational allowance to her children within one month.

Disposing of a public interest litigation petition, a Division Bench comprising Justice F.M. Ibrahim Kalifulla and Justice K.B.K. Vasuki said that the Adi Dravidar and Tribal Welfare Department Secretary and the Tiruchi Collector should also take steps to pay arrears of pension besides ensuring that the money was henceforth disbursed on or before the tenth day of every month.

B. Stalin, a lawyer practising in the High Court Bench here, had filed the PIL petition to assist the Dalit family in getting justice. The petitioner's counsel, P. Rathinam, contended that the Government had paid only a lump sum amount of Rs.2 lakh and not the monthly pension as required under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Rules, 1995.

Stating that the Government was bound to follow the Statutory provisions, the Division Bench said: "In as much as the reliefs have to be borne by the State by virtue of statutory prescription, it is imperative that such benefits are granted without any further loss of time to the victims for their sustained livelihood and for the education of the children."

Direction to police

The judges also directed the Tiruchi Police Commissioner to issue suitable instructions to the Cantonment police station, under his jurisdiction, to register a case against all those who allegedly threatened some witnesses when the latter had gone to the First Additional Sessions court on September 14, 2009 to depose during the trial of the Dalit's murder case.

The Commissioner was further ordered to ensure that after registration of the case, it was transferred to an officer in the rank of Assistant Commissioner of Police, as stipulated under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The ACP should complete the investigation and file the final report before the court concerned within one month.

Sensitisation meet on SC/ST (Prevention of Atrocities) Act held

Either the Collector or his representative should personally inspect the scene of atrocity

Relief amounts depending on the nature of atrocity must be provided

VELLORE: Vellore Collector C. Rajendran urged officials to take steps to prevent atrocities on the Scheduled Castes and Scheduled Tribes and to assist the SC/ST people affected by atrocities to obtain due relief from the government, and mete out punishment to the guilty.

Presiding over a sensitisation programme for government officials on the SC/ST (Prevention of Atrocities) Act and the Protection of Civil Rights Act, Mr. Rajendran said that Vellore district was fortunate in that there were no large-scale atrocities on SC/ST people compared to the districts in Bihar and Uttar Pradesh. Out of the 40 lakh people in Vellore district, SC/ST people constituted 20%, and they were living in harmony with the rest of the population.

The Collector said that it was the duty of the officials to prevent atrocities on SC/ST people. Either the Collector or his representative (the Revenue Divisional Officer or tahsildar) should personally inspect the scene of atrocity when he gets any complaint.

If the complaint was found to be genuine, the victim of an act of atrocity should be provided relief amounts of Rs.25,000 or Rs.50,000 depending on the nature of atrocity. If a woman victim wanted the lawyer changed, her request should be granted. Action should be initiated against all those responsible for perpetrating atrocities against SC/ST people, he said.

M. Balasubramanian, Deputy Superintendent of Police, Vellore, welcomed the gathering. Raja, DSP, Social Justice and Civil Rights, Vellore proposed a vote of thanks.

Samajwadi Party chief Mulayam Singh Yadav and RJD chief Lalu Prasad have called the Women's Reservation Bill a political conspiracy.

The Samajwadi Party is not against the Bill. Of course, the Bill in its present form is a conspiracy to keep out the minorities. The BJP and the Congress are scared of the mettle of backward class leaders like Lalu Yadav, Mulayam Singh and Ram Vilas Paswan. Hence, they are hesitating to include reservation of backward classes in the women's Bill. SP also wants the upliftment of women. We are only asking for the inclusion of Dalits, Muslims and minorities.

But by opposing the Bill, you are dismissing reservation for women altogether. Reservation for women has to be party-based. Women should get 50 percent reservation in government jobs. Parties should take the initiative to reserve tickets for women from all strata of society. All parties issue tickets to those with money and muscle power. We are demanding this should change.

We don't want to see wives of bureaucrats occupying seats in Parliament. The whole purpose will be defeated then. Hence, women's empowerment is only possible if 33 percent of tickets in each party are reserved for women.

All major parties including the BJP, Congress and the Left are criticising the SP's stand.
The Left's opposition is totally political. The BJP and Congress support the Bill but they need to answer a question: till date, why has Parliament not seen a single Muslim MP elected from Orissa, Punjab, Uttaranchal or Madhya Pradesh? With this sort of non-representation of minorities, who will guarantee representation of women from the backward classes? Clearly, it is not possible.

The BJP was supporting the Bill but is now demanding a debate. I know several Congress MPs who have, off the record, told me that they too disagree with the Bill. They too demand reservation for Muslims and Dalits.

Who are these Congress MPs?

I can't name them as Congress is dictatorial. It has a system of firing dissenters.

But the first woman Lok Sabha Speaker, Meira Kumar, is also a Dalit.

Both Meira Kumar and President Pratibha Patil have been elected to their respective offices on merit. Meira Kumar has risen to that position through her efforts, not through reservation. Congress has a history of not giving tickets to women. They are merely misleading the nation.

Will SP's withdrawal of support to UPA make any difference to the Bill?

If nothing else, it will at least expose them. All those in the Congress who are pompously sleeping and eating at Dalit homes must understand that this will not make any difference to their lives. The Dalits and minorities must be given adequate representation for their progress. We were supporting the Congress because we wanted the BJP to stay out of power. We were supporting it for secular values. However, there is no option but to withdraw if it chooses to ignore those values.
