Delhi High Court dismisses frivolous case by V.K. Saxena challenging medical certificate of Medha Patkar

 


The criminal revision petition filed challenging the medical certificate of Medha Patkar and seeking revision of dismissal order of the Metropolitan Magistrate was rejected admission, by the single judge bench of Justice Ajay Bharhoke of the High Court of Delhi. The petition  was filed by Mr. V. K. Saxena,  who have been filing  many petitionsand has published defamatory advertisements against Narmada Bachao Andolan & Medha Patkar but lost the case in  the Supreme Court and was compelled to pay costs. He was also accused in the complaint filed by Medha Patkar on the physical attack on her in Sabarmati Ashram, which is being heard by an Ahmedabad court now.

 

Through the instant petition, Saxena challenged the order of dismissal by Metropolitan Magistrate of Patiala High Court, Delhi. Before the learned Metropolitan Magistrate, Saxena had filed an application under section 197 & 198 of Indian Penal Code on grounds of perjury alleging Ms Patkar's medical certificate as fake. It was on 3.3.2009 that Ms. Patkar couldn't attend a case against Saxena at Patiala High Court, New Delhi due to back pain and doctors advising against long distance travel, while she attended villager's dialogue with the Collector, Nandurbar. There was no contradiction or perjury in the two acts, yet Mr. Saxena challenged the certificate. Justice Bharhoke, considering the petition as outrightly frivolous, rejected even admission of the case. This is certainly an apt order & befitting reply to the harassment by Mr. V.K Saxena, a man associated with certain politicians in Gujarat and hail from the corporate sector against social activists such as Medha Patkar, Mallika Sarabhai, Ashish Nandy etc.
