The Cabinet Committee on Security (CCS) put off plans to partially revoke the Armed Forces Special Powers Act (AFSPA), following fresh violence in the Kashmir Valley over alleged desecration of Koran in the US.While political dilemma over revocation of the Armed Forces Special Powers Act (AFSPA) from Jammu and Kashmir continues, the Indian Air Force chief on Tuesday stressed the need for legal protection to soldiers.

Curfew was on Tuesday extended to all major towns of the Kashmir Valley as a precautionary measure after violent clashes left 14 people dead and over 50 injured, official sources said in Srinagar.

Air services to and from Srinagar have been suspended for three more days. Air services in Srinagar were earlier under suspension since September 3 due to renovation work on the runway, but were otherwise operating from the military airport at Awantipora in Pulwama. The services have now been been stopped due to bad security situation in the Valley.

"Soldiers while involved in performing their duty need legal protection if you want them to be efficient," IAF chief Air Chief Marshal PV Naik told reporters on the sidelines of a function in New Delhi.

Naik expressed confidence that the government's decision on the issue would be right.

"I think the government is fully sensitive to the issue and they will take the correct decision," he added.

Defence Minister AK Antony, meanwhile, has assured that the views of all sections would be taken into consideration before a final decision on the AFSPA is taken.

"We will take a decision (on the AFSPA). Tomorrow is the all-party meeting, after which we will take a decision," Antony said at another function. "The decision has to be taken carefully."

The AFSPA gives army officers legal immunity for their actions. There can be no prosecution, suit or any other legal proceeding against any officer acting under the act. Nor is the government's judgement on why an area is found to be "disturbed" subject to judicial review.

Jammu and Kashmir Chief Minister Omar Abdullah has demanded that the AFSPA be revoked from parts of the valley, where the deaths in violence have reached 88 since June 11.

A mob defied curfew in north Kashmir's Khanpora in Baramulla district on Tuesday morning and indulged in heavy stone pelting on the security forces. The police used tear smoke shells to disperse the mob. One protester is reported to have got injured. Heavy pelting was going on the security forces till last reports came in.

Srinagar city, Anantnag, Bijbehara, Awantipora, Lethpora, Pampore and Pulwama towns in south Kashmir and Sopore town in north Kashmir were already under curfew since Sunday.

The new areas that have been brought under the ambit of prohibitory orders include Budgam town, Choon, Mirgund, Ompora, Narkara, Shekhpora, Humhama, IG Road, Gulwanpora, Nadir Gund, Chadoora and Wathoora in central Kashmir's Budgam district.

Curfew was also imposed in Ganderbal and Kangan towns, Kulgam, Qoimoh, Shopian town, Baramulla town, Tangmarg, Kupwara town, Tregham, Kralpora, Handwara, Chotipora, Kulangam and Bandipora town.

A police spokesman said a mob took out the belongings and bedding of police personnel from a police post at Khanabal-Pahalgam Road in Anantnag town on Monday night and set them on fire.

A troops carrier of the state police was torched at Charar-e-Sharief in Budgam district, he said.

Fresh violence erupted in Kashmir on Monday, leaving 17 dead, including a policeman and over 70 injured with mobs torching several government properties and a private school after a television report alleged desecration of a holy book in the US.

The state cabinet yesterday condemned the alleged act of desecration and made a fervent appeal to the people not to take law in their own hands.

Prime Minister Manmohan Singh had on Monday voiced concern over the ongoing unrest in Jammu and Kashmir. He also sought to reach out to the people in the state, saying their grievances have to be addressed and promised talks within the Indian Constitution with those who abjure violence.

The CCS, which met on Monday evening for three hours, took stock of the worsening situation in the Valley , which recorded the biggest single death toll from protests on Monday. It was of the view that larger consensus was required on the 'way forward' and the government announced convening of an all-party meeting in the Capital on Wednesday.

The proposal for a makeover for AFSPA still looks a tough task as the Army continues to maintain that "special laws are needed to tackle a special situation ." With paramilitary forces and the police failing to contain the situation that seems to be going worse, a section of the CCS was of the view that the government should not do anything that would sap the morale of the Army. "The Army is needed to maintain some semblance of order in the chaos-ridden Valley," said a leader during the meeting.

Politically, too, the Centre does not have much elbow room to work around AFSPA, as the main Opposition, BJP, has warned against looking at it as a solution. In the event of the situation spinning out of control, it is certain to pin the blame for any possible setback on the government . The recent back-and-forth between Congress and BJP on the issue clearly points to this possibility.

Clearly aimed at sending out the signal that the Centre does not subscribe to J&K chief minister Omar Abdullah's "no outreach, no back channel approach" , CCS said the government is keen to restart the process of dialogue. "The dialogue can embrace all the issues that agitate the minds of the people of Jammu and Kashmir, especially the youth. The dialogue can address issues such as trust deficit and the governance deficit," a statement issued after the CCS meeting said.

With minority institutions bearing the brunt of the rumours of desecration of Koran — a mob in Baramullah set ablaze a private school run by missionaries — the US administration stepped in to share the hurt of the community . "News reports have stated that on Saturday, September 11, one misguided individual in the US desecrated the Holy Koran by tearing pages from it. On behalf of everyone at the US embassy in India, I condemn such acts as disrespectful, intolerant, divisive, and unrepresentative of American values. The deliberate destruction of any holy book is an abhorrent act. The acts of this one individual are not representative of America and American values," US ambassador Timothy Roemer said.

He also said that the US was dismayed to see reports that a school and a church in Kashmir and Punjab have been attacked and destroyed by rioters. "We strongly support local authorities' appeal for calm and an end to the violence," the US ambassador said.

Hours before the crucial CCS meeting, Mr Abdullah held separate meetings with Congress chief Sonia Gandhi and home minister P Chidambaram. Mr Abdullah, who left for the Valley, held an emergency meeting of the Cabinet and called upon people to maintain peace.

In Srinagar, DGP Kuldeep Khuda played out a tape before the media which allegedly showed an aide of hard-liner Hurriyat leader Geelani instigating the mobs to attack security personnel.

Defence Minister A.K. Antony Tuesday said the government will take a final decision on a Kashmir package, including withdrawal of the contentious Armed Forces Special Powers Act (AFSPA), at an all-party meeting called Wednesday.

'Before we take a final decision, it is better to involve everyone,' Antony told reporters a day after the Cabinet Committee on Security (CCS) met to review the situation in violence-hit Kashmir, including lifting of the AFSPA from parts of the state.

   

Asked why the CCS was not able to take a decision on a Kashmir package, especially AFSPA, despite a three-hour-long meeting, he said: 'Important decisions have to be taken after carefully assessing all aspects.'

   

'Yesterday we had a very long meeting. Ultimately, we thought before we take a final decision, we will take into confidence all the major parties so that everybody is involved,' the defence minister told reporters after dedicating to the nation the AFNET (Air Force Network), the Indian Air Force's (IAF) high-speed digital connectivity network.

   

'Don't worry, we will take a decision. Tomorrow (Wednesday) is the all-party meeting. After that, we will take a decision,' he added when reporters continued to ask him about withdrawing the act from some areas of Kashmir Valley. The CCS meeting was held in the wake of widespread violence in the Valley that has seen the deaths of 88 civilians in retaliatory firing by security forces during street clashes since June 11.

   

The Armed Forces Special Powers Act (AFSPA) has become a political hot potato with the ruling National Conference, the opposition People's Democratic Party (PDP) and the separatists demanding its lifting in Kashmir valley, but the armed forces opposing the move.

   

The Bharatiya Janata Party (BJP) has also vehemently opposed its withdrawal, saying the move will demoralise the security forces deployed in the state.

   

The AFSPA gives army officers legal immunity for their actions. There can be no prosecution, suit or any other legal proceeding against any officer acting under the act. Nor is the government's judgement on why an area is found to be 'disturbed' subject to judicial review.

   

Antony also appealed to all groups to 'keep out irresponsible elements'. At least 16 people lost their lives on Monday during protests initially triggered by reports of the Quran having been desecrated in the US.

   

The Indian Air Force chief Air Chief Marshal P.V. Naik Tuesday voiced his unwillingness on withdrawal of the act in Kashmir, saying that soldiers need legal protection.

   

'Soldiers while involved in performing their duty need legal protection if you want them to be efficient,' he said.   

   

Naik expressed confidence that the government's decision on the issue would be right.    

   

'I think the government is fully sensitive to the issue and they will take the correct decision,' he added.

With the BSE benchmark Sensex breaching the 19,000-level and still going strong, analysts believe that Indian markets have entered a bull phase and persistent FII inflows may push the index past the 20,000-mark in the coming days.

"Investors are sitting on huge cash piles and as the market is rising, they cannot sit sideways for long. A large chunk of cash is coming in the market and in such a scenario, hitting the 20,000-mark seems easy," CNI Research CMD Kishore Ostwal said.

"By October the Sensex is likely to cross the 20,000-mark and by November, I see it at the 21,000-level," Ostwal added.

The Sensex had touched an all-time high level of 21,206 in January, 2008, a year that saw the benchmark index of the Bombay Stock Exchange record an over 80 per cent jump.

Echoing a similar opinion, Network Stock Brokings Head of Institutional Sales & Strategy Prakash Diwan said hitting the 20,000-level would not be a big deal in the coming days.

"The market is driven by strong liquidity and FII inflows are expected to continue in the local stock market. Hitting the 20,000-level by Sensex would not be a big deal. Soon the Sensex will be able to reach that level," he said.

Yesterday, the Sensex zoomed by more than 408 points to cross the 19,000-level for the first time in 32 months.

"Investors have faith in the India growth story and in the coming days, the Sensex will touch new highs," Diwan added.

The index has risen 122.3 per cent so far this year, from a low of 8,701.07 in October, 2008, on account of the global economic crisis.

"I do not see any reason why markets should not move up. It is a liquidity-supported rally and unabated FII inflows would further push local markets," SMC Global Securities Equity Head Jagannadham Thunuguntla said.

"India is one of the hot spots for overseas investors and those fund houses, which were still watching the situation, now are interested to pick up local stocks as global equities are rebounding," Thunuguntla added.

The Sensex took just five days to reach the 19,000-level from the 18,221.43 mark. On September 3, the index had settled at 18,221.43.

Three banking stocks -- SBI, ICICI Bank and HDFC -- accounted for about 70 per cent of the Sensex's rise from 18,000 to 19,000.

"Banks are on a rising streak on optimism that lending will pick up in a fast-growing Indian economy and that they are well capitalised," IIFL Vice-President (Research) Amar Ambani said.

"Banking stocks jumped as regulators gave firms more time than expected to meet capital requirements (the Basel norms)," another analyst added.

However, equity analysts did not rule out a correction in the markets, as they felt stocks are overvalued.

"Investors should take cautious approach about the market this time. A fall from this high cannot be ruled out," Unicon Financial CEO Gajendra Nagpal said.

The BSE benchmark Sensex was up by 153.39 points at 19,361.72 today, with just an hour left before the close of trade.

Mkts likely to rise if RBI, inflation don't play spoiler: Analysts

The stock market is likely to continue its upward journey this week on the back of persistent inflows from overseas fund houses, analysts said.

However, the markets will be keeping a close eye on the RBI's September 16 mid-term monetary review and the release of August headline inflation (WPI) on September 14, which will set the course on Dalal Street, they said.

Boosted by robust industrial growth in July and positive global cues, the markets are expected to open on a firm note on Monday, brokers said.

"Investor sentiment got a fillip after strong IIP data for July and it will work as a booster for the market. We may see action in consumer good stocks, as this sector contributed 63 per cent to the country's industrial production during July," Bonanza Portfolio Vice-President Avinash Gupta said.

As per government data released on Friday, India's industrial output growth nearly doubled to 13.8 per cent in July, dispelling fears about a demand dip and prompting policy planners to hike their economic growth projections to more than 8.5 per cent.

There is a chance that the RBI may leave policy rates unchanged for a while or tinker with the repurchase (repo) rate by hiking it by 25 basis points, SMC Global Securities Research Head (Retail) Saurabh Jain said.

"The Index for Industrial production (IIP) and inflation are important in affecting any potential action by the RBI during its mid-September policy review. Consensus points towards a 25 basis points hike in policy rates," brokerage house ICICIDirect said in a note.

Analysts believe this is liquidity-driven market where we see valuations at fair level for short term, but said that a correction cannot be ruled out.

Buoyant investor sentiment saw the benchmark Sensex and Nifty indices scale 32-month high levels during the past week on heavy capital inflows, following a rebound in global markets. The domestic market was closed on Friday (September 10) for the Eid-ul-Fitr festival.

Registering one of the best weekly gains for the current calender year, the Bombay Stock Exchange benchmark Sensex rose 578.23 points, or 3.17 per cent, to end the week at 18,799.66, its best close since January 18, 2008.

Foreign institutional investors have made a net investment of Rs 3,402.90 crore in Indian equities so far in the current month, taking their total investment so far in the local stock market this year to Rs 62,784.50 crore.

On the global front, almost all major indices, including the S&P 500 and Dow Jones, ended in the green last week.

Omar Abdullah                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                 New Delhi, Sept. 13: On a day this summer's nastiest bouts of violence claimed 14 lives in the Kashmir Valley, Prime Minister Manmohan Singh found his peace package blockaded by mounting concerns over the security implications of revoking the armed forces act in some non-border districts.                                                                                                                                                                                                                         A three-hour meeting of the cabinet committee on security (CCS) this evening failed to iron out internal discord and ended on the rather anodyne note of issuing another appeal for calm in Kashmir.                                                                                                                                                                                                                                                                                                     On Monday, 14 persons lost their lives in the deadliest day yet of azaadi protests in the Valley, the anger and violence being fanned by an Iranian channel that aired footage of the alleged desecration of the Quran in the US.                                                                                                                                                                                                                         In addition to renewing its dialogue offer to "address the issues agitating the minds of the people of J&K, especially the youth", the CCS also called an all-party meeting on Wednesday on the spiralling crisis.                                                                                                                                                                                                                                                                                                     But having failed to push the initiative through the CCS, the Prime Minister is unlikely to find endorsement from a wider body. The BJP, already a vociferous critic of any bid to tinker with the Armed Forces Special Powers Act (AFSPA), will, on the contrary, demand that the Omar Abdullah government be dismissed for its failure to get a grip on the law and order situation, making the Prime Minister's predicament even more confounded.                                                                                                                                                                                                                                                                                                     It is not merely the defence forces that have stiffened opposition to any changes to the AFSPA, the Congress, too, is divided.                                                                                                                                                                                                                                                                                                     Former Jammu and Kashmir chief minister Ghulam Nabi Azad, for instance, is strongly opposed to any security content in the peace package and has been arguing that the Omar government must be pressured to get a grip on the unrest that has claimed over 80 lives over the past three months.                                                                                                                                                                                                                                                                                                     It is perhaps significant in this context that among the issues the CCS statement promised to address were that of "trust deficit and governance deficit".                                                                                                                                                                                                                                                                                                     While the Centre has consistently backed Omar through the current crisis, it has been less than pleased with his handling of the situation and positively disappointed with his disconnect with the agitating Kashmiri masses.                                                                                                                                                                                                                                                                                                     As the peace package remains mired in differences, political pressure is building on Omar who finds himself caught between an incensed constituency and a Centre that is dragging its feet on providing him concessions that he could sell in Kashmir.                                                                                                                                                                                                                                                                                                     Omar, sources in the National Conference said, was "angry and upset" that New Delhi had not been able to deliver what he had repeatedly been promised.                                                                                                                                                                                                                                                                                                     "We need something to go to the people with, expectations have been raised and when nothing happens, it strengthens the hands of those in Kashmir who say New Delhi is not interested in addressing the aspirations of the people of Kashmir," a senior National Conference leader told The Telegraph.                                                                                                                                                                                                                                                                                                     A measure of Omar's exasperation was the fact that late tonight he fielded two ministers — Ali Mohammed Sagar and Ghulam Hasan Mir — to attack the Centre for "hurting genuine Kashmiri aspirations by consistently failing to deliver on promises".                                                                                                                                                                                                                                                                                                     Arguing that the Omar government was fighting a "tough battle" against separatist and militant elements in the Valley, an irate Sagar said: "We have the responsibility of leading our people and fulfilling their aspirations. New Delhi is not helping the cause by continuing to be indecisive about announcements that the people of Kashmir have been expecting."

In a sudden flare-up of violence in Kashmir today, 17 people, including a policeman, were killed and over 70 injured with mobs torching several government properties and a school, some of the trouble triggered by a TV report alleging desecration of the Quran in the US. The state cabinet, which met this evening, condemned the alleged act of desecration and made a fervent appeal to the people not to take law in their own hands. In New Delhi, Prime Minister Manmohan Singh voiced concern over the ongoing unrest in Jammu and Kashmir.

As the strife in Kashmir continues for yet another day, security forces have unearthed a militant hideout in Doda. Tension has been escalating in the Valley between the forces and the locals. Protesters took to the streets risking their lives.
Meanwhile in New Delhi, the Congress Working committee (CWC) met to decide the schedule to elect the party  chief. Kashmir was also discussed at the meet.
Party sources said the CWC spent considerable time of the over one-hour long meeting discussing Kashmir. The Congress is part of the alliance headed by the National Conference in Jammu and Kashmir and sections in the party have been insisting that Chief Minister Omar Abdullah make more concerted efforts to reach out to the people.

With the violence in the valley continuing to soar, non-Kashmiris are fleeing before they're targetted. Indian Railways suspends operations in the state till things return to normal.
Meanwhile on the political front, questions are being raised whether chief minister Omar Abdullah can really curb the violence.
A group of senior Congress leaders, including legislators, former ministers and parliamentarians, met top party leaders including Prime Minister Manmohan Singh, Finance Minister Pranab Mukherjee and AICC general secretary Prithviraj Chavan over the past two days to express their apprehensions about Omar's ability to handle the current crisis.

Kashmir continues to burn as protesters defy curfew in most parts of the valley and there is no let-up in violence and clashes between protesters. Security forces have claimed another life today and left five others injured.
Kashmir CM Omar Abdullah has asked the Centre for more paramilitary forces to restore calm in the state. Omar is facing the heat for the escalation in violence and unabated street protests in Kashmir. Meanwhile, Congress President Sonia Gandhi wants the perpetrators punished and has said the government will continue to push for development.
The government believes that the two Hurriyat factions aided by anti-India elements from Pakistan are fueling the violence and aggravating the situation in the valley. Despite restrictions, separatists groups are protesting human rights violations by security forces.
Caught in the midst of the violent clashes are innocent civilians. Traders in Kashmir are suffering huge losses due to the prevailing instability in the valley.  An eight-year-old boy was among those killed in yesterday's violent clashes.
The valley has witnessed violent protests since June 11, claiming more the 36 lives. In one of the worst attacks this year, on August 1 a mob set fire to an abandoned police station near Srinagar. Four civilians were killed and 35 others injured as protesters pelted stones at police personnel.

Kashmir is on the edge as violence continues to erupt and political parties refuse to cooperate with Chief Minster Omar Abdullah in his relentless fight for peace.
Kashmir has been burning since July when curfew was imposed in Srinagar, Budgam, Anantnag, Pulwama, Pampore and Kupwara. The army was deployed to control the situation and restrictions on movement imposed in Sopore and Baramulla.
Curfew was imposed on July 6 after three people were killed in firing allegedly by security forces. Violent protests have left four dead. On Tuesday (July 6) evening, a teenager was shot dead; earlier that day, the body of a 17-year-old boy was found in a canal. The army staged a flag march on July 7 at the Srinagar Airport road. curfew was finally lifted on July 11 and the situation described as "peaceful".
Prime Minister Manmohan Singh has called for a cabinet meeting to discuss the Kashmir issue after CM Omar Abdullah asked the Centre to intervene. The J&K government has also banned the movement of media persons on July 7 following strict curfew restrictions.
On Monday July 12, CM Omar Abdullah convened an all party meet which was boycotted by Mehbooba Mufti-led PDP. Congress was not at all happy with its abstinence as clearly stated by its spokesperson Manish Tewari:
"Every political party which considers itself in the mainstream has to rise above politics and help restore peace and isolate the separatists."
One of the outcomes of the all-party meet was that they decided to set up an independent committee to probe the civilian killings in the recent violence in the state.
"The chief minister said a delegation would meet Prime Minister Manmohan Singh to urge the central government to strengthen the stalled peace process through a dialogue."
In the meantime, it is the common man, children in particular,  who are being affected the most as markets, educational institutions, banks and other business establishments remain closed and public transport is off the roads.  Tourism has been hit hard by the unrest in the valley. Life continues to be paralysed as restrictions  are still imposed in parts of the old city.
And while Kashmir burns, the politicians scramble to score brownie points over each other. The Opposition, BJP, leave no opportunity to scream "complete lack of political will to counter the separatists in the state…"

The Armed Forces (Special Powers) Act (AFSPA), was passed on September 11, 1958 by the Parliament of India.[1] It conferred special powers upon armed forces in what the language of the act calls "disturbed areas" in the states of Arunachal Pradesh, Assam, Manipur, Meghalaya, Mizoram, Nagaland and Tripura. It was later extended to Jammu and Kashmir as the The Armed Forces (Jammu and Kashmir) Special Powers Act, 1990 in July 1990.[2]
According to the Armed Forces Special Powers Act (AFSPA), in an area that is proclaimed as "disturbed", an officer of the armed forces has powers to:

• "Fire upon or otherwise use force, even to the causing of death, against any person who is acting in contravention of any law" against "assembly of five or more persons" or possession of deadly weapons.
• To arrest without a warrant and with the use of "necessary" force anyone who has committed certain offenses or is suspected of having done so
• To enter and search any premise in order to make such arrests.

It gives Army officers legal immunity for their actions. There can be no prosecution, suit or any other legal proceeding against anyone acting under that law. Nor is the government's judgment on why an area is found to be "disturbed" subject to judicial review.
It was withdrawn by the Manipur government in some of the constituencies in August 2004 in spite of the Central government not favouring withdrawal of the act.
In December 2006, responding to what he said were 'legitimate' grievances of the people of Manipur, Prime Minister Manmohan Singh declared that the Act would be amended to ensure it was 'humane' on the basis of the Jeevan Reddy Commission's report, which is believed to have recommended the Act's repeal.[3]
The Act has been employed in the Indian administrated state of Jammu and Kashmir since 1990.[2]
On 23 March 2009, UN Commissioner for Human Rights Navanethem Pillay asked India to repeal the AFSPA. She termed the law as "dated and colonial-era law that breach contemporary international human rights standards."[4][5]
Violence has increased in the past two decades since enforcement of the Act[6]. The state has created a "Gallantry Awards" pool for the arms forces which are awarded for elimination of insurgencies and conduction of operations. The term 'encounters' is used by the security forces to describe confrontations where it is deemed appropriate, under the provisions of the act, to employ violence.[6]
Protests began in Kashmir valley on Sep 10, 2010, on the occasion of Eid and turned violent on Sep 11, the anniversary of the controversial act. Indian Goverenment is considering partial withdrawal of the act.

When India presented its second periodic report to the United Nations Human Rights Committee in 1991, members of the UNHRC asked numerous questions about the validity of the AFSPA. They questioned the constitutionality of the AFSPA under Indian law and asked how it could be justified in light of Article 4 of the International Covenant on Civil and Political Rights, ICCPR.
The Attorney General of India responded that the AFSPA is a necessary measure to prevent the secession of the North Eastern states. He said that a response to this agitation for secession in the North East had to be done on a "war footing." He argued that the Indian Constitution, in Article 355, made it the duty of the Central Government to protect the states from internal disturbance, and that there is no duty under international law to allow secession.

The act has been criticized by Human Rights Watch as a "tool of state abuse, oppression and discrimination".[7][8]
The South Asian Human Rights Documentation Centre argues that the governments' call for increased force is part of the problem.
"This reasoning exemplifies the vicious cycle which has been instituted in the North East due to the AFSPA. The use of the AFSPA pushes the demand for more autonomy, giving the people of the North East more reason to want to secede from a state which enacts such powers and the agitation which ensues continues to justify the use of the AFSPA from the point of view of the Indian Government." - The South Asian Human Rights Documentation Centre[9]
A report by the Institute for Defense Studies and Analysis points to multiple occurrences of violence by security forces against civilians in Manipur since the passage of the Act[10], and declares that the Act has "resulted in large-scale violation of the citizens under Articles 14, 19, 21, 22, and 25 of the Constitution". The report states that residents believe that the provision for immunity of security forces urge them to act more brutally.[10] The report also gives a grim picture of the effects of removal of the Act.
[11] In addition to this, there have been claims of disappearances by the police or the army in Kashmir by several human rights organizations.[12][13]

Many human rights organizations such as Amnesty International and the Human Rights Watch (HRW) have condemned human rights abuses in Kashmir by Indians such as "extra-judicial executions", "disappearances", and torture;[14] the "Armed Forces Special Powers Act", which "provides impunity for human rights abuses and fuels cycles of violence. The Armed Forces Special Powers Act (AFSPA) grants the military wide powers of arrest, the right to shoot to kill, and to occupy or destroy property in counterinsurgency operations. Indian officials claim that troops need such powers because the army is only deployed when national security is at serious risk from armed combatants. Such circumstances, they say, call for extraordinary measures." Human rights organizations have also asked Indian government to repeal[15] the Public Safety Act, since "a detainee may be held in administrative detention for a maximum of two years without a court order."[16].

Even as fresh clashes rocked the valley today, separatist Syed Ali Shah Geelani called for more protests to highlight their demands

Hardline faction of Hurriyat Conference led by Syed Ali Shah Geelani has issued a curious 11-day protest schedule asking people of Kashmir to carry out normal activities of life from dusk to dawn on strike days.

As per the schedule, only two days - September 19 and 22 - have been exempted from strikes and protests by the Geelani-led Hurriyat faction which is spearheading the ongoing agitation in the Valley.

The striking point in the protest schedule is that the hardliners have asked the people of the Valley to carry out day to day activities from 7 PM to 7 AM on the strike days.

"All business establishments, including manufacturing units, flour mills and cement factories will remain open from 7 PM to 7 AM," the statement issued by the Hurriyat said.

It also said shops and other business establishments can do the normal business during night hours. Transporters can ply normally during night, it added.

Mr. Geelani has called for a march to the security forces' camps on September 21 for holding protests to highlight their demands.

The Kashmir Valley has been rocked by violent protests since June 11 following the killing of a teenager during alleged firing by security forces here. The unrest has so far claimed 88 lives.

Kashmir naked parade video: Cases registered for uploading morphed pictures
SRINAGAR: Jammu and Kashmir Police today registered two cases against unidentified persons for uploading "morphed pictures" on prominent social networking sites to incite people against security forces in the Valley.

A police spokesman said that efforts were on to trace the origin of the video clipping, purportedly showing four men being paraded naked by uniformed personnel in Kashmir, and apprehend the persons responsible for morphing and uploading it.

"Some miscreants are making repeated attempts to upload morphed pictures on YouTube against security forces to incite people. Two cases already stand registered in this connection with the Crime Branch," he said here.

The video clipping first appeared on YouTube and then was widely circulated on Facebook social networking site.

The spokesman said uploading transmission of such pictures is criminal offence punishable under section 66-A of Information Technology Act.

"It is also punishable under Section 505 of Ranbir Panel Code which is a cognizable offence and attracts a rigorous imprisonment for three years and fine," the spokesman said, requesting the general public to cooperate with the government for maintenance of public order.

"The general public is advised not to fall prey to such unverified and baseless rumours. They may dial 100 for any information or assistance," he said.

The clashes on Tuesday in Baramulla, north of Indian Kashmir's main city of Srinagar, came a day after violence that led to the deaths of 19 people. Three protesters were wounded on Tuesday, according to a police officer speaking on condition of anonymity to the Associated Press news agency. Another two demonstrators were injured in a village close to Srinagar when police fired shots at them, the officer said. The shooting sparked further clashes. Thousands of police have been stationed in the region to prevent further violence, while all fights to Srinagar have been suspended. 'Go India' Monday's protests were held against Indian rule and reports of Quran burning. It was the most deadly day of violence since mass demonstrations began three months ago, state police said. We want freedom.'' Security forces shot live ammunition at some of the crowds, killing people in at least five different villages, a police officer said. In the village of Tangmarg, troops fired at thousands of rock-throwing demonstrators, killing five people and wounding at least 50 others, the police officer said. Earlier, protesters burned at least four government buildings as well as a schoolhouse in the town. In Budgam, troops tried to disperse demonstrators with tear gas and baton charges but began firing into the crowd after protesters attacked a police station and the government forces with rocks, the police officer said. At least four people including a young woman were killed and at least 30 others were wounded, some critically. A policeman was also killed during the protests in Budgam after he was hit by a vehicle that then sped away, the officer said. At least four other protesters were killed in three other towns, he said. 'House arrest' Mirwaiz Umar Farooq, the main separatist leader, told Al Jazeera there is no room for political protest in Kashmir. * Despite a rigid curfew tens of thousands of protesters have taken to the streets on Monday [Reuters] "I have been under house arrest since Eid, many of my party have been arrested," Farooq said. Monday's toll included at least seven people killed in police clashes after thousands of Muslim protesters set fire to a Christian missionary school and government buildings in two Kashmiri districts to denounce reports on the Iranian state-run channel, Press TV, that copies of the Quran had been damaged in the US over the weekend. Though a Florida pastor called off his plans to burn the Muslim holy book, the channel showed footage of a different man destroying a Quran. The protesters chanted "Down with Quran desecraters,'' and protest leaders denounced the alleged desecration in speeches to the crowds. The death toll was the highest since separatist protests broke out in June against Indian rule in the northern state. In a statement at the end of a special cabinet meeting on Kashmir, on Monday, the Indian government said it was "deeply distressed by the turn of events" and appealed for calm. 'Incoherent policy' However, it decided against heeding calls from some in the government to partially lift a 20-year-old army emergency law, that gives sweeping powers to security forces in Kashmir. The government offered to take part in talks with all peaceful groups in Kashmir, which would cover the "trust deficit and the governance deficit". It also called an all-party meeting for Wednesday in New Delhi "to take certain initiatives and measures that will build confidence of people." Saeed Naqvi, a political commentator based in New Delhi, told Al Jazeera that Delhi has been preoccupied with other problems and ignored the Kashmir issue. "There is a trust deficit [between India and Kashmir] and it has been addressed by inaction, unimaginative policy, even absence of policy, on the part of New Delhi," he said. "There is angst and anger [in Kashmir]. After three months of bloodshed and agitation ... [the struggle] has acquired an intensity and velocity. All they had to do was tone down the profile of the army. "Nobody likes a foreign army and the Indian army looks like a foreign army to them."

Uttarakhand CM backs further division of UP

VARANASI: Uttarakhand Chief Minister Ramesh Pokhriyal has favoured further division of Uttar Pradesh saying that smaller states achieve better growth rate.

"For better development, Uttar Pradesh should be further divided," he said here yesterday.

Pokhriyal said that small states can achieve better growth.

Giving the example of his own state, the CM said that the growth rate of Uttarakhand was at 2.9 per cent at the time of its inception, but now it is growing at 9.31 per cent and the state stands at third place in country in terms of growth.

The per capita income of the state has risen from 14,000 per person to 42,000 per person which is higher than the national average, he added.

After Uttarakhand was craved out of Uttar Pradesh, demands for making Poorvanchal and a Harit Pradesh grew stronger.

Pokhriyal also paid a visit to Kashi Vishwanath temple and attended the aarti at the Dashaswamegh ghat.

He also appealed to the people to make the river Ganga pollution free.

China building aircraft carrier: Mao's grandson

China building aircraft carrier: Mao's grandson

China is building an aircraft carrier, close on the heels of developing carrier-killer missiles and advanced nuclear submarines, with the confirmation of it coming from none other than Maj Gen Mao Xinyu, the grandson of Mao Zedong.

The Mao junior, who has been a strong advocate of the Chinese navy acquiring the big ships to counter US naval superiority confirmed that Chinese marine forces were building a carrier, without specifying its tonnage.

"As a General, I was very interested in the development of the Second Artillery Corps and our Marine forces. I am glad to know that the marines are constructing the first aircraft carrier," the General was quoted as saying by the web edition of the state run 'Global Times' today.

Despite building a strong navy with a host of warships and submarines, China so far did not have an aircraft carrier and speculation has been rife in the West that Beijing is building one, but there was no confirmation so far.

Recently, influential Japanese daily 'The Asahi Shimbun' had said that China would produce its first aircraft carrier within five years.

US naval intelligence sources have said that China is building two 50,000-60,000 ton aircraft carriers to be equipped with Russian SU-22 fighters. These are expected to be ready by 2015.

There have also been reports that China may opt to build nuclear powered carriers.

There is a steady build of public opinion by official media in recent weeks for developing carriers in the light of steady rise in military tensions in the Korean peninsula as well as China's plans to build dominant blue water navy on the lines of its rival US.

According to US sources, China is almost ready to deploy its 1500 kms range anti-ship carrier killer missile, capable of destroying aircraft carriers from a long distance.

Obama's IT czar coming to India

With less than two months for his planned visit to India, US President Barack Obama will soon send his top IT czar Aneesh Chopra to the country with a high-powered technology delegation.

The delegation to be co-led by Indian American Chopra, who is chief technology officer for the US President, and Secretary of State's Senior Advisor for Innovation Alec Ross, would travel to New Delhi and Rajasthan.

Obama is scheduled to visit India in November. This Delegation is an important first step of the US-India Innovation Exchange, announced by Secretary of State Hillary Rodham Clinton and External Affairs Minister SM Krishna during the June 4 US-India Strategic Dialogue.

As a product of the US-India Strategic Dialogue, this Innovation Exchange reinforces Obama's and Prime Minister Manmohan Singh's commitment to strengthening Indo-US robust relationship through partnerships in the many areas in which the two countries have common interests, an official US release said.

Technology is one area where the US and India share not only common interests but also common innovation-based cultures devoted to cutting-edge research and visionary entrepreneurship, it said.

Both the US and India are recognised global leaders in a variety of technology sectors, from software and computing, to telecommunications and energy, it said.

The Technology Delegation is designed to leverage US and Indian expertise to help produce real-world technology solutions in three areas of energy, education, and e-Governance.

Through meetings with Indian business and government leaders, and visits to innovative Indian organisations, we aim to spur productive discussion and thought around identifying new projects, the State Department said.

"This Delegation aims to deliver projects ready for investment and ultimate market entry. All projects will be characterized by strong US-India collaboration and a clear path to execution," the statement said.

"Project ideas can take many forms, including public-private partnerships, private-private joint ventures; and working groups dedicated to finding new ways to tackle big problems," it said.

"Given that the US and India share strong cultures of creative idea generation and innovative risk-taking, we are optimistic about the potential of new projects arising from the Delegation," the State Department said.

Govt to go slow on expressways after Sonia intervention

NEW DELHI: The government's ambitious plan of building around 18,637 km expressways by 2022 has hit a roadblock. Following the recent farmers protests against the Yamuna expressway project in Uttar Pradesh and Congress president Sonia Gandhi's remark favouring justifiable compensation for land acquisition, the government has decided to go back to the drawing board on the creation of an expressway authority and the funding pattern of the projects.

The ministry of road transport and highways, which was in the process of finalising a draft bill for creation of an expressway authority and take views of state governments, has decided to go slow on the proposals. Last year, highways minister Kamal Nath had announced that a separate authority will be created by 2010 for implementation of expressway projects. The plan has been shelved for a few months till the Centre firms up its land acquisition policy.

According to sources, the ministry has been seriously considering the same design, build, finance and operate (DBFO) model as employed by Uttar Pradesh government for Yamuna expressway. Under this model, the government would acquire land for the private developer who would in turn design and build the expressway. The builder would get the rights for collecting toll and real estate development alongside the expressway for a certain period. It would also have rights to develop land for residential, commercial and institutional purposes along the alignment.

The government was eyeing good revenue through positive viability gap funding of 20% for expressways. The ministry, however, has decided to put brakes on this as the entire exercise would require land acquisition on a massive scale. A senior ministry official, on the condition of anonymity, said, "Expressway plans would take time now, it may be delayed till next year end. We hope the rural development ministry pushes the land acquisition (amendment) bill and resettlement and rehabilitation bill in the winter session of Parliament. After that we will start the process of finalising the bill for creation of the expressway authority and the funding pattern."

So far, the government has approved construction of 1,000 km of expressways under NHDP Phase-VI at a cost of `16,680 crore with a deadline of December 2015. These include Vadodara-Mumbai, Delhi-Meerut, Bangalore-Chennai and Kolkata-Dhanbad Expressways.

This delay in finalising the authority and funding pattern could hit the government's plans to award 11 expressway projects by the end of the current Five Year Plan. The projects are a part of the first phase of expressway networks in Maharashtra, Gujarat, Andhra Pradesh, Delhi, Haryana, Kerala and Tamil Nadu.

In the second phase, scheduled between 2013 and 2017, about 3,690 km will be added with the longest stretch being over 700 km. The third phase, between 2018 and 2022, will add another 6,031km. Depending on the need, the third phase may also see construction of an additional 5,275km of expressways on annuity model.

$11 bn defence deals lined up for Prez visits

NEW DELHI: There is nothing like mega arms deals to sweeten presidential visits. With Obama, Sarkozy and Medvedev slated to come here in November-December , India is fast-tracking major defence contracts with US, France and Russia.

The high-profile visits will, of course,see bilateral talks and agreements on a host of nonmilitary issues. But with India being one of the world's largest importers of military hardware and software—it has inked contracts worth over $50 billion since the 1999 Kargil conflictvisits here are often used to push defence deals to serve larger geo-strategic interests.

While France will get the over $2.1 billion Mirage-2000 upgrade contract, India is likely to shell out $6 billion for the Russian Sukhoi T-50 PAK-FA fighter aircraft (FGFA) project.
Superior to US Raptor, Sukhoi PAK-FA to fit IAF needs

New Delhi: Besides France and Russia , India is on course to finalize its biggest-ever defence contract with the US for 10 C-17 Globemaster-III giant strategic airlift aircraft, which will come for upwards of $3 billion, under the American Foreign Military Sales (FMS) programme. "The Mirage and FGFA contracts will probably be inked during the visits of Sarkozy and Medvedev in December. The C-17 negotiations, however , might not be concluded by the time Obama comes visiting in early-November ," said a senior official.

India and France have been negotiating the upgrade of 56 Mirage-2000 s, which were first inducted into the IAF combat fleet in the mid-1980 s, for over three years now. But the bone of contention till now was the upgrade price being demanded by French companies Dassault Aviation (aircraft manufacturer ), Thales (weapons systems integrator ) and MBDA (missile supplier ), which was around 30% more than what India was ready to pay. "But the project has been finalized now, with only a few contractual issues left to be ironed out,'' said another official. Similarly, New Delhi and Moscow have for long been negotiating the detailed commercial and design contract for the FGFA, with India keen on inducting 250 of these fighters from cash-strapped Russia from 2017-2018 onwards, as reported by TOI earlier.

Billed as superior to the American F/A-22 'Raptor' , the world's only operational FGFA as of now, the Sukhoi PAK-FA for India will now be tailored to the IAF's requirements, with Hindustan Aeronautics as a codeveloper . "Our FGFA will be much cheaper than Raptor or the F-35 (being developed jointly by the US, UK and seven other countries). Phase-I of the FGFA contract with Russia has been finalised, which will now go to the CCS for approval. Later, Phase-II will be finalized," the official said. The US, on its part, is now cornering a major chunk of the Indian defence market . After the $2.1 billion for eight P-8 I long-range maritime reconnaissance aircraft inked in 2009, all eyes are now on the C-17 contract. India, in fact, may even go for another six C-17 s after the first 10.

BJP questions PM's silence on Obama's anti-IT moves

NEW DELHI: BJP on Sunday questioned Prime Minister Manmohan Singh's silence over US President Barack Obama's "protectionist" approach on outsourcing. It also took a dig at the relationship between the prime minister and the American president.

"Dr Manmohan Singh claims that the Indo-US ties are on a new high. We also support good relations. Mr Obama has said that when Dr Manmohan Singh speaks, the whole world listens to. Mr Obama has used the language of protectionism. Will the prime minister speak now or will he maintain his usual conspicuous silence?" BJP's chief spokesperson Ravi Shankar Prasad asked.

The party demanded that the UPA government take up the cause of the Indian software companies, which could be hit by the anti-outsourcing trend in the US. Indian IT companies, such as Infosys, Wipro, HCL and TCS, get 60% of their export revenue from the US.

Ohio banned outsourcing of government IT services to foreign lands weeks after the US government had increased the fee for H-1B and L1 visas. Mr Obama's statement last week that he would end tax breaks for companies that create jobs and profits in other countries has cast a cloud on the ties between the two countries ahead of the presidential visit next month.

"It's ironical that the biggest supporter of globalisation and free world is now talking of protectionism. Indian companies with their excellent professionals, software engineers and entrepreneurship have done India proud globally," Mr Prasad said.

The Indian IT sector has said that the move by the state of Ohio to ban outsourcing by government departments to offshore locations like India was discriminatory and amounted to a trade barrier. Commerce and industry minister Anand Sharma has termed the US moves to curb outsourcing "regressive".

The US has also indicated its unhappiness with the final shape the nuclear liability bill took, after the UPA government made crucial changes to get BJP on board to ensure its passage in Parliament.

Musharraf to launch his political party in London on Oct 1

Former president Pervez Musharraf, who has announced his intentions to return to Pakistan before the 2013 general elections, will formally launch his new political party and unveil its programme in London on October 1.

Musharraf, 67, is also planning to hold a show of power in Birmingham on October 3, less than two months after a man hurled his shoes at President Asif Ali Zardari during a rally in the same British city with a large population of Pakistani origin.

The former military ruler's spokesman Mohammad Saif told the Dawn newspaper that Musharraf would "start his political journey at a press conference (in London) on October 1".

Musharraf will address a public rally at the Oval Banqueting Suite in Birmingham's Sparkhill area two days later, media reports said.

The meet is being described by Musharraf's aides as a demonstration of the support enjoyed by his new party, the All Pakistan Muslim League, among Pakistanis abroad.

Supporters of Musharraf from the Middle East, the US, Europe and Pakistan, including former Foreign Minister Khurshid Mehmood Kasuri, are expected to attend the meet.

Musharraf has reportedly chosen Birmingham as the venue for the meet because of the strong backing from Khalid Mahmood, a local Labour party MP.
Before the show of power in Birmingham, Musharraf will hold meetings of his new political party in London.

During the planned interaction with the media, Musharraf will launch his party's manifesto, explain how he rates the current government and opposition in Pakistan and outline his future plans.

Musharraf's supporters are planning another gathering in Manchester on October 9.

The MP has stood by Musharraf all along and has hosted him at the House of Commons on a number of occasions despite the opposition from many British Pakistani groups.

Chaudhary Aslam Wassan, the APML coordinator for Birmingham, claimed Musharraf has a lot of support among expatriate Pakistanis who have nostalgia for his time in power "when the land mafia and criminal gangs were under control and foreign investors were flocking to Pakistan".

"He served Pakistan wholeheartedly. Compare today's Pakistan with Mushararf's period. It has been taken over by bandits who only want Pakistan for their children," Wassan said.

A mob has defied a curfew in Indian-administered Kashmir, pelting the security forces with stones.
Police fired tear gas at the group in Khanpora Baramulla district, north Kashmir, and one man was injured. The curfew has been extended to new areas.
Meanwhile, all commercial flights to Kashmir have been cancelled for three days, because of the ongoing trouble.
Police shot dead 18 civilians on Monday in the deadliest day since the Kashmir protests erupted three months ago.

The BBC's Chris Morris in Delhi says that there is now an enormous sense of anger, and many people see this as the biggest challenge to Indian rule in Kashmir for 20 years.
Our correspondent says that the government in Delhi seems to be divided about how to respond - even Prime Minister Manmohan Singh admitted last week that the government was groping for a response.
One suggestion supported by Jammu and Kashmir Chief Minister Omar Abdullah - a government ally - was to ease emergency regulations as a gesture of goodwill.
But a decision on that has been put on hold - many in the security establishment do not approve.
Our correspondent says that there is no sign at all of any progress towards a lasting settlement of the Kashmir dispute, which has poisoned relations between India and Pakistan for six decades.
The latest protests in Srinagar were over reports of Koran desecration in the US, which stoked public anger.
The curfew was extended on Tuesday to cover fresh areas and thousands more federal police were deployed across the valley.
Police patrolled the streets of Srinagar using loudspeakers to warn residents to stay indoors.
