Home Minister Chidambaram appeals for calm ahead of Ayodhya verdict
: Union Home Minister P. Chidambaram on Wednesday appealed to the general public to help maintain peace in the wake of the court verdict on the Ayodhya issue.Reading a statement, the Home Minister said that hasty conclusions that one side has 'won' or that the other side has 'lost' should not be drawn.
Chidambaram pointed out that there were four suits and there are a number of issues in each suit. Issues were framed by the Trial Court, recast by the High Court, additional Issues were framed by the High Court and, in one case, Issues were recast after certain orders of the Supreme Court.
He said the Issues involve complicated questions of fact and law. Among the questions of fact that are being canvassed are questions relating to possession, dispossession, worship etc.
Among the questions of law that are being canvassed are questions relating to maintainability of the suits, adverse possession, prescription, estoppel, limitation, res judicata, the interpretation of UP Muslim Wakfs Act, 1936
Chidambaram informed it was possible that there would be one or more judgments delivered by the three-judge Special Bench.
He said, "The judgments would have to be read carefully, and the findings of the Hon'ble judges on each of the Issues in the four suits would have to be analysed meticulously, before any conclusions may be drawn."
Chidambaram said that it would be reasonable to assume that one or both sides would immediately apply to the Special Bench of the High Court for leave to appeal to the Supreme Court on the Issues that either side may think have been decided against it.
He pointed out that Article 134A of the Constitution of India allows a party aggrieved to make an oral application in this regard immediately after the passing of the judgment.
Chidambaram said that it was the duty of all organisations concerned to actively work to maintain the peace. In particular, all organisations must urge their members not to spread rumours or make provocative statements."
He pointed out that the authorities have been told maintain the utmost vigil and defuse any situation when there is the first sign of trouble. "It is the Government's earnest hope that all sections of the people will cooperate with the Government in maintaining peace, order, harmony and tranquillity," he stated.
The Home Minister also informed that the State Governments have been advised to take adequate measures to maintain law and order, especially in sensitive areas.
"The Central Government has also taken a number of measures to assist the State Governments. No one needs to have any apprehension, and if every one realises his/her obligations to society, we can, working together, ensure that there is peace, order and harmony," Mr.Chidambarm stated.

All-party team leaves behind hope, fear in Jammu-Kashmir
The all-party delegation led by union Home Minister P. Chidambaram Wednesday wiund up its three-day visit to Jammu and Kashmir and returned to New Delhi from here, leaving behind a gleam of hope and a cloud of fear.The 39-member delegation met almost 1,000 people from a cross section of society in the state and heard people until the midnight. But some people, including commoners and the Kashmiri Hindu leaders, were annoyed at not being given time to interact with the visitors.
The highlight of the visit, however, remained the meeting of some delegation members with the separatist leaders.
The members met hardline separatist leader Syed Ali Geelani twice Monday evening and Tuesday morning and also visited moderates -- All Parties Hurriyat Conference chairman Mirwaiz Umar Farooq, Jammu Kashmir Liberation Front's (JKLF) Yasin Malik in Srinagar and jailed president of the Jammu Kashmir Democratic Freedom Party Shabir Shah in Jammu.
This was being touted as a 'success' of the visit by some delegation members, especially Communist Party of India-Maxist (CPI-M) leader Sita Ram Yechury, who described the interaction with separatists as a 'meaningful exercise'.
Separatists, who had reiterated their known positions during the meetings, are learnt to be waiting as to how the delegation on its return would respond to their suggestions.
'Let's hope that this time you understand things better,' Shabir Shah told the delegates who called on him at a nursing home, where he was temporarily shifted Tuesday, from Kot Bhalwal jail near here, to facilitate his meeting with the delegation members.
It was also a message of hope for some, like Chief Minister Omar Abdullah who felt that the delegation's visit was a 'significant step'. He hoped that there would be 'movement forward' in addressing problems faced by the people in the Kashmir Valley.
More than 100 people have been killed in the valley in over 100 days of renewed unrest and the situation is being kept under control by an almost round-the-clock curfew and heavy deployment of security forces.
Omar Abdullah's National Conference party demanded withdrawal of the Armed Forces Special Powers Act and also greater autonomy to the state - a semi-sovereign status in which the state has all powers except those for dealing with communications, defence and foreign affairs and designation of head of the government as prime minister and that of the head of the state as 'sadar-e-riyasat'.
This very hope of some was a source of fear for many in Jammu. 'We are afraid that the delegation, the way it has reached out to separatists responsible for the trouble in the Kashmir Valley, would do something unacceptable to us,' BJP leader Ramesh Arora said.
The BJP was apprehensive that the delegation might 'fall into the trap of separatists' and announce 'some concessions which would have serious repercussions', Arora said.

Mamata keeps Buddhadeb away from Metro project function
Railway Minister and Trinamool Congress chief Mamata Banerjee Wednesday kept West Bengal Chief Minister Buddhadeb Bhattacharjee out of the list of invitees as President Pratibha Patil laid the foundation stone for a new Metro project here.
'I received no invitation,' the chief minister told reporters at the state secretariat.
State Transport Minister Ranjit Kundu said an invitation card had been sent to his office Tuesday evening after he had left for the day.
'As far as I know, neither the chief minister nor any other state government ministers were invited to that programme. However, yesterday (Tuesday) at 4.30 p.m. an invitation card was sent to my office when I had already left,' Kundu told IANS.
The foundation stone-laying function for the Joka-BBD Bag metro rail line was attended by Governor M.K. Narayanan, union Finance Minister Pranab Mukherjee and Railway Minister Mamata Banerjee, among other dignitaries.
'I cannot comment on this issue,' said a metro railway official.
This is not the first time that Banerjee had chosen to keep out Bhattacharjee and his ministerial colleagues at bay. Earlier, she drew the ire of the state's ruling Left Front for keeping them out of the guest list of various railway programmes.
The Left Front had then claimed that those railway projects would not have been a success without assistance from the state government.
According to Trinamool Congress sources, it is the declared policy of the party that no party leaders will attend a programme or share the dais where Left Front leaders or CPI-M leaders are present.
However, during another programme graced by Patil during the day, state Agricultural Minister Naren De had shared the dais with Trinamool Congress leader Sudip Bandophadhyay.
However, while Bandopadhyay - a Lok Sabha member - addressed the platinum jubilee celebrations of the Marwari Federation, De remained mum.

Navy, coastguard satisfied with coastal exercise
Navy and Coastguard today expressed satisfaction over the successful completion of ''Neptune II'', the three-day coastal security exercise off Lakshadweep islands held from September 14. The exercise, the second in the series for the Islands, and scheduled by the Commander in Chief Coastal Defence, also saw the participation of personnel from the Indian Army and Indian Air Force this time in addition to all other agencies involved in coastal security.In a special media briefing on the conduct of the exercise, Commodore MR Ajayakumar, Naval Officer in Charge and DIG BK Loshali, Commander Coastguard District headquarters praised the high level of security consciousness in the Lakshadweep Islands and emphasised on the prominent role played by the Lakshadweep administration and the police there in the success of the exercise. The conduct of NeptuneII involved the security agencies being divided into playing the roles of anti-national elements and coastal defence force.
"All the attacking elements were successfully neutralised by the coastal defence force during the exercise, signifying considerable progress in the crystallisation of the coastal defence architecture," they said. The Village ''Dweep'' Panchayats and Island vigilance Committees played a robust role in successfully thwarting the ''attacking'' force .
The commitment levels and involvement of all the participating agencies came for praise from the officials who said that vigil was not let down even for a moment in the 49-hour long exercise.
Pakistan asks US to help resolve Kashmir issue
Denying that Pakistan is fomenting trouble in Kashmir, Pakistani Foreign Minister Shah Mahmood Qureshi has asked the United States and the international community to help resolve the Kashmir issue.Pakistan has neither the means nor the capacity to mobilise the young and old to stage protest demonstrations and shut down towns and cities, he said in an address at the Council on Foreign Relations, a think-tank, here Tuesday.
'The international community must recognize that the people of Kashmir, in an entirely indigenous upsurge, are demanding their right to self-determination,' Qureshi claimed adding, 'The occupation cannot continue.'
Qureshi, who reports suggest is likely to meet Indian External Affairs Minister S.M. Krishna on the sidelines of the UN General Assembly session, asked India to take a 'fresh look' at the evolving situation in the territory and sit down with Pakistan to resolve the issue.
'Dialogue is the only way forward...We can do it,' he said. 'We are convinced that sustainable peace can only offer the best guarantee for ensuring a bright and prosperous future for the over one billion people inhabiting the region.'
'Resuming the dialogue process with India, therefore, remains a major objective for us,' Qureshi said noting his talks with Krishna in July were 'useful'.
'We look forward to constructive and result oriented interaction with India on all issues, especially the issue of Jammu and Kashmir,' he said.
The United Nations had recognized the rights of the Kashmiri people long ago, Qureshi said. 'Now is the time for the international community to do something about it.'
'We call upon the United States particularly, which is pressing so responsibly for peace in the Middle East, to also invest its political capital in trying to help seek an accommodation for Kashmir,' he added.
'It has always baffled me that the international community has long recognized that the Palestinian question is the core issue to peace in the Middle East, but does not seem to understand that, similarly, until the status of Jammu and Kashmir is resolved, real peace in South Asia will remain elusive,' Qureshi said.
'The rights of the Kashmiri people cannot continue to be denied,' he said. 'Surely the world can recognize that this resistance is internal and visceral. It may be easy for some to dismiss the uprisings as outside agitation, but no one any longer can seriously believe this.'
Foot over bridge collapses near CWG venue; 23 labourers injured
An under-construction foot over bridge collapsed near Jawaharlal Nehru stadium, the main venue of the Commonwealth Games, injuring 23 labourers.Five of the injured are seriously injured in the incident that occurred at 3.10pm in Lodhi Road area of South Delhi, police said.
The 95-metre long bridge was being built along with another overbridge at the cost of Rs 10.5 crore by Chandigarh-based company PNR Infra, Delhi government sources said.
Public Works Department of Delhi government, which had given the contract to PNR Infra for constructing the overbridge as ordered an inquiry into the incident.
The bridge, whose construction was to be completed soon, was to connect the parking lot of the Jawaharlal Nehru Stadium where the opening and closing functions of Commonwealth Games would be held.
Fire department officials said the labourers were putting concrete mix at a portion of the bridge when the incident took place.
PWD chief Engineer Rakesh Mishra admitted that the incident was a "setback" but expressed confidence that the project would be completed before the Games that start on October 3.
Yesterday, two police personnel, including an officer, had suffered injuries when a canopy erected at the stadium fell on them.
Ayodhya verdict like a semi-final: Pillai
Two days before the court pronounces its verdict in the Ayodhya land title suit, Union Home Secretary Gopal K Pillai on Tuesday said the verdict was "more like a semi-final" and indicated that the hour at which the judgment is delivered on September 24 would be crucial in preventing any kind of law and order problems. "You also had a tourist influx into J&K which is almost 85 per cent higher than the previous year. In March, April and May, you could not get a hotel room in Srinagar. You had all your hotels and restaurants full. You had taxi services running at full capacity all over Kashmir. And then suddenly in June you have the violent eruption. As things improve, there are, in one sense, vested interests who don't want things to improve."
On the internal armed movements in the country, mainly Naxalism, Pillai said, "There the real challenge for us is not really the ideological premise of liberation by armed might. The real challenge for us is really improving our governance. We just don't have governance in many of these areas. The state has moved away for a variety of reasons and the vacuum has been filled up by the CPI (Maoists)."
Portion of false ceiling falls at CWG venue
A small portion of a false ceiling at the main Commonwealth Games venue of Jawaharlal Nehru stadium complex here today fell, causing more embarrassment to the organisers and the government a day after the collapse of an under-construction foot overbridge.Two-three tiles fell this morning from the ceiling of the stadium where the weightlifting event is scheduled to be held, police sources said. No one was injured in the incident. The tiles measures 2 ft by 2 ft.
This is the second incident of collapse in the past three days inside the stadium complex.
On Monday, a canopy collapsed in which two police personnel, including an Additional Deputy Commissioner of Police, suffered minor injuries.
In another incident which took place yesterday outside the complex, an under-construction foot overbridge collapsed when labourers were engaged in work. 27 labourers were injured.
The Centre, the Delhi government and the CWG Organising Committee are under attack for the pace of preparations for the Games.
When contacted, a senior fire official claimed that they were told by Delhi Disaster Management Authority that a mock drill was taking place at the stadium and there was no incident of tiles falling from the ceiling.

What are the issues on which the high court may give its verdict?
There are 28 issues, some of which are:
a) When was it built and by whom — Mughal emperor Babar or his Awadh governor, Mir Baqi Tashqandi?
b) Was it built on the site of a Hindu temple after demolishing the latter?
Does the court need to pass a judgment on each issue?
Courts have to frame issues depending on the pleas in a suit, but they need not rule on them all. In this case, the court seems to have left no avenue unexplored, even directing excavation of the site to unearth evidence. Still, it may not rule on a question if there is not enough evidence to decide it.
What are the legal options before parties in the case that may feel aggrieved by the verdict?
Any party can challenge the verdict in the Supreme Court which, if it admits the appeal, will immediately order status quo. The Supreme Court's decision will be final unless one of the parties seeks a review — by the same bench — or file a curative petition to an apex court bench of at least five judges.
Where does the government come in? Does it have the responsibility of implementing the court order?
The Centre is the statutory receiver of all the disputed 67.7 acres in Ayodhya. It acquired the land on January 7, 1993, through the Acquisition of Certain Area at Ayodhya Act.
The Centre will therefore be called on to implement the verdict unless the court directs otherwise, or unless the verdict is challenged and the Supreme Court imposes status quo. However, the Centre can cite law-and-order problems to stall immediate implementation.
In an earlier case, when demolition of shrines (mostly mosques) by the Ahmedabad Municipal Corporation triggered riots in Gujarat, the Centre had moved the apex court and got an immediate stay on the demolition drive that the state had started at Gujarat High Court's behest.
If tempers flare over the verdict, can the government challenge it in court? Can it enact a law in Parliament to bypass the verdict?
The Centre cannot challenge the verdict in court because it is not a party to the case. The jury is out on whether it can enact a law to undo the court order as it had done in the Shah Bano case of 1986 to invalidate a Supreme Court judgment.
The RSS and the Vishwa Hindu Parishad (VHP) have already demanded a law that will recognise Hindus' "right" to the plot and hand it over to them so they can build a Ram temple there.
Some legal experts say there is a difference between the Shah Bano and Ayodhya cases. They argue the apex court's 1986 ruling (on the maintenance due to divorced Muslim women) was based on an interpretation of Muslim personal law. The Ayodhya ruling is expected to be based on the court's findings and not on interpretation. So enacting a law to bypass it may be problematic, if not impossible, they say.
The Uttar Pradesh (UP) government is one of the defendants, though, and, technically, can challenge the verdict.
How many title suits are involved in the case?
Five. But there are dozens of other petitions — for access, right to worship or pray, writ petitions and the like.
Who are the dramatis personae?
● Retired bank official Rajendra Singh Visharad, son of the late Gopal Singh Visharad who filed one of the first two suits in 1950 (see history of the Ayodhya case below).
● Mahant Ram Das, chela of the Paramhansa Ramchandra Das, who filed the other of the first two suits.
● Nirmohi Akhara, which filed the third suit.
● The Sunni Central Wakf Board, which filed the fourth suit.
● The representatives of Deoki Nandan Agrawal, a retired judge of Allahabad High Court who filed the fifth suit.
What about the VHP, Ramjanmabhoomi Nyas and the Babri Masjid Action Committee (BMAC)?
They were never direct parties to the case but the BMAC has become "a litigant by proxy".
On February 1, 1986, the VHP floated the Ramjanmabhoomi Nyas for "renovation, reconstruction and development" of Ram's "birthplace" and to build a temple. It was headed by Jagadguru Ramanandacharya Swami Shivaramacharya of Kashi (Varanasi). The trustees included Mahant Avaidyanath of Gorakhpur's Gorakshpeeth, prominent Ayodhya mahants like Swami Nritya Gopal Das and the Paramhansa Ramchandra Das, and VHP leaders Ashok Singhal and Vishnu Hari Dalmiya.
The Paramhansa took over as Nyas head in 1992. After his death, Nritya Gopal Das became president.
The BMAC was formed in 1986 shortly after the Nyas's birth. Its original patrons, Sultan Salauddin Owaissi and Suleiman Sait (former MPs) and Abdullah Bukhari (former Shahi Imam of Delhi's Jama Masjid), are dead. Its conveners were former Samajwadi UP minister Azam Khan, former MP Syed Shahabuddin, All-India Muslim Personal Law Board member Zafaryab Jilani and Urdu journalist Jawed Habib.
Among them, Jilani alone is soldiering on in the case as the lawyer for the Sunni Central Wakf Board. The Lucknow-based Jilani had shot into prominence when he advised the personal law board on the Shah Bano ruling.
Will the verdict have any bearing on the demolition cases against Advani and the other Sangh parivar leaders?
No. Those criminal cases will continue to be heard by the designated CBI court.
Some of the issues before the court are historical or mythological. Do courts usually rule on such matters?
The Supreme Court had in 1994 refused to go into the case's archaeological or historical aspects, preferring to return a presidential reference on this.
Jurist Nani Palkhivala has cited several reasons why courts should not rule on historical or archaeological matters:
● Courts are not qualified by training or experience to do so. They can only deal with questions of law or of fact.
● One arm of the state cannot shuffle its constitutional responsibility to another. In Palkhivala's words: "The failure of the political process can never be either concealed or supplemented by any reference to any court."
● If courts enter the political arena, their image and status would be undermined.
● Large organisations with millions of followers have openly said they would not be bound by the court verdict.
Constitutional lawyer Rajeev Dhavan, however, says the historical issues are not important for the title suit: more relevant are issues such as who has the deeds, etc. But, he says, if there is some evidence the court may just record it to try and get one or the other party to back off.
Dhavan says the BMAC had assured the Nyas in 1991-92 that it would back off if the other side could prove that the Ayodhya site was indeed where Ram was born or that there was a temple there in the 1520s.
Have courts ever decided similar cases?
Yes, for instance:
● In 1940, the Privy Council had decided on the Shahid Ganj Masjid in Lahore, taken over by Sikhs in 1762. Although three courts had successively ruled it was a mosque, the council held that Muslims had lost the title by adverse possession. It is still a gurdwara.
● In the Babri-Ramjanmabhoomi case, a Faizabad court had in 1885 dismissed a prayer by Hindus to build a Ram temple next to the disputed structure. Dhavan says that verdict should have been enough. However, the second set of cases since 1950, and the subsequent interim orders and status quo orders, etc, means Allahabad High Court has to take all this into account.

The history: 125th year of original suit, diamond jubilee of the current case
When did the case start?
The first suit goes back to 1885, the year the Indian National Congress was born. The case was revived in 1950.
In 1885, the Faizabad deputy commissioner refused to let Mahant Raghubar Das build a temple on land adjoining the disputed structure. Das then filed a title suit in a Faizabad court against the secretary of state for India, seeking permission to build a temple on the Chabutra on the outer courtyard of the disputed structure.
His suit was dismissed on the ground that the event (alleged demolition of an original Ram temple in 1528) had occurred over 350 years earlier, and so it was "too late now" to remedy the grievance. "Maintain status quo. Any innovation may cause more harm than any benefit," the court said.
How was the case revived in 1950?
On December 23, 1949, an FIR was lodged alleging some 50-60 people had broken the locks of the structure and
installed a Ram idol and several other Hindu idols and articles of worship.
Six days later, the structure was attached and placed in the custody of receiver Priya Dutt Ram, appointed by the Faizabad additional city magistrate. The magistrate provided a scheme of management under which the property was administered. The receiver ensured worship of the idol through a pujari.
This is how the current case started a year later:
Jan 16, 1950: Hindu Mahasabha member Gopal Singh Visharad and the Paramhansa Ramchandra Das, keeper of the Digambar Akhada in Ayodhya, each file a civil suit in the Faizabad court against some district officials and Muslims. They seek an injunction against removal of the idols and demand permission for uninterrupted puja and darshan. An interim court order says the idols should remain in place.
Both Visharad's and the Paramhansa's suits are part of the current case.
Later that year, lawyer Umesh Chandra Pandey appeals that the gates be unlocked and free entry allowed for puja and darshan. This, however, is not a title suit.
April 26, 1955: Court confirms interim order, letting idols remain in place.
Dec 17, 1959: Nirmohi Akhara, a philanthropic body, and its mahant file suit against receiver and UP government seeking delivery of the property to itself. This is the third title suit.
Dec 18, 1961: Sunni Central Wakf Board seeks declaration of the structure as a mosque, handover of the plot to itself, and removal of idols and other articles. This is the fourth suit.
Jan 6, 1964: The four suits are combined
1984: VHP begins campaign to build Ram temple at the site
Feb 1, 1986: District judge accepts Pandey's 36-year-old plea to allow darshan and puja and directs UP government to open the locks. VHP forms the Ramjanmabhoomi Nyas.
Feb 1986: Prominent Muslim leaders form the Babri Masjid Action Committee.
May 12, 1986: Sunni Central Wakf Board challenges the February 1 order.
Dec 16, 1987: UP govt seeks transfer of all suits from Faizabad court to Allahabad High Court. This is soon done.
July 1989: Fifth title suit filed by retired high court judge Deoki Nandan Agrawal on behalf of Ram Lalla (young Ram) Virajman (installed), making Ram a party to the case.
Aug 14, 1989: High court restrains political parties from disturbing status quo at the disputed structure.
Oct 25, 1989: Court allows UP govt to take possession of land around the structure but later, on an appeal from Muslim groups, sets aside the acquisition of the 2.77 acres adjacent to the disputed structure. Prohibits permanent construction. UP govt still has 42.09 acres around the 2.77 acres.
Nov 10, 1989: Congress govt at Centre allows shilanyas by VHP outside the 2.77 acres. Foundation for Ram temple laid.
March 20, 1992: UP's Kalyan Singh (BJP) govt transfers 42.09 acres to a private trust, the Ramjanmabhoomi Nyas. VHP and RSS are trustees.
Nov 27, 1992: Supreme Court permits symbolic kar seva on UP govt's assurance.
Dec 6, 1992: Structure demolished and idol "reinstalled".
Jan 1, 1993: High court orders meaningful darshan on VHP plea
Jan 7, 1993: Centre acquires the entire disputed land through an act. Gets President to ask Supreme Court's opinion on whether there was an ancient Hindu temple at the site and promises to do everything to implement the court's opinion.
Oct 24, 1994: Apex court in a majority decision declines to consider the presidential reference and returns the case to the Lucknow bench of Allahabad High Court.
March 13-14, 2002: High court bans all religious activity, symbolic or actual, at the site
Admiral stirs questions on Israel's "nuclear" subs
An apparently innocuous note from an official history of Israeli submarines has offered a glimpse into the murky depths of the country's nuclear secrecy.Contributing a preface and summation chapter for the recently published "Israeli Vessels in the Fourth Dimension", former admiral Shaul Chorev writes that the five major powers -- the United States, Russia, China, France and Britain -- have deployed submarines with nuclear-tipped ballistic missiles.
With India planning to match them by decade's end, Chorev writes, it would be "the sixth country in the world to have a sea-based strategic deterrence capability" -- implying, by default, that Israel's submarines carry conventional arms only.
That seems hard to reconcile with analysts' assumptions that Israel's three, diesel-fuelled Dolphin submarines are "second strike" nuclear missile platforms, deterring any catastrophic attack on the Jewish state by promising retaliation in kind.
Though the publishers said the book underwent vetting by military censors, Chorev's statement also appears to clash with the "ambiguity" policy under which Israel neither confirms nor denies having -- or lacking -- nuclear bombs in any form.
As current director of the Israel Atomic Energy Commission, Chorev helps fine-tune this four-decade-old official reticence, making it unlikely that he would commit a faux pas in print.
Asked about the book passage, a commission spokeswoman had no immediate comment. But a former Israeli official who had been in charge of safeguarding state secrets played down its impact.
"He was writing about foreign navies, so this should not be too much of a concern," the ex-official said, also acknowledging that censors were generally more vigilant for disclosures about existing Israeli warheads and delivery systems.
Much hangs on what Chorev means by "capability".
Another former official who spoke on condition of anonymity said Chorev may have been hinting that, while the Dolphins are able to fire nuclear missiles, they are not routinely deployed with them aboard. Unlike nuclear-powered submarines, the Dolphins must be regularly refuelled and serviced in port.
PARSING STRATEGY
"Israel would only need a 'second strike' option when there is the threat of it coming under a 'first strike', and none of its enemies has the bomb yet. That obviously affects operational planning," the former official said.
Stephen Saunders, editor of Jane's Fighting Ships Yearbook, said it looked like Chorev was drawing a distinction between major powers' nuclear submarines, which are big enough to carry long-range "strategic" missiles, and the Dolphin, whose 10 torpedo tubes accommodate much less powerful cruise missiles.
"Therefore, with a nuclear warhead, a cruise missile ... could be described as a sub-strategic weapon. Whether or not the Israelis have such a weapon is open to question," Saunders said.
"I can only suggest that the relatively short range and vulnerability of sub-sonic cruise missiles makes them less credible as a deterrent."
Independent analysts estimate that the Jewish state has anywhere from 80 to 200 nuclear weapons.
Israel has two more diesel-fuelled Dolphin submarines on order from Howaldtswerke-Deutsche Werft, a German firm building them at a steep discount as part of Berlin's commitment to shoring up a Jewish state founded in the wake of the Holocaust.
Negotiations on buying a sixth Dolphin foundered in July after Germany declined to underwrite the purchase again.
German opposition parties have voiced misgivings about providing Israel with another potential nuclear weapons platform. The Israelis may therefore have a vested interest in lowering the strategic import of the submarines.
Still, the menace associated with the Dolphins helps keep world powers focused on pursuing a diplomatic solution to the deadlock around the nuclear plans of Israel's arch-foe, Iran.
For the first time, an Israeli submarine last year sailed the Suez Canal, a potential short-cut to the Iranian coast.

Foreign inflows lift Indian shares to new 32-mth high
* BSE Sensex up 1.6 pct on the day; up 14 pct YTD

MUMBAI, Sept 20 (Reuters) - Rising foreign fund inflows,
which propelled Indian shares to scale a fresh 32-month peak
for the sixth straight session on Monday, also raised concerns
whether the market was rising too soon too fast.
Financials led the rally, which saw the benchmark index
.BSESN close 1.6 percent higher, on robust loan demand
outlook in the world's second-fastest growing major economy.
The 30-share BSE index rose 1.59 percent or 311.35 points
to 19,906.10, with 25 of its components closing in the green.
It touched 19,927,30 points intra-day, its highest since
January 2008.
"The biggest push is the huge amount of money that is
coming in from overseas," said Krishna Sanghavi, head of
equities at Kotak Asset Management.
"Though all rationale as to economic growth and earnings
growth is in place, the concern is we are seeing too much money
coming in a bit too fast."
Foreign funds have bought a net $15.8 billion of Indian
equities so far this year, which has helped the main index gain
nearly 14 percent. This follows a record $17.5 billion net
investment in 2009, which had seen the index rally 81 percent.
For the year to date, the Indian benchmark has outperformed
MSCI's world equity index .MIWD00000PUS and its emerging
markets index .MSCIEF which have gained 0.1 percent and 5.1
percent respectively in the period.
Top lender State Bank of India (SBI.BO) gained 0.4 percent
while leading private lenders ICICI Bank (ICBK.BO) and HDFC
Bank (HDBK.BO) climbed 1.2 percent and 1.9 percent
respectively.
Cigarette-to-hotel business ITC (ITC.BO) climbed as much as
5.9 percent to 178.30 rupees, its highest level in at least 20
years, helped by robust domestic consumption.
Energy major Reliance Industries (RELI.BO) climbed 1.3
percent, as it caught up with the broader market rally after
the recent underperformance. The stock, which has the heaviest
weight on the main index, is still down 4.6 percent in 2010.
"The stocks which had missed out on the broader rally are
now catching up," said Kunal Sukhani, manager of institutional
equities at Asian Markets Securities.
Leading telecom companies Bharti Airtel (BRTI.BO) and
Reliance Communications (RLCM.BO) which were the only two
Sensex negatives to log a yearly loss last year, significantly
underperforming the main index, firmed 2.4 percent and 5.1
percent respectively.
"We initiate coverage on Bharti with thumbs up to Africa,"
JM Financial said in a note adding they arrive at a "buy"
rating for the stock.
Idea Cellular (IDEA.BO) bucked the trend and slipped 1.4
percent as it said it continuously evaluates stake-sale

Export-focused outsourcers continued to rise with sector
leader Tata Consultancy Services (TCS.BO) scaling a new record
high at 921.50 rupees.
"We remain positive on tier-1 IT companies on the back of
significant market share gains against global incumbents," JM
Financial said in a note last Friday, adding that Infosys
Technologies (INFY.BO) was its top sector pick.
Infosys and Wipro (WIPR.BO) rose 1.1 percent and 0.1
percent respectively, while TCS gave up early gains and shed
0.2 percent at close.
Hero Honda (HROH.BO), the country's leading motorcycle
maker, firmed nearly 4 percent after a report suggested KKR &
Co, TPG Capital, Carlyle Group and Bain Capital LLC are
competing to acquire a part of Honda Motor Co's (7267.T) stake

Bharat Heavy Electricals Ltd (BHEL.BO) slipped 0.2 percent
as Credit Suisse downgraded the stock to "neutral" from
"outperform".
The brokerage expects the state-run firm's sales growth to
moderate from 2012/13 (April-March) with no order inflow growth
in the past two years combined with negative growth rates ahead
and extension of execution cycles.
Advancing shares outpaced declining ones in the ratio of
1.5:1 in relatively higher volume of 542 million shares.
The 50-share NSE index .NSEI climbed 1.6 percent to
5,980.45 points.
Elsewhere, the FTSEurofirst 300 .FTEU3 index of top
European shares were up 0.7 percent by 1038 GMT while the
MSCI's measure of Asian markets other than Japan
.MIAPJ0000PUS firmed 0.5 percent.
