Court rejects anticipatory bail plea of Amit Shah

The anticipatory bail plea of Gujarat minister Amit Shah, who did not turn up before the CBI for questioning in the Sohrabuddin Sheikh fake encounter case, was rejected by a special court.
Shah is a close aide of Gujarat Chief Minister Narendra Modi.
CBI Special Court judge G K Upadhaya rejected Shah's application on technical grounds saying it did not mention under what section of IPC he had been made an accused.
Shah had earlier applied for anticipatory bail through his lawyer Mitesh Amin.
The minister of state for home, who had been asked by CBI to present himself before it by 1 pm today, failed to appear before the agency for questioning despite being summoned twice.
Instead his lawyer turned up at the CBI office in Gandhinagar demanding more time and a questionnaire. However, both his demands were rejected.

New Delhi:  While Amit Shah remained missing in Gujarat, where the CBI wants to question him for his alleged complicity in the murder of a Muslim man by senior police officers, the BJP's senior-most leaders held a press conference in Delhi to state they would not attend a lunch at the Prime Minister's home. "The atmosphere would be too bitter," said Sushma Swaraj, confirming that Nitin Gadkari, LK Advani, Arun Jaitley and she were boycotting the meal. The conversation at the lunch table, had the BJP chosen to attend, may have challenged the host's famous diplomatic skills. In the last 48 hours, the CBI has moved with high velocity in Ahmedabad, filing a 30,000 page chargesheet against Shah, a minister and close aide of BJP Chief Minister Narendra Modi.

On Thursday, Shah was served a notice to meet the CBI by 1 pm. But he has not been an easy man to pin down this week. He has not been seen at his office, and skipped a cabinet meeting. When he was a no-show on Thursday afternoon, the CBI issued a second summon, giving him a deadline of 1 pm on Friday.  Shah surfaced only in the form of a statement faxed to the press - he declared his innocence, and said that by giving him little or no time to respond to its notice, the CBI was acting "with malice." The Congress responded at its own press conference in the evening. The BJP was attacked both for its poor manners in skipping lunch, and in suggesting that the Congress is misusing the CBI to settle political scores. "A party that calls itself a responsible Opposition leader is fielding senior leaders to influence and subvert an ongoing Supreme Court-initiated investigation. It is indefensible and unheard of. BJP is scaling new heights of improper conduct. First, it was the Gujarat Home Minister running scared....not available, avoiding interrogation. Now perhaps the Gujarat Home Minister's mentor is equally scared and appears to have pressurized senior BJP leaders to prevent an ongoing investigation. It is unprecedented that a press conference be held on such an issue," pronounced Abhishek Manu Singhvi, spokesperson for the Congress. The PM's lunch, at his residence, he stressed was to discuss the agenda for the next Parliament session which begins soon.

The BJP says it decided on Thursday to decline the PM's invite for lunch. On Friday morning, senior leader LK Advani called Finance Minister Pranab Mukherjee.

By Friday evening, the mood in the BJP was sombre. Amit Shah was formally charged with murder at 6 pm, the party worries that the CBI is getting uncomfortably close to one of its biggest strengths, the Gujarat Chief Minister.

There's also the fact that the Congress will now have the upper hand in the monsoon session of Parliament which begins shortly. Till the Shah fiasco, the BJP had plenty of issues to target the government with - price rise, the aggressive stand taken by Pakistan after the talks with India last week. On these issues, the BJP would have been joined by other major opposition parties. But once again, the stain of communalism means that the BJP will find itself eating alone.

In a big blow to the BJP government in Gujarat, junior Home Minister Amit Shah, a close aide of Chief Minister Narendra Modi, was today charged with murder by CBI in the Sohrabuddin Sheikh fake encounter case and may face arrest after he was denied anticipatory bail. Shah, who has not been seen in public for several days and skipped Cabinet meetings and office, also failed to appear before the CBI earlier in the day for questioning for the second time in two days following summons issued twice, the deadline for which expired at 1 PM. Shah''s anticipatory bail plea shortly after he failed to show up before the CBI was rejected by Special CBI court judge G K Upadhaya, heightening the possibility of his arrest.
CBI also sent teams to the office and residences of the senior BJP leader in Gandhinagar and Ahmedabad and recorded statements of Shah''s staff but could not locate him. The probe agency tightened the noose around Shah, who has been named as an accused along with 14 others including some IPS officers in the chargesheet filed today in the special CBI court, on a day of fast paced developments.
Shah has been listed as accused number 13 and the chargesheet notes he has not been arrested. A CBI statement said the 15 accused were booked in the fake encounter of Sohrabuddin and for brutually killing his wife Kausarbi.
The CBI probe was spread over five states--Gujarat, Rajasthan, Madhya Pradesh, Andhra Pradesh and Maharashtra. About the summons to Shah, the statement said " he did not appear and hence chargesheet was filed without his examination.
" Besides the murder charge, the other charges against all the 15 accused included criminal conspiracy, wrongful confinement, kidnapping and abducting to murder, extortion and destruction of evidence under various IPC sections. The CBI is conducting a fresh probe into the November 26, 2005 encounter at the behest of the Supreme Court after questions were raised on the investigations by the Guajrat police.
Sheikh, an alleged gangster, was killed in an alleged fake encounter by Gujarat Police. The accused included IPS officers Abhay Chudasama, D B Vanzara, Dinesh M N and Rajkumar Pandian and eight other policemen.
All of them are under arrest. "Yes, we have sent teams," CBI sources said but avoided a direct reply when asked whether teams have been sent to arrest Shah.
In an attempt to avoid being questioned face to face by CBI officials, Shah earlier in the day sought more time to appear before the probe agency and sent his lawyer to its office here but his plea was turned down by it. Shah''s lawyer Mitish Amin said a request was made to the agency to request for more time and consider the option of handing a questionnaire to the Minister to respond to their questions.
However, CBI has turned down the request to give a questionnaire, Amin said. "They do not think that they need to give a questionnaire to us," Amin told reporters after coming out of CBI office.
Earlier, before going inside the CBI office, Amin had said, "The way he (Shah) has got the summon and he was asked to come for deposition, we feel that the time was too short". "We will ask the CBI to give the questionnaire as the incident is very old," he said.
"We are willing to cooperate but the time given to Shah was less. The way he has got the summons and was asked to come for deposition, we feel that the time was too less," Amin said.

Prime Minister Manmohan Singh's lunch for top BJP leaders on Friday ahead of the Monsoon Session of Parliament was called off after they expressed their inability to attend it.

PMO sources said that BJP leader L K Advani, Leader of Opposition in the Lok Sabha Sushma Swaraj and Leader of Opposition in the Rajya Sabha Arun Jaitley were invited for the lunch.

This morning they rang up to say they would not be able to attend the lunch, the sources said.

Meanwhile, the top BJP leaders held a strategy session at the residence of Advani in the wake of CBI summons to Gujarat Home Minister Amit Shah in the Sohrabuddin Sheikh fake encounter case.

All the three leaders are attending the meeting.

"The Indian economy is growing fast and from the presentUSD 1.2 trillion, it is expected to become a USD 5-trillion economy very soon," Folmsbee, said without specifying a particular time frame while addressing management students at G S College of Commerce in Nagpur.

The Consul General, who was in the city today for a seminar on 'Indo-US relations' also emphasised on the need for both countries to focus on vital issues like energy crisis, technology transfer, climate change, higher education and small as well as medium enterprises.

On the higher education scenario, particularly at the University level, Folmsbee said many US varsities were in the process of setting up their establishments in the country with Columbia University already establishing its institution in Mumbai.


The Prime Minister's economic think-tank today projected foreign investment in Indian capital markets to fall to USD 25 billion this fiscal from USD 32 billion in the previous year, even as it expected India to remain a lucrative destination for capital inflows.

Meanwhile, Gujarat Home Minister Amit Shah failed to keep his date with the Central Bureau of Investigation (CBI) on Friday in connection with the 2005 Sohrabuddin fake encounter case.

Shah's lawyer asked the CBI for more time and more details of what sort of questions the minister is likely to face.

According to sources, this is a strategic move to avoid direct questioning by the CBI.

"During 2010-11, there will be portfolio capital inflows of USD 25 billion, down from USD 32 billion in the previous fiscal," the Prime Minister's Economic Advisory Council Chairman C Rangarajan said while releasing the Economic Outlook 2010-11 report.

Rangarajan attributed the estimated decline in FII inflows to robust inflows in the previous year, after these investors withdrew money from Indian capital markets in large sums due to the global financial crisis.

However, portfolio investment in the next fiscal will again rise to 35 billion dollars, the PMEAC said.

Rangarajan said amid uncertainty in the western world, India remains an attractive destination for capital inflows, with the country's economic growth expected to be 8.5 per cent this fiscal and 9 per cent in the next financial year.

This will lead to rise in foreign direct investment (FDI) to USD 50 billion this fiscal from USD 31.7 billion in the previous fiscal. This will further increase to USD 55 billion in 2011-12.

FDI is supposed to be longer term investment by foreign investors, while portfolio investment is generally expected to be volatile.

The higher FDI inflows, along with larger inflows through external commercial borrowings and other debts, would more than make up for the decline in portfolio investment this fiscal.

As such, the total foreign inflows have been pegged at USD 73 billion this fiscal from USD 53.6 billion in 2009-10, which would further increase to USD 91 billion in 2011-12.

The strong capital inflows will ensure that the current account deficit (CAD), which swelled to USD 13 billion in January-March, would be managed comfortably. CAD refers to the deficit in external merchandise and services trade, besides investment income flows.

After covering for current account deficit, foreign capital inflows will add USD 30.9 billion to forex reserves this fiscal from USD 13.4 billion last fiscal. In the next fiscal, forex reserves will go up further by USD 39.8 billion through capital inflows.

"This (capital flows) would be adequate to finance the large current account deficit in the two years and leave a modest USD 31 and USD 40 billion (2.0 and 2.4 per cent of GDP) to be absorbed in the foreign exchange reserves," it added.

The panel expects the current account deficit to be 2.7 per cent of the GDP this fiscal.
