Landslides are so Common in the Himalayas way back Home. you may remember the infamous landslide in the way of Man Sarovar in which Icon Pratima Bedi was among the Killed!

My heart bleeds to know about the fate of the Poor Schoolchildren in Uttarkhand! Over 30 students were feared to be buried in a collapsed school building in a massive landslide that occurred at Somgarh village of District Bagesvar in Uttarakhand's Kumaun region.OurDSB friend Pradeep Tamta, the Ex Naxal of seventies and now a Congress MP represents the area. Earlier he was a MLA from Bagesvar. My friend Kapilesh Bhoj, Mohan , the Poet resides in Someshwar Kausani Valley and teaches in Chanauda, on the bank of Kosi. The landscape as well as Human scape is so close to my heart and mind like the elegant Himalayan altitudes visible from Kausani. Pradeep may get a Five Times Hike in salary as MP, what our people got, is reflected in the landslide. Once upon a time, we all were Environment Activists and we were fighting against Deforestation and were deepthorat indulged in chipko Movement. I Don`t Know what measures Praddep could ensure for decaying Himalayas to sustain and survive.

My teacher Tarachandra Tripathia and favourite writer Shekhar Joshi along with Famous Poet Sumitra Nandan Pant also root in the Valeys! Every line documented may present every detail of the Life inflicted with landslide. As a student, I had faced so many landslides. I reported the major one, the landslide in Gangotri in 1976 while I had to face the wounded and Bleeding Himalayas! Even the day, I left the Himalayas NEVER to return again in 1979, I was standed in landslide on nainital Haldwani Route!

The school-Saraswati Shisu Mandir-was situated near the hill where this land slide occured on Wednesday morning.

The Commissioner of Kumaun asked for ITBP search and rescue teams.

Integrated Search and Rescue Teams of ITBP immediately rushed to the site from sector Head Quarters Almora.

The team that also include five specially trained medics, comprises three platoons is equipped with all advance equipment required for search and rescue at this disaster site.

This team is also having all emergency medicines,oxygen cylinders, stretchers and other medical equipments.

The road between Tapkote and Somgarh is damaged at several places. No vehicle can move beyond 8 km point from Tapkote because of broken roads and bridges.

ITBP teams walked 8km on foot to reach the site. About four students have been saved alive. The rescue operation is going on. It will continue in night also, an official release stated.

The ITBP has also been on the forefront of relief and rescue operations in Leh, evacuating people from under the debris, retrieving dead bodies, providing the homeless with food and other basic amenities.

The amendments suggested by the Parliamentary Standing Committee on nuclear liability bill are expected to be considered by the Union Cabinet tomorrow. The Standing Committee on Science and Technology, which examined Civil Liability for Nuclear Damage Bill, 2010 for over two months, presented its report to both Houses of Parliament today.

The report addresses major concerns of BJP as it recommended provision for "clear-cut" accountability of suppliers for any mishap involving an atomic plant and raise of compensation cap from Rs 500 crore to Rs 1,500 crore among various amendments. This paved the way for early enactment of nuclear liability law, which is crucial for operationalisation of India''s nuclear deals with various countries.

After approval of the amendments in the bill by the Cabinet, the proposed legislation is expected to be passed during the current session of Parliament which ends on August 27 but may be extended till August 31.

Pursuing Bhopal gas leak case can chill Indo-US biz relations: US official

With India pursuing efforts to make Dow Chemicals pay higher compensation in the Bhopal gas disaster, a senior US official reportedly asked the government not to persist with it so as to avoid any "chilling" in the investment relationship between the two countries.

"We are hearing a lot of noise about the Dow Chemical issues. I am not familiar with all the details but I think we want to avoid development which put a chilling effect on our investment relationship", US Deputy National Security Advisor Froman Michael wrote to Ahluwalia in a recent e-mail, Times Now reported today.

His remarks came in response to Ahluwalia's e-mail in which he sought US help in ensuring that India gets accommodation by continuing to get concessional aid from the World Bank's soft-lending arm IDA.

When asked about this e-mail exchange, Ahluwalia did not said he was not involved in any discussions with the US on issues that are sub judice — a reference to the Bhopal case.

"I don't interpret from Froman's email that there is any link between two (Dow Chemicals and World Bank)." Asked about the US "pressure" to go slow on Dow Chemicals, Ahluwalia told the channel, "I don't regard these e-mails as pressure at all."

Froman reportedly assured Ahluwalia that US would take care of India's request. "We are aware of this issue and we will look into it. While I have got you, we are hearing a lot of noise about the Dow Chemical issues. I trust that you are monitoring it (Dow Chemical issue) carefully," Froman replied to Ahluwalia according to the TV Channel report.

Meanwhile, official sources said the government's stand is clear as contained in Home Minister P Chidambaram's statement in Parliament last week during a debate on the Bhopal disaster.

On the liability of Dow, Chidambaram had said in Rajya Sabha that there are three players — Union Carbide, Dow and Eveready.

Once the Madhya Pradesh High Court fixes liability, "we will certainly hold that company or those companies liable for remediation and whatever we had done by way of remediation before the liabilities are crystallised we will ask for restitution. We are not allowing anyone to go scot-free".

N-bill liability cap hiked to Rs 1,500 cr, suppliers' liability fixed



Relenting to key concerns of the opposition, a parliamentary panel on Wednesday proposed to triple the liability cap in case of a nuclear accident to Rs 1,500 crore (about $322 million) and also sought to make suppliers of atomic equipment accountable if it is found defective.

The proposed changes in the legislation that earlier faced unrelenting hostility from the opposition parties have brightened the chances of the Civil Liability of Nuclear Damage Bill, 2010, during the monsoon session of parliament that concludes Aug 31.

The government is keen to get the legislation through before US President Barack Obama visits India in November as it is a prerequisite for implementing the 2008 India-US civil nuclear deal.

The 31-member parliamentary standing committee on science and technology tabled its report in both houses of parliament Wednesday amid noisy protests and accusations of a deal between the ruling Congress and the opposition Bharatiya Janata Party (BJP).

The bill was referred to the standing committee after it was introduced May 7 during the budget session of parliament. The report recommended trebling the operator's compensation cap from Rs.500 crore to Rs 1,500 crore, "specially keeping in view the present level of inflation and the purchase value of the Indian rupee".

The panel recommended that while the government may increase the compensation cap, it should not decrease it under any circumstances. It also recommended doubling the period for victims' claims to 20 years.

Private players eyeing a piece of the nuclear pie will, however, be disappointed as the report recommended shutting them out from the sector in India, leaving the operation of nuclear plants in the hands of the government or government-owned companies.

The committee has also suggested expanding the definition of nuclear damage by including the immediate and long-term health impact on a person and loss of life and personal injury, as also including the word "environment" as defined by the Environment (Protection) Act, 1986.

Giving in to a key demand of the BJP, the panel recommended the inclusion of a clause specifying suppliers' liability, a crucial concession that helped the government to win the party's support.

Agreeing that the expression "willful act or gross negligence" in clause 17 (B) in the draft bill was "quite vague," the panel recommended that it needed to be rephrased as: "The nuclear incident has resulted as a consequence of latent or patent defect, supply of sub-standard material, defective equipment or services or from the gross negligence on the part of the supplier of the material, equipment or services."

This clause became a rallying point for the opposition, which missed no chance in lambasting the government for allegedly crafting an escape route for foreign suppliers who were averse to taking the blame in case of an accident.

The panel's report makes it clear that the operator should have a written contract with the suppliers providing for the right of recourse and says that an operator must compensate victims first and then settle liability with the supplier.

Speaking to reporters, T Subbarami Reddy (Congress), the chairman of the parliamentary panel, said the main objective of the bill was to provide for a mechanism of prompt payment of compensation to the victims in case of a nuclear accident. The bill also provides for the appointment of a Claims Commissioner and a Nuclear Damage Claims Commission to dispose off claims within three months.

Stressing that the the bill was needed to boost power production in India, he said the Left members had given a note of dissent but all other members backed the panel's recommendations.

The Maoists on Tuesday claimed they would be willing to shun violence and come forward for talks provided the Centre announced a three- month bilateral ceasefire.The CPI (Maoist) politburo member and military council chief Koteshwar Rao alias Kishenji told newsmen in Kolkata over phone that the organisation would be ready for talks provided there was a "genuine" initiative by the Centre.

"We respect honourable President Pratibha Patil's appeal asking us to shun violence and come to the negotiating table," Kishenji said.

However, the Maoist leader made it clear that his party would not declare a unilateral ceasefire.

"The proponents of extreme ideologies and the followers of Left- wing extremism must abandon their path of violence," President Patil had said in her Independence Day eve address to the nation. She had also hoped that the civil society would help the rebels to come forward in the dialogue process.

Prime Minister Manmohan Singh in his Independence Day speech on Sunday had also appealed to the Naxalites to abjure violence, and come forward for talks with the government and join hands to accelerate social and economic development.

In response to the President and Prime Minister's appeal, Kishenji said to create an environment for talks both parties should learn to respect each other and announce a ceasefire.

The Maoists also demanded a neutral committee comprising human rights activists Swami Agnivesh, Medha Patkar, Kabir Suman, B. D. Sharma, Arundhati Roy, Gautam Naulakha and Kannabiran to facilitate and mediate the talks. "How can we initiate talks without peace negotiators?" Kishenji said.

Arya Samaj activist Swami Agnivesh had been appointed as the interlocutor for talks with the Maoists by home minister P. Chidambaram. But his role as interlocutor ended abruptly after the killing of Maoist spokesperson Azad in Andhra Pradesh.

Later Agnivesh demanded an inquiry for the killing, and criticised the government for its lack of sincerity.
The Maoist politburo member also demanded that Andhra Pradesh chief minister K. Rosaiah and Union home minister Chidambaram should step down for killing their top leader, Azad in cold blood.

The rebel leader spoke against the separatist and terrorist forces operating in India and offered the Maoists' support to the government.

"We are for peace and we are the biggest patriots," Kishenji said, demanding politicians like Sharad Pawar and Karnataka's Reddy brothers, who have made huge wealth through 'unfair' means, should be put behind the bars.

Kishenji also criticised the Centre for organising the Commonwealth Games and wasting public money for the highprofile journey of the Queen's baton.

Distancing itself from the controversial remarks of Railway Minister Mamata Banerjee about the killing of Maoist leader Cherukuri Rajkumar, alias Azad, the Congress Wednesday said she had made the remarks as the Trinamool Congress chief and not as a minister.
'She is not only a minister of the government of India, she is also the president of a political party. She has said the remarks were made in her capacity of Trinamool Congress chief,' Congress spokesman Shakeel Ahmed told IANS.
Replying to a query about the suggestion of Maoists to have Banerjee as one of the mediators, Ahmed said it was for her to decide if she is ready for the role.
'It is between the government, Maoists and the people they have named as mediators,' Ahmed said.
He said it remains to be seen if the ceasefire offer had the backing of all Maoist groups.
The spokesman said Congress would support any effort for peace but the decision on ceasefire had to be taken by the Maoists and the government.
Meanwhile, Banerjee Wednesday stuck to her comments suggesting Maoist leader Azad was killed in a staged shootout and said she was happy the rebels had responded to calls from the president and the prime minister to come for talks.
Speaking to reporters at her residence in Kolkata, a day after the Maoists proposed a three-month ceasefire and sought her as one of the mediators in the proposed peace talks, Banerjee said the problem should be solved peacefully and democratically through negotiations.
At the rally earlier this month in Lalgarh, Banerjee condemned the 'manner' in which Azad was killed at Adilabad in Andhra Pradesh July 2.

Congress party and Bharatiya Janata Party (BJP) on Wednesday rubbished allegations suggesting any deal between the two national parties to reach an understanding over Nuke Bill.: The Rashtriya Janata Dal (RJD) and Samajwadi Party (SP) leaders accused Congress here on Wednesday for striking a deal with the main opposition Bharatiya Janata Party (BJP) on support for the Civil Nuclear Bill.They charged the Congress party of availing BJP's support in lieu of giving a clean chit to Narendra Modi, Chief Minister of Gujarat and his alleged role in the Sohrabuddin Sheikh fake encounter case.

"Democracy functions in a manner whereby even if there are contradictory shades of opinion an attempt is made in parliament through a committee process to harmonise those opinions and it is that harmonization has taken place," said Manish Tiwari, a Congress spokesperson.

"If there are certain reservations which the opposition had and those reservations have been addressed and some kind of unanimity has been achieved, to call it a deal, I think is not only erroneous but it is completely uncalled for and I don't think it needs to be dignified by a response more than what I have already said," he added.

Senior BJP leader M Venkaiah Naidu, termed the other opposition parties as opportunistic to suit their own needs unlike his party that is committed to certain principles in national interest.

"In the Nuclear Liability Bill whatever concessions they had announced were not enough and so what we demanded in the interest of the people of the country, government has accepted those. And it is not our nature to oppose the government just for the sake of being an opposition party; it is the nature of other opposition parties. After getting approved their personal demands, they change their stance, we are not like them," said Naidu.
Member of Parliament and Samajwadi Party (SP) chief, Mulayam Singh Yadav said the BJP used the nuclear liability bill to bail out Narendra Modi and both the parties had struck a 'deal' over another deal.
"The Bharatiya Janata Party (BJP) and Congress had a deal that you (BJP) give recommendation on my (Congress party's) nuclear deal. They had a deal over deal. A nuclear deal is going on with America and the Bharatiya Janata Party (BJP) and Congress party had a deal among themselves that we (Congress) are not going to disturb you (BJP) with the CBI and you (BJP) just support us (Congress) on the nuclear deal," said Mulayam Singh Yadav.
"BJP has accepted the deal that we (it) will give our (its) complete support to the nuclear deal on the condition to spare its Chief Minister and other ministers (to mean Narendra Modi Chief Minister of Gujarat and his former Home Minister Amit Shah)," he added.
Member of Parliament and Chief of Rashtriya Janata Dal (RJD) Lalu Prasad accused the Congress of silencing regional parties and reaching an understanding with the BJP on the nuclear bill by using CBI as a blackmailing tool.
Prasad flashed a newspaper report today in Lok Sabha quoting an official of the CBI, as saying there is no evidence found against Narendra Modi in the encounter case.
"The deal has taken place for the nuclear liability bill, further I won't talk about price rise but release of Narendra Modi. Today's Times of India states that 'No evidence against Narendra Modi in Sohrabuddin fake encounter, says CBI official'. It is in today's Times of India, that's why I have raised this issue on the floor of the house in the parliament and will further raise it. It's not a tiny issue," said Lalu Prasad.
He termed the suspected deal between the Congress and the BJP as unfair and unacceptable.
"It is injustice, unfair and we are not going to accept this and will further spread this issue throughout the nation," added Lalu Prasad.
Another leader of RJD, Ram Kraal Yadav reacted on the issue by raising slogans outside the Parliament House.
The nuclear liability bill was tabled in the Lok Sabha by the government in March 2010.

N-liability report: Left MP dissents, says one step back

A Left-party MP says that the recommendations of a parliamentary panel that examined the contentious nuclear liability bill are 'one step back' from its draft. Another Left MP says the bill's statement of objects and reasons 'is not so convincing'.

'Section 17 was initially modified to strengthen 17 (b). However, the current draft has gone one step back from even the original draft bill in protecting the supplier,' said Communist Party of India-Marxist leader Saman Pathak.

The two-page dissenting note, which had been attached with the 25 page report of the standing committee on science and technology that was tabled amidst an uproar in parliament Wednesday, says the report now suggested that section 17 (a) end with an added 'and', 'which makes all subsequent section 17 (b) and (C) defunct if 17 (a), is not met'.

'Section 17 (a) says that the right to recourse for the operator shall exist only if it is expressly provided for in the contract. This means that the exisiting law by which a supplier is responsible to the owner is now to be substituted by a private contract between the owner and the supplier,' he pointed out.

Pathak also said that there should be a separate sub-clause which states that 'the right to recourse for the operator or the government should be there in the event of supply of equipment which is defective or due to faulty design'.

'Since these changes have not been accepted, I am constrained to draw the conclusion that the provisions of the bill will unduly favour the foreign suppliers of nuclear equipment. This is being done to make the provisions compatible with the Convention on Supplementary Compensation (CSC). I am not convinced why India should join the CSC,' he said.

He also said that he is of the firm opinion that any legislation on civil nuclear liability 'should keep the interests of the Indian people, who may be affected in a nuclear accident, as its core concern'.

'The provisions suggested in the bill and those proposed by the committee fail to ensure that. Hence my dissent on the report,' he concluded.

Forward Bloc MP Barun Mukherji, in his three-page dissenting note, said: 'The statement of objects and reasons is not so convincing due to its disproportionate presentation of some issues'.

According to him, the bill had been drafted 'to facilitate India's joining the CSC', adding that during the discussions of the standing committee, the secretary of the Department of Atomic Energy 'had also confirmed such intention of India to join CSC'.

'Such approach on behalf of the government appears to be biased and hence, much of its credibility is lost,' Mukherji maintained.

New Delhi:  India is working on getting Dow Chemicals to pay hundreds of crores for the Bhopal Gas Tragedy. The US is lobbying hard for Dow, with a senior government official stating, in an email, that it hopes India's emphasis on Dow will not have "a chilling effect on the investment relationship" between the two countries.

In 1999, Dow bought Union Carbide, whose pesticide plant in Bhopal leaked a poisonous gas which has killed more than 15,000 people since December 1984. The Madhya Pradesh High Court is considering a suggestion that Dow should be made to deposit 100 crores to fund the removal of the tons of toxic waste that still lie in and around the Carbide plant.

Late last month, Montek Singh Ahluwalia, the Deputy Chairman of India's Planning Commission wrote to Michael Froman, the Deputy National Security Advisor of America, who chairs the India-US Economic Dialogue Forum with him. Ahluwalia wanted Froman to back India's petition for a higher limit on the loans it gets from the World Bank. On July 30, Froman wrote back, saying he was "aware of this issue."  In a separate paragraph, Froman states, "There is a lot of concern about the noise around Dow..We hope this does not have a chilling effect on our investment relationship."

The World Bank has sanctioned India's request. Montek Ahluwalia has told NDTV there is no link between that, and the Dow Chemicals issue. And in Parliament, the Home Minister, P Chidambaram, has made it clear that for the giant clean-up required at the now-defunct Carbide plant in Bhopal, "we will claim restitution from Dow Chemicals, Union Carbide and Eveready either separately or collectively after their liability is fixed,'' said the Minister.

In 1989, the Supreme Court agreed to a settlement by Carbide that saw the Indian government being paid 470 million dollars as compensation for victims. The government plans to file a curative petition now against that decision, and ask Dow for several hundred crores. Part of the government's case will be that the settlement was reached on the assumption that 3000 people died as a result of the gas leak. The actual death toll was nearly six times that.

Dow has always argued that it cannot be held financially liable for the tragedy because Union Carbide had sold its Indian subsidiary to a company named Eveready before the Dow takeover.

The government has also said that it will aggressively push for the extradition of Warren Anderson, the American who was the CEO of Carbide at the time of the gas leak in Bhopal. Earlier this year, a Bhopal court sentenced seven Indian executives of Carbide to two years in prison. They were found guilty of criminal negligence, and were granted bail immediately.

Yechury accuses Mamata of having nexus with Maoists

CPI-M leader Sitaram Yechury today accused Railway Minister and Trinamool Congress chief Mamata Banerjee of having a nexus with outlawed Maoists.
Talking to reporters here, Yechury said: "The Maoists and the Trinamool have been working together. They are collaborating, so you cannot have any one of them being the mediator to try and ease the violence and tension."
"When they are themselves involved. Then what is the point in it? The question is that whether violence will stop or not and until it is clear there is no point of doing any dialogue," he added.
Earlier in the day, the national media carried a news about Banerjee being a possible mediator for talks between the Central Government and the Maoists.
Banerjee today said she stood by her statement on Maoist leader Cherukuri Rajkumar alias Azad's killing made at a rally in Lalgarh, West Bengal on August 9.
"Whatever I said in Lalgarh, I stick to it. In our democratic set up, we always prefer an amicable settlement and a peaceful solution," she added.
At the rally, Mamata had said: "The way Azad was killed was not right and asked for a probe into his death.
"I feel the way Azad was killed is not correct. Swami Agnivesh had made him agree to hold talks (with the government). What happened was not correct. I feel the process (for holding talks with the Maoists) should start," she added.
Asked about a reported statement by Kishenji that they were willing to accept Banerjee as mediator, She said she had only heard about it in the media.
On Tuesday, Kishenji offered a three-month ceasefire for the sake of peace and for talks.
"President Pratibha Patil and Prime Minister Manmohan Singh in their Independence Day speeches, have appealed to the Maoists to abjure violence. We are never for violence but the government has instigated us to take up arms," Kishenji said from an undisclosed destination.
"We are always against terrorism and corruption of any kind...It has been our party's mandate to fight corruption and so we are mobilising people all over the country to ensure that they raise their voice against injustice," he added.
Kishenji also suggested some names of mediators including writer Arundhati Roy, singer and Trinamool Congress MP Kabir Suman, B D Sharma, Gopal Narlekar and Ramanna. (ANI)

Witness in Sohrabuddin case says he was threatened by CBI

A witness in the Sohrabuddin Sheikh fake encounter case has said he had gone underground as he feared that the CBI, which is probing the case, would force him to make "more false statements". The witness, Noor Mohammad Goghari, told this to a court hearing the Popular Builder firing case yesterday in which he is an accused.
According to CBI charge sheet, firing at Popular builder in December 2004 was stage managed by some of the accused in fake encounter case with the purpose of lodging FIR against Sohrabuddin in Gujarat. Goghari is shown as an witness in the charge sheet in the Sohrabuddin fake encounter case and his statement, recorded under Section 161 of CrPC, has been included in it.
As per the statement, he has said he was threatened by IPS officers accused in the fake encounter case. He told the court hat he did not appear during the last hearing as he feared that CBI would pick him up, make false statements on his behalf and implicate him in the fake encounter case.
In his application before additional sessions judge I B Waghela, who had issued warrant against him, Goghari said he was called to the CBI office for questioning in fake encounter case, where he had denied having information about the case. He said the CBI officials pressurised him to make statements of their choice, saying they would help him out in the Popular Builder firing case.

Walkouts make headlines, but debates should be better: PM

Prime Minister Manmohan Singh Wednesday said walkouts make for good headlines, but a good parliamentarian, who has done his homework well, can take government to task.

He also stressed that in today's information boom, parliament needs to raise its 'standard' and 'quality' of debate.

'Disruptions and walkouts may make good headlines but it is a good parliamentarian, who has done his homework, who can take the government to task,' the prime minister said at a function in the central hall of parliament where where President Pratibha Patil gave away the Outstanding Parliamentarian Awards for 2007-2009 respectively to Congress leader Priya Ranjan Dasmunsi, Samajwadi Party leader Mohan Singh and senior Bharatiya Janata Party leader Murli Manohar Joshi.

Dasmunsi has been hospitalised since 2008 when he suffered a second stroke and the award was received on his behalf by his wife Deepa Dasmunsi, a Congress member of the Lok Sabha.

'There is no doubt that in today's age of information overload, parliament has to raise the standard and quality of its debates and discussions,' Manmohan Singh said, adding that the country needs parliamentarians like Dasmunsi, Joshi and Singh.

'The effective functioning of parliament is certainly dependent on the norms, conventions and rules that govern proceedings. But it is the calibre of the members who breathe life and vitality into this institution.

'Outstanding parliamentarians through their speeches and interventions make parliament a forum not just to reflect public opinion but also to mould it,' the prime minister said.

Reminding the parliamentarians about their role, he said it is their duty 'to raise the voice of the people and to seek answers from the government of the day on matters of public interest.'

Speaking about the three senior parliamentarians, the prime minister said he had often heard them make thoughtful interventions during major debates.

Fondly remembering Dasmunsi, who was the parliamentary affairs minister and later the information and broadcasting minister in the UPA-1 government, Manmohan Singh said he was full of 'energy and enthusiasm', adding that he could reach out to members of all political parties.

'He had the ability to build consensus and find a way forward despite strong differences and helped to prevent many disruptions,' Manmohan Singh said.

He described Mohan Singh as a 'strong advocate of issues that affect the common man'.

Terming him a politician of the old school, the prime minister said he is heard with attention in the house.

Describing Joshi 'as one of our experienced parliamentarians', the prime minister said he had served with great distinction in both the Lok Sabha and Rajya Sabha.

'I have always found Dr. Joshi's interventions to be thoughtful and incisive, even when I have disagreed with his views. He is a man of wide ranging interests and has been an active member of many important standing committees,' he said.

The prime minister also said that although the three leaders belong to different parties, it reflects the important role played by members from all parties whether from the opposition or from the ruling party.

He hoped that younger politicians learn from their example as they have 'shown that argument and debate can be conducted effectively without raising one's voice.'

Their hand-wringing and finger-pointing over Union Carbide now behind them, Congress and BJP legislators came together on Tuesday to recommended modifying the proposed law on civil nuclear liability to let foreign suppliers of equipment off the hook for any accident caused by negligence on their part.
In its report submitted to Parliament on Tuesday, the Standing Committee on Science & Technology suggested a modification in the Nuclear Liability bill making the recovery of damages from a supplier — even in the event of gross negligence — contingent upon his prior acceptance of liability in a written contract. This is a major dilution of the existing provision.
The draft bill makes the operator of a nuclear facility wholly liable for any damage stemming from an accident. As it stands, Clause 17 allows him to exercise a right of recourse under three separate circumstances: (a) where it is expressly provided for in a contract in writing; (b) where the accident results from the gross or wilful negligence of the supplier or his employees; or (c) where an individual intentionally causes the accident.
Citing the legal difficulty in establishing culpability for negligence, the standing committee has recommended expanding the scope of 17 (b) to include accidents caused by "latent or patent defect, supply of sub-standard material, defective equipment or services". But it has made this contingent on the written contract between operator and supplier expressly providing for these eventualities. "The Committee … recommends that Clause 17(a) may end with the word 'and'," the report says, adding "that the operator must secure his interest through appropriate provisions in the contract with the supplier".
The report was adopted by all members of the committee barring two Left MPs, who submitted dissent notes protesting this effective dilution of 17(b).
The Hindu first reported the U.S. nuclear industry's unhappiness with the original text of 17(b) on April 1, 2010. In June, this newspaper highlighted the government's surreptitious attempt to delete the sub-clause even as the Standing Committee was considering the bill. In the ensuing uproar, the Department of Atomic Energy backed off. But if the parliamentary panel's recommendation is incorporated – the Union Cabinet is to clear the bill's final version on Wednesday and the House may vote on it next week – suppliers would have had their way, since the trend in international nuclear contracts is for the supplier to avoid any liability for accidents.
Left MPs say insertion of the word "and" after 17(a) was clearly an afterthought since a new sheet was inserted into the printed Standing Committee report to accommodate the change.
The reason for this last minute modification is presumably the September 2008 promise the Manmohan Singh government made to the U.S. to "take all steps necessary to adhere to the Convention on Supplementary Compensation for Nuclear Damage (CSC)". The U.S. wants India in the CSC because Indian victims of a nuclear accident would then be barred from filing damage claims in U.S. courts in the event of an accident caused by American-supplied equipment.
The Convention also limits the operator's right of recourse essentially to what his contract with the supplier provides for. Despite this, Indian officials, aware of the link between liability and safety, included supplier negligence as a standalone ground. But in the face of U.S. pressure, the government is now trying to retrofit the bill to make it CSC compliant.
Globally, South Korea and Hungary provide operators with a right of recourse against suppliers in the event of gross negligence, regardless of whether the contract provides for it or not. Even with a trusted friend like Russia, the Indian side is having a tough time including a right of recourse in the contract. That is why the bill envisaged explicitly gives the operator the right in the event of the supplier's gross negligence.

Brahminical big bully quarrels with all its neighbours

Bangalore: Brahminist rulers of India may be inwardly rejoicing that the rising violent Maoist movement and its enthusiastic Maoist supporters in Nepal are both controlled by their jatwalas. The Nepali Maoists may be headed by a beef-eating, scotch-guzzling, equally corrupt and casteist Brahmin Prachanda. (DV Sept.16, 2008 p.7: "Brahminical joy over Prachanda take over of Nepal" & p. 8: "Brahmin Prachanda as great admirer of killer Parashuram"). But the entire Nepal has turned against India but closer to the enemy camp, China.
Prachanda also hates India: India has been virtually controlling Nepal until very recently. The Indian ambassador to Kathmandu was like a "second king", so powerful. All this is gone, thanks to the overbearing Brahminical bosses of India. If there is one country today which is so much hated in Nepal — "the only Hindu country in the world" — it is the Hindu India, thanks to the "imperialist Brahmins" who have quarrelled with all their neighbours. India today is hated by Pakistan, China, Nepal, Bhutan, Bangladesh, Burma, Lanka and even the tiny Maldives. India is surrounded by a host of enemies all around — thanks to 65 years of Brahminical rule.
A report in the prestigious Financial Times (July 16, 2010), London, by its Delhi correspondent, James Lamont, says even the Brahmin Prachanda hates the Brahminical India. Maybe Prachanda depends so much on China which alone can fulfil his ambition to rule Nepal.
Chinese weapons: As Prachanda's Maoists are fully supporting the Indian Brahmin-led Maoists, there are unconfirmed reports that Prachanda has helped procure some Chinese weapons to his Indian comrades to fight the Indian rulers. Today, every neighbour is so chummy with China, in contrast with India whose rulers have the knack to quarrel and even fight with every neighbour.
So much so, India today is totally encircled by many enemies around. But China is so much loved and supported by all its neighbours.
The FT quotes "a retired Indian army general, Ashok Mehta, a Brahmin" saying if China controls the Himalayan height of Nepal", it would have no need of a nuclear arsenal trained on India.
But India's rulers are not bothered about what happens to India. Because they don't belong to India, hence they don't love India. This is the secret.
Why India is hated: India's Brahmin PM Nehru provoked a war with China and at least 1 lakh Indian soldiers died (1962) but not 1 Chinese soldier was killed. But the rulers were not at all perturbed. They will be worried only if their jatwalas are killed. All those who died in the Himalayan holocaust were our people (SC/ST/BCs Muslims/Sikhs/Christians).
The Brahminical logic is that all these fellows died because they were destined to die. They fought for their motherland and died. As India is not their motherland, they are not expected to die and hence they are not bothered about what happens to India. This is the great Brahminical logic.
Please note: If there is a war tomorrow with the nuclear Pakistan, the rulers will not bothered because those who die will not be their people. It is this hate-mongering policy of the Brahminists that has made India hated by all its neighbours.
Every country around India is so close to China. That means China is virtually lording over the whole of South Asia, says FT. Lanka hates India despite being Budhist country, but loves China.
Lanka is anti-India: Brahmins stationed a notorious Brahmin, Raman Iyer, formerly of the RAW, at Madras to direct its operations in Lanka. It gave every aid, including army to fight the Lankan Tigers and finish them. Once their job is over Lanka turned against India refusing to oblige the Brahminical big bully. Today, China gives full military and financial aid to Lanka. It is building roads, airports and a massive sea-port at Hambantota, on the South of the island.
China, however, does not trust the Brahmin Prachanda but using him to give sleepless nights to the big bully. But this bully is not bothered as long as the Indian Maoists confine themselves to rural areas where their jatwalas don't stay. But once it attacks cities, the abode of the bullies, the big Bully may order the army to strike.
Meanwhile, the big bully is deeply worried about its shrunken influence even on its neighbours. Its international ally, the Jews, are losing. But China, its no.1 enemy, is rising.
The big bully is suffering from an acute stomach-ache but there is no medicine.


Whole of Hindu India will go BIMARU ?

Bangalore: The "Hindu heartland" also called the cowbelt is the fertile Gangetic plain where the invading Aryans came first and settled down. And launched their looting spree and the drive to devastate the innocent but hard-working natives.
This area, called North India, houses the capital of the country, Delhi, and comprises the most stinking part of the country — despite housing the "holiest" centres for the Hindus.

A demographer called Ashish Bose, a Bengali upper caste Kayasth (Hindu), rightly coined a word to describe the different areas comprising this cowbelt: BIMARU states. BIMARU in Hindi means sickness — though the letters in this word stands for the six states comprising the cowbelt: Bihar, MP, Rajasthan and UP. Some more states are since carved out of these four.
Ashish Bose, a professor of Delhi University, now 80, has written a book, Head Count (Memoirs of a Demographer), Penguin. Rs. 450, pp.214.
Indian population has reached 1,300 million though official figure is put 1.18 billion in 2009. Like everything else, no official estimate in India is correct.

The BIMARU states are a liability for India. The Southern States which include Maharashtra, have escaped this BIMARU because, they are outside the cowbelt. That is how these five states have become the country's most advanced states. Out of the country's six metropolitan cities (Bombay, Delhi, Calcutta, Bangalore, Madras, Hyderabad) four are situated outside the cowbelt. Only Delhi, also the capital of India, is in the cowbelt. Even Calcutta is outside — though it is a dead city.
Specialists on the BIMARU disease killing the cowbelt states, like Ashish Bose say they are incurable. Already the whole area is in ICU.
This BIMARU is also contagious. Even the cities outside the BIMARU have started dying. That means the Brahminical BIMARU is spreading fast. Will the whole of Hindu India go BIMARU ?

Israel and its guardian USA have lost their most valued friend in Turkey. US will lose many more as long as it goes on protecting the criminal zionists. US loss of Turkey's friendship is the biggest gain for East and Islam. But the West has already started giving pinpricks by instigating the Khurds against Turkey. I remember an incident when a huge fire engulfed all the huts where your people lived. No one came to help any of them. This was in early 60s. I left India in 70 and I do not know what is happening now. Don't you think things have changed now? You have every right to protest and your people have special quotas in education and job market. I may be mistaken. You may disagree with me. I cannot dwell in the negative thoughts. If DV closes, so be it. You or your people will never going to be closed. I trust in god and if one door closes he always opens another door. I am not trying to be philosophical and for me it is true and I have experienced in the past and hope to experience even more. Failures are part of life and these experiences are learning tools. Please do not give up your talent, your passion, your love and your hope for the people. Have you heard anything about Holocaust? Muslim world does not believe that some thing happened. I visited Israel and toured the holocaust museum. It was gut wrenching experience I could not imagine people of that calibre existed not too long ago. My point is there are bad things everywhere, many are worse than what we see. India stands 134 in ranking, so what? People think America will soon go down economically and no longer would be super power. Does that mean I need to stop what I am doing and start worrying? You think there is a simple solution, we can change just like that? Instead of worrying and ranting about how bad the Brahmins are treating the lower castes I would rather look at myself and see what I can do that makes a difference in this world. Statistics are partly true. Have you thought about the next move beyond DV? I understand your concerns. You may call me Bania, Bohra, blood sucker, leopard, masked etc. It is OK. I do not pretend to be a Christian, I question many theological and dogmatic Christian things, Christianity what I believe is not the one traditionally practiced which is lot more into heaven, hell, sin, conversion, "turn or burn" etc. Jesus was not a religious person and never said people to worship him in the whole Bible. All he asked was to follow his path of love. I am a free man and I have nothing to hide and I have no agenda. I like to see people at the same level. The last thing I want to do is to influence you or control your thinking. My point is to recognize you as a good fellow human being who has passion for the underprivileged people and work for them. I encourage you to be a great leader in the fight against the oppressors. I do differ with your methodology of feeling victimized and feel sorry for yourself. I see in that line of thinking there is no growth. The example I gave you about the holocaust was not just about the worst crime but it is more about the resiliency and courage of the Israel people. I personally witnessed when I visited Israel last year. No way I want to put you or any of your people down. We cannot undo the past and we cannot control Brahmins or any other human being for that matter. That does not mean there is no hope and I do believe what Jesus said "Blessed are the poor (both in material and spiritual)". This has taken me years to understand. I do not say I just converted into a modern religion like putting on a new cloth. I did not come to find another god or to seek salvation. I wrote earlier I do not understand traditional theistic stuffs like heaven, hell, sin, salvation etc. But I do not argue with religious Christians. I came to Christ to find the exact meaning of love, not another religion. I am afraid for most people who embraced Christianity in India this is just another religion, perhaps better. It is very easy to put Jesus or Mary in an altar and worship like most Hindus do. Personally I have had may own downsides and I still struggle at times. Do not be judgemental in telling me I am just after individual salvation. What is salvation? Slave in Latin means a topical healing medicine. Love is healing. I really do not understand they are after saving souls. They think there will be an eternal fire for the unbelievers, the concept not much different from karmic concept of Hindus (Brahmins). I applaud your effort is collective salvation.

India has a mere 15% upper castes (Hindus including Brahmins) but we have no instance of one single leopard changing its spot. We know everything about the Holocaust but history says the Jew, the creators of the Holocaust industry, killed more Christians in Russia to establish their communism. This is the greatness of the Hindu rishis and their births. I think the people of the Barbarian era would at least be more intelligent than our Dravidian people. As per one Hindu mythology Mahavishnu and Parameswaran both males, fall in love with each other, cohabit and produce a male child which is being worshipped by the Hindu orthodox people even now, as Sastha or Iyappan, or Harihara Puthran.
Iyappa: Again it is stated clearly that Mahavishnu fell in love with another Brahma rishi called Naradar and produced not one child but 60 babies. 60 years of the Hindus from Prabava are named after the 60 children of Brahma.

Once the king Devendiran happened to see a lady named Parisadam, she was the dutiful wife of a rishi. He wanted to have intercourse with her. He said that he had a great love for her. She replied that she has neither love for Indiran nor could she betray her husband. Indiran was frustrated. He was determined to achieve his object. Some time later the rishi performed Aswamedha yaga wherein his wife Parisadam had to insert the penis of the horse into her womb, as a ritual. Indiran seized this as the best opportunity. He somehow entered inside the male organ of the horse and accomplished his long felt desire. Indiran spoilt Parisadam forcibly against her wishes.
I have enlightened you with great restraint, the details regarding Brahma, Rishis, Devas and their king to enable you to learn something about them as is authoritatively stated in the Manu's code.
Courts warned: Today our high courts are giving judgments based on the Hindu law. As the justice is given to all taking into consideration mainly what the Manu law, rishis and devas have said sometime long ago, I am telling you all these things for deep consideration.
So far as the Hindus are concerned, where there is a problem to be decided, the dharma sastras are seemed to be the main basic rock of determination. Of all, the Manu code is the most important one.
The Privy Council has categorically stated about the Manu code thus: "However obsolete and out of date it might be judgment based on it are final". Not only this, the Constitution of India is also laid down according to the Manu law.
The very fact that the measures taken by the government of Tamil Nadu to enable all communities to do the job as priests in temples were nullified by the Supreme Court of India clearly demonstrated that the Manu's law is still under the full sway. INDIA'S INTERNAL & EXTERNAL SITUATION GOING OUT OF CONTROL

Brahminist days numbered, future belongs to Bahujans : DV needs your support to survive

India of 1,300 millions, the second largest mass of humanity in the world, is in a state of total despair. Intellectually, morally and economically sinking. A vast ocean of humanity, which a recent visiting British PM, David Cameroon, could never see (because it is cunningly hidden) is forcibly kept dumbed down. The enslaved masses have no strength even to shout. They have not even woken up from their centuries-old slumber.
The ruling micro-minority Brahminists (just 3%), during their over 2,000 year-long crafty human engineering, killed the burning fire in the hearts of the virile Dravidas and Adi-Dravidas, systematically plundered their wealth, and literally sucked the boiling blood from their muscular body. Even the sub-Saharan African countries have not seen the poverty, deprivation which "Hindu India" is witnessing today, says a UN report.
What caused India's fall: So, it is now too late to wake up the unconscious slaves and activate them. DV's existing plight is a faithful mirror image of what is happening, the turmoil, that has gripped "Hindu India".
In the neighbouring China, the population is much bigger but the ruling Communist Party used its vast human power to build the country into a powerful personality and made it into a super power.
China soared to the sky because its rulers loved its people but India sank into the depth of the Indian Ocean because its Brahminic rulers hated its people because they did not belong to India.
The Chinese giant has woken up and is trying to dictate terms to the whole world, showing its muscles. The sole super power, USA, is pissing in its pants and literally begging before China. In contrast our rulers have become a laughing stock of the world.
India's Bahujans comprising its SC/ST/BCs (65%) and Muslim/Christian/Sikhs (20%), plus women of even upper castes (Hindus 15%) are made lifeless, unable to react. Or open the mouth even when cut to pieces. Only in Kashmir we see some protests. But the Hindu army is crushing them.
Silence of DV family: We have said all these many times but the near-total silence of our DV family members — even when we announced the "Closing down DV" — further confirmed our fears.
How did this micro-minority enemy oppressor, the Aryan Brahminical people, convert India into a vast graveyard? What is the wonder weapon they used to dumb-down the behemoth Bahujans?
Yes. The answer lies in the mass media which the Brahminists control.
The education system, which covers not even 30% of the Indian masses, is again in the very enemy hands. The Bahujans are systematically kept out of education. Even those few who get the primary and secondary education are fed with Brahminical poison and thereby get further dumbed down.
Dalit IAS/IPS officers: Those who are fortunate enough to get little education but only in their own mother tongue (English is strictly reserved to the Bhoodevatas) are subjected to further brainwashing by the language media. The brainwashing gets more vigorous, if not violent as you go up the socio-economic ladder.
That is how Dalits, OBCs and even Muslim/Christian/Sikhs among IAS/IPS and other Central Service officers get completely Brahminised (corrupted) by the time they take up their job. That is how these officers take to corruption because only the corrupt can become popular with the Brahmin bosses. If you are honest and ideologically Ambedkarite, your life becomes miserable. If you take to Vipassana, Brahmins will love you.
DV family members are these very Dalit-Bahujan elite whose blood itself has been poisoned by the time they took up the job. Exceptions to this rule go only to prove the rule.
Media influence: This is the cause of the silence of graveyard among our vast DV family. If our foreign subscribers are more alert, more angry it is solely because they have escaped the Brahminical gas chamber. At our recent meetings in London and Paris, DV members were more vocal.
To repeat what we have said many times: Brahmins are ruling India only because of their monopoly power on the media which is corrupting and corroding the Bahujan minds.

DV members silence: Dalits are running hundreds of journals but none has the courage to identify and name the rascals drinking our blood. Babasaheb did name these Brahminical blood-suckers. India's only other Dalit media which had the courage to identify, name and fight the enemy is DV. Several DV members have said this. Yet our DV family is not coming forward to save DV when it is sinking. Not that they are against DV or hate DV. No.
The reason for their total silence (with minor exceptions) is they have lost the capacity to think. This is what we very often describe as "slaves enjoying their slavery".
Assault on Muslims: The dumbing down of Muslims, who ruled India for 800 to 1,000 years, and made into not only slaves but dubbed terrorists and anti-nationals within 63 years of "independence", is the most spectacular achievement of the ruling Brahminists. The world over the Muslims are fighting and dying and winning too — but in India they are simply dying or languishing in jails without a murmur. The Brahminical media management is so total, so precision perfect, that no foreign power on earth took even notice of the military killing Kashmir craving for self-determination.
"Jews of India" join Jews: Being the first to get English education (even as they pretended to fight the British under their obedient servant, the Gujarati Bania), they were also the first to migrate and take up key positions in US, UK, the entire West. Not only that. The "Jews of India" cultivated the Jews, the real rulers of the West, and occupied influential positions in banking, media and other decision-making positions. During our recent tour of West, we did not find a single Western media criticising India. Rather they are all "dazzled" by the "rise of India" — sometimes called Chindia, hanging on to the tail of the rising super power China.
Agriculture destroyed: Take it from us: this 15% upper caste rulers can no more be controlled. They will mercilessly crush anybody going against their Brahminical rule.
They have already destroyed the entire countryside. Agriculture, the mother of all cultures, is devastated.
Corruption flows from the top. But this top — fully Brahminical — is also fully hidden by the Brahminical media. So much so corruption is no longer an issue. A topmost army general is facing court-martial. A Supreme Court judge is caught. The politicians right from the topmost Khatri Sick PM never complain against corruption. Because if they talk, the whole can of worms will open up.
Football fiasco: That is how the notorious Karnataka Brahmin, Suresh Rao Kalmadi, controlling the doomed Commonwealth Games, is fully protected even by the Khatri Sick PM.
All their tall talk of "remaking India" is bullshit. You will find one more proof when the forthcoming Commonwealth Games collapses. In the football World Cup we did not participate because India did not have even a team. A country of 1,300 millions, which once had a fantastic team and participated in such events, is not ashamed. Yes. This is because the idli-sambar Brahminists are not interested in football which is the game for beef-eaters. Grass-eating Tendulkars can't play football.

Bahujans used to kill Muslims: As the grass-eating (vegetarian) Brahminists cannot become physically violent, they are preaching hatred and brain-washing the Bahujans to attack and kill Muslims. This process is called the "re-writing of history" for which the Vajpayee Govt. itself once committed millions of rupees. They want to make the "Hindus" more aggressive. When they say Hindu they actually mean the Bahujans. But the Brahmin is violent only in his thought. But at the same time they won't allow even a tiny paper like DV to survive because it is constantly irritating them, exposing them by revealing hidden secrets of the Bhoodevatas. Future belongs to us: As we are debating the "closing down DV" issue, we want our family members to remember that future belongs to us. Violence is gripping India. The rulers want peace because peace of the graveyard helps them to steal, plunder and murder more Bahujans "peacefully".
But the Bahujans are not allowing them peace. Everything the Brahminist touches is becoming mud. Confusion has gripped India. The forthcoming Commonwealth Games (if it takes place) will prove it. We have already predicted its collapse.
Yes. Everything is favourable to us. But there is only one condition. That condition is we must get angry. We must start hating the existing conditions created by the enemy. You have to identify the enemy — a task already made easy by DV.
International situation is very favourable to us. We have written many times on this. No where we have proved wrong except in the case of Obama.
DV line of thought is perfect: DV's line of thought is accepted. Though the journal is named Dalit Voice, it is the "Voice of the Persecuted Nationalities Denied Human Rights" (85%).
In another five years dramatic changes will take place and the Brahminists will themselves run away from India. Already their one foot is out of India.

Tripartite talks on Gorkhaland end positively

Gorkha Janmukti Morcha (GJM) Secretary Roshan Giri, who led the 7th secretarial level tripartite talks with the Bengal Government in New Delhi has said the meeting was successful.
"The meeting was successful. Most of the subjects we raised have been considered. Now we just have to talk about the territories of Terai and Dooars. This would be also taken up in the political level meeting," he said.
He also informed that those issues, which could not be addressed or resolved at this meeting, would be again taken up in the next official tripartite meet.
"All those topics on which we could not come to any possible solution, these would be again taken up in the next political level meeting. The next tripartite level official meeting is going to be held on September 7," he added.
Union Home Secretary GK Pillai, State Home Secretary Samar Ghose were present from the Bengal side and from the GJM side, besides Roshan Giri, there were six other members from the (Gorkha Adivasi) Study Forum.
Earlier 'political-level' talks were held at New Delhi on July 24.
The Gorkha population in West Bengal is around a million out of the state's 80 million people. (ANI)

Dialogue, the only solution to tension in Kashmir Valley: Sushma Swaraj

Leader of Opposition in Lok Sabha Sushma Swaraj and a senior member of Bharatiya Janata Party (BJP) during an interaction with a delegation of youth from the Kashmir Valley here on Wednesday, said that dialogue is the only mode to solve the issues of Jammu and Kashmir.
The team of youngsters posed several questions to Sushma Swaraj and candidly discussed their views.
"The might of the state cannot bear violence from one side, so if stone pelting occurs then the Army also fires bullets. I want to end on this note that the solution cannot be achieved by throwing stones or by the firing of bullets by the Army. The solution whenever it is achieved will be only be possible by sitting across a table, through dialogue and communication," said Sushma Swaraj.
BJP leader Smriti Irani, who heads the women's wing of the BJP was also present at this lively interaction meet.

Situation remains calm in J-K barring a few stone-pelting incidents

Situation in the valley remained by and large peaceful barring a couple of incidents of stone pelting on Wednesday.
A stray incident of stone pelting was reported from Khwaja bagh Baramulla area. The stone pelters were chased away by the police.
Heavy stone pelting, however, was reported from Jenab Sahib Soura in the late afternoon.
In separate incidents, police had to resort to baton charging and use of tear smoke shells to disperse a mob at Tarigam village, Kulgam district of Jammu and Kashmir state on Wednesday, after a mob involved in forcibly closing down of shops attacked it by pelting stones.
"Today some shops were opened in Tarigam Kulgam. Some miscreants tried to forcibly close down the shops which led to a scuffle between the miscreants and the shopkeepers. However, when a police party reached the spot some miscreants assembled there pelted stones on the police team," an official release stated.
The police used tear smoke shells and cane charge to disperse the mob.
However, the miscreants didn't relent forcing the police to fire some rubber pallets.
One person was injured in the back and is stated to be stable.
Some shops including that of a gas dealer were looted.
In a similar incident at Nihama, Pulwama three miscreants came on scooter and tried to force the closure of shops.
As the shopkeepers resisted their attempts, it led to skirmish.
The shopkeepers beat up the miscreants also informed the police.
However, the miscreants managed to run away despite injuries before the police could reach the place.(ANI)

Bhakra''s water level below maximum limit, no need to panic

The water level of Bhakra reservoir is rising every day following rains in catchment areas but it still stands below the maximum limit of 1670 feet. There is no need to panic as the present water level of Bhakra reservoir stands at 1664.5 feet which is much below the limit of 1670 feet, All India Power Engineers Federation chairman Padamjit Singh said here today. Last year, the level stood at 1602 feet, Singh said. The water inflow into the reservoir is 82,182 cusecs and the discharge 36,265 cusecs

Maoists fire at CRPF camp in J''khand; jawan injured

Maoists today opened fire at a CRPF camp at Bishnugarh near here, which left one jawan injured, police said. Three motorbike-borne Maoists reached the 22nd Battalion camp at Bishnugarh, about 45 km from here, at around 4 am and fired on the gates injuring a guard, DSP (Headquarters) Hazaribagh, Naushad Alam, said.
The CRPF personnel immediately took positions and returned the fire. The exchange of fire continued for about 20 minutes, Alam said, adding the ultras fled to the nearby forest.
The injured jawan, Mukesh Kumar, was referred to the Apollo Hospital at Ranchi. The CRPF men fired 50 rounds as against 22 rounds by the Maoists, he said.
During the search, security forces spotted a blood soaked towel, indicating bullets might have hit the Maoists, the officer said.

Finmin offers concessions on new tax plan

Finance minister Pranab Mukherjee on Wednesday offered concessions on most major demands by states on legislation needed to allow an ambitious tax reform to take effect from next April.
The goods and services tax (GST) regime would replace existing multiple state and federal levies such as excise duty, service tax, and value-added tax, simplifing tax administration, and aiming to curb tax evasion.
"The priority for now is the finalisation of draft constitutional amendments so that the amendment bill may be introduced in parliament during the ongoing monsoon session," Mukherjee told the panel of state finance ministers on GST.
After states objected to a clause in the draft GST bill giving the federal finance minister veto power over state tax matters, the finance minister dropped this clause altogether.
In a major concession to dissenting states, Mukherjee said decisions taken by a proposed GST council will be taken by consensus.
Mukherjee also promised states another revised draft of the GST bill to reflect these concessions.
"It is critical for meeting the April 2011 deadline," he said.
However, some states, especially those ruled by the opposition Bhartiya Janta Party, wanted one month to consider the draft GST bill which also needs approval from state legislatures before the new tax system can be introduced.
"Some states have raised certain objections ... but our target is still April 2011 to implement the GST," Asim Das Gupta, head of the panel told reporters after the meeting.
Senior finance ministry officials seemed optimistic about the GST being introduced on time on April 1, 2011.
The officials, who did not wish to be named, said that even if the GST bill is introduced in the next session of parliament starting towards the end of the year, the deadline could be met.
High expectations rest on GST with business executives and investors hoping it will reduce their average tax burden by eliminating multiple taxes and cut down on corruption and red tape.

Healthcare costs reflect government apathy

New Delhi, Aug. 16 -- There's been a lot of discussion lately about health insurance and its economics.
The basic problem is that hospitals charge far more from patients who have health insurance, and the insurers are bleeding money as a result. It's common knowledge that private Indian hospitals that are reputed to be good (regardless of whether they are actually good) tend to charge breathtaking amounts - but they charge even more when an insurer foots the bill.
The insurance industry wants hospitals to charge less or be removed from the cashless list. Hospitals claim that providing high-quality care has high cost and the IRDA, predictably, thinks that the solution lies in insurance customers paying more to insurance companies.
However, hidden behind these conflicting opinions is an alarming fact - our dysfunctional public health system, combined with profit-driven insurance and healthcare industries will inevitably add up to disaster, no matter which way the current crisis is solved. The facts are very simple.
Around the world, people's access to reasonably-priced and good quality healthcare is linked to the viability of their countries' universal public health systems. Unless a large mass of people are content with zero-priced (or close to zero-priced) government doctors and hospitals, there's nothing to keep the private healthcare and health-insurance industry honest.
What you are seeing right now is a battle between the two which is about which of the gets to keep more of the money they shake down the patients for.

Former Satyam chairman Ramalinga Raju granted bail - TV

NEW DELHI (Reuters) A court on Wednesday granted bail to former chairman and founder of Satyam Computer Services Ramalinga Raju in a case of accounting fraud that turned out to be India's biggest corporate scandal, television channels said.
The bail was granted by a court in Hyderabad on health grounds, the reports said.
Raju, a management graduate from Ohio University who founded Satyam in 1987, shocked investors in January 2009 when he said profits of the company had been overstated for years and assets were falsified. He has been in police custody since the revelation.
Raju's lawyer was not immediately available for comment.
In April, India's federal crime bureau said it had filed charges against nine people including Raju for alleged involvement in accounting fraud at the outsourcing firm.
The charges include criminal conspiracy, cheating and forgery and falsification of accounts, the Central Bureau of Investigation had said.
Five former Satyam officials were also granted bail in July. Those included former managing director B. Rama Raju and former finance chief Vadlamani Srinivas.
Satyam was sold to India's Tech Mahindra Ltd , majority-owned by Indian automaker Mahindra & Mahindra and partly owned by British telecoms operator BT Plc , in an auction in April last year. It was subsequently renamed Mahindra Satyam.

ANALYSIS - Why is the world not responding as Pakistan drowns?

Scant international donations to flooded Pakistan are being driven by a multitude of factors ranging from the financial crisis, donor fatigue, a low death toll and scepticism that the government can translate the contributions into effective aid, say relief workers and analysts.

The disaster, which has killed up to 1,600 people and affected 20 million, is one of the biggest humanitarian crises in recent years - bigger than the Indian Ocean tsunami in 2004 or the earthquake in Haiti earlier this year, according to the United Nations.

Yet despite the television images broadcast across the world showing large swathes of land submerged, villages and towns decimated and hundreds of thousands of people living in makeshift camps with no food and water, the world has been slow to react to calls for aid.

While some donations in cash and kind have been provided bilaterally or channelled via smaller appeals, only about 45 percent of the $459 million of the main U.N. appeal has been met by international donors - far less than in other recent disasters.

"It's pretty much fair to say that there has been a lot less money generated for the Pakistan floods than the other major disasters that it has been compared to, like Haiti and Kashmir earthquakes or the tsunami," said Jan Kellett, leader of Global Humanitarian Assistance, a programme that monitors trends in humanitarian financing run by British-based Development Alternatives.

"For example, on day 16 after the tsunami, commitments of aid were more than $1.4 billion, whereas the Pakistan flooding has received $200 million over the same period. So there is a huge difference."

NO MONEY LEFT?

Stretching from the far north of the country to the deep south - an area the size of England, Pakistan's floods have overwhelmed aid workers and authorities since they began almost three weeks ago.

Highways and bridges have been washed away, marooning hundreds of villages. Millions are now in danger of contracting diseases carried through contaminated water and insects such as diarrhoea, cholera and malaria.

Aid workers say the lack of funds has meant that only a tiny fraction of the 8 million people in need of urgent assistance have received food rations, clean drinking water and shelter.

Donor fatigue has, as in most disasters, become a significant challenge to getting the funds required, aid workers say.

"The disaster has not come at a good time," said Tammy Hasselfeldt, Pakistan director for the International Rescue Committee, an aid group, and chairwoman of the Pakistan Humanitarian Forum, a coalition of 37 of the biggest aid agencies in the country.

"First, it comes during the financial crisis and then it comes after the Haiti earthquake where donors have already made a huge aid commitment... It may be hard for them to fund another major disaster in a given fiscal year due to their budgetary restraints."

Others say the complexity of the disaster - the varying flood patterns and degree of help required in different parts of the country - may have made it difficult for donors to understand its effects.

"I think the sheer scale of the disaster means it is very hard for people to comprehend and put it into context," said Ben Ramalingam, head of research and development at ALNAP, a network of major international humanitarian agencies.

"I suspect the low death toll of about 1,600 has also played a part in slow response. Some might argue that if more people died, then sadly it would be easier to mobilise donors. While we have seen pictures of the floods on our TV screens and maps of the affected areas, it may be that there hasn't been enough of a human face to this disaster yet."

TARNISHED IMAGE?

As the Pakistani military has been spearheading relief efforts, the civilian government has been criticised for its ineffective response and President Asif Ali Zardari has been slammed for going ahead with an official visit to Europe while the disaster unfolded.

Many survivors have received no aid and public anger is growing. Some flood victims have blocked highways to demand government help or to try and snatch relief goods from passing trucks.

Some analysts believe this tarnished image of the government - and a more general perception of corruption in Pakistan - could be discouraging donors from coming to the rescue. But other experts disagree.

"No government anywhere, including in the developed world, would have been able to deal with a calamity of this magnitude on its own," said Samina Ahmed, South Asia project director for the International Crisis Group.

"Zardari's visit to Europe was a bad political call, but you have to look at the facts on the ground, at the size of the disaster, instead of looking for scapegoats."

Some observers draw parallels with the earthquake in Haiti, which attracted around $3 billion in international aid despite concerns over corruption and the collapse of the entire government machinery.

GLOBAL ATTENTION

According to the latest figures from the U.N. Financial Tracking System, the top donor has been the United States - a key ally of Pakistan - contributing almost 40 percent of the $208 million committed so far to the U.N. appeal.

Australia and the United Kingdom have each provided almost 13 percent of the money, while the European Commission has provided less than 1 percent.

Neva Khan, Pakistan director at aid group Oxfam, said the British government had made "a good start" pledging more than 30 million pounds ($47 million).

"But it can and should do much more to help the people of Pakistan. This is a disaster on an unprecedented scale which needs an equally robust response. Britain should be leading from the front by committing more aid money and pressing other wealthy countries, especially its EU partners, to do the same. So far, the response from Europe has been feeble," she added.

Experts say everyone - Pakistan's government, the United Nations and aid agencies - need to do more to grab donors' attention.

The weekend visit by U.N. Secretary General Ban Ki Moon to Pakistan where he described the plight of survivors as "heart-wrenching" has gone some way towards that, but that is not enough.

Aid workers say Zardari should declare a national emergency because it would help the world understand the seriousness of the crisis and draw in more funds.

Explaining the scale and nature of the disaster, what the needs are and exactly how aid is going to be delivered could also help.

"We are planning a whole series and sequence of events from the autumn into the winter to maintain the crucial international attention and focus on the extent of the crisis and the massive needs of the people of Pakistan," said Kilian Kleinschmidt, deputy to the U.N. Secretary General's Special Envoy to Pakistan, adding that the U.N. General Assembly would hold a special session on Pakistan on Thursday.

"Pakistan will require our continued and sustained engagement to recover."

Anil Ambani eyes stake in commodity bourse

Billionaire Anil Ambani's group plans to buy 26 percent of a local commodities exchange, signalling growing corporate interest in bourses where Goldman Sachs and IntercontinentalExchange have bought small stakes.

The Reliance Anil Dhirubhai Ambani Group (R-ADAG) plans to buy a stake in the Indian Commodity Exchange (ICEX), a leading bourse for trade in metals including gold, while Jaypee Capital wants to acquire 26 percent in the National Commodity and Derivatives Exchange (NCDEX), said the market regulator, whose approval is needed for stake sales in bourses.

R-ADAG's Reliance Money, a unit of Reliance Capital, will buy the stake from Indiabulls Financial Services Ltd, which owns 40 percent of ICEX, which was founded last year by state-run metals and farm commodities trader MMTC Ltd, two sources in Indiabulls said.

B.C Khatua, chairman of the Forward Markets Commission that regulates commodities exchanges, confirmed there was a proposal to sell equity to Reliance Money but he did not say how much stake would be sold.

"Yes Indiabulls has approached us... They want to surrender their anchor-investor (main equity holder) status to Reliance Money," Khatua said.

He also said the regulator was considering a proposal from Jaypee Capital Services to acquire a 26 percent anchor investor stake in NCDEX.

Analysts said the entry of large business groups such as R-ADAG would help boost the exchanges' turnover.

"Investors are expecting valuations to go up if there are reforms in this sector. The entry of players like Reliance will drive up trading volumes," said Gnanasekar Thiagarajan, director, Commtrendz Research.

India has four commodity bourses - National Commodity and Derivatives Exchange (NCDEX), Multi-Commodity Exchange (MCX), National Multi-Commodity Exchange, and ICEX - which operate at the national level.

A fifth bourse ACE Derivatives and Commodity Exchange, promoted by Kotak Mahindra Bank, has been given national level commodity exchange status last week and would launch operations in a month's time.

India, which allowed futures trading in commodities in 2003, has one of the fastest growing commodity futures markets and had a combined turnover of 77.65 trillion rupees in the 2009/10 fiscal year ending March.

The growing turnover has attracted several investors such as Goldman Sachs that bought 4 percent stake in NCDEX through a Mauritius-based investment arm and InterContinental Exchange that also holds a 4 percent stake in the same exchange.

NYSE Euronext, Fidelity International, Aginyx Enterprises, Intel Capital, and Passport India Investments own stakes in rival MCX, India's biggest commodities exchange..

Foreign investors are allowed to hold up to 5 percent equity in local commodities' exchanges.

India, Mongolia win cases on tax-free diplomatic properties

New York, Aug 18 (DPA) A US court has ruled that India and Mongolia do not have to pay property tax on permanent housing for their diplomats, which was a blow to New York City's efforts to collect $47 million, news reports said Wednesday.

Those two countries, like many other foreign missions accredited to the UN, have refused to pay taxes and interest on diplomatic properties and housing for diplomats. The city has been trying for years to collect hundreds of millions of dollars from foreign missions, and won in the past against Turkey and the Philippines.

The Second US Court of Appeals late Tuesday ruled in favour of India's and Mongolia's lawsuits fighting tax collectors. New York City claimed Mongolia owed $4.4 million since the 1980s and India owed nearly $43 million since 1991.

News reports said a decision by the US State Department in 2009 to confer tax exemption to foreign governments and living quarters for diplomats helped Tuesday's ruling. The cases for Turkey and the Philippines took place before 2009.

Gujarat delegation in Seoul for Vibrant Gujarat 2011

The first international delegation to South Korea to promote the Vibrant Gujarat 2011 investment summit has received an overwhelming response, an official said here Wednesday.

About 80 Korean companies and trade associations participated in the roadshow that was organised Aug 16 at Seoul. Ravi Saxena, Gujarat's Additional Chief Secretary for science and technology, led the delegation.

'Senior representatives from several companies like Samsung, Hanwha Group, Daewoo E & C and Korea Maritime Institute amongst others were present during the roadshow,' informed Ravi Saxena, while speaking from Seoul.

'The roadshow was followed by meetings with companies and associations like Honam Petrochemcial Corporation and Medium Business Corporation amongst others' he added.

Skand R. Tayal, Indian Ambassador to Korea, delivered the inaugural address and set the stage for discussions on developing a business relationship between Korea and Gujarat.

Saxena said there are several avenues of investments for Korean companies in Gujarat in the sectors of infrastructure development, IT devices, networks and applications, petrochemicals, renewable energy, shipbuilding and healthcare.

It is to be noted that Indian government has embarked on a 'Look East' policy and South Korea offers several business opportunities.

The South Korean President Lee Myung- Bak was the chief guest during the republic day celebrations of India this year. This is an evidence of strong growing relationship between the two countries and both countries are looking at strengthening the business relations after signing of the Comprehensive Economic Partnership Agreement last year.

A target of increasing the bilateral trade to $30 billion by 2014 has been set by both the countries.

'Eight other similar delegations will be visiting countries around the world during the months of August and September to promote Vibrant Gujarat 2011 event and inward investments to the state,' the spokesman said.

Obama: U.S. must tackle deficit without denting recovery

President Barack Obama said on Wednesday the United States must figure out how to control its long-term deficit without hurting economic recovery, which remains hobbled by the overabundant housing market.

Obama acknowledged the deficit is worrying Americans and said cutting it would raise the public's confidence.

"People, consumers, are not going to start spending until they feel a little more confident that the economy's getting stronger," Obama told a group of about 30 voters at a home in Columbus.

The president is on a three-day swing through important electoral states to tout his economic policies and raise millions of dollars for Democratic candidates campaigning for the Nov. 2 elections.

The U.S. budget deficit is expected to reach $1.47 trillion for the 2010 fiscal year. Republicans have balked at plans to stimulate the economy with additional spending, citing the record deficit. Democrats in turn want to eliminate tax cuts for the richest Americans to address the same issue.

U.S. growth slowed in the second quarter, sparking fears the country might suffer a double-dip recession after climbing out of the worst economic slump since the Great Depression. Obama said housing oversupply was obstructing the recovery.

"The housing market is still a big drag on the economy as a whole," Obama said. "It is going to take some time for us to absorb this inventory, that was really too high."

Sharply rising prices encouraged far more homes to be built than were needed and overhang of inventory will take time to mop up.

"We were building 2 million homes a year when only 1.4 (million) were being absorbed," he said.

The trip is Obama's ninth to Ohio -- always an important swing state in U.S. elections -- since becoming president.

Obama took questions from a handful of voters and most asked about pocketbook issues, including pension plans, Social Security and the cost of healthcare and childcare.

The prospects for Obama's fellow Democrats to hold their majorities in the U.S. House of Representatives and Senate in November are complicated by fears that the country may be on the brink of a double-dip recession, with employment at 9.5 percent.

The president's approval ratings, which have fallen into the mid- to lower 40 percent range, also are a difficulty. Congress' ratings are even worse, hovering at about 20 percent.

Satyam scam: Court asks CBI to make specific charges

Hyderabad, Aug 18 (PTI) A local court today directed the CBI to submit "specific material" on its allegations against the former Chairman of Satyam Computers, B Ramalinga Raju, and nine other accused in the multi-crore accounting scam in the IT firm, prior to framing of charges against them. The XXI Additional Chief Metropolitan Magistrate court, which today began hearing arguments on framing of charges against the accused, asked the CBI counsel to inform it in a specific way on the agency''s allegations against the accused in two main chargesheets, besides a supplementary chargesheet.

CBI counsel K Surendra said as part of the conspiracy, the accused projected a rosy picture about the financial status of Satyam and lured investors ''dishonestly and fraudulently'' to invest in the shares of Satyam Computer Services Limited, making wrongful gains to the tune of crores of rupees. Countering the allegations, Raju''s counsel, Umamaheshwar Rao, termed the CBI''s allegations as ''hypothetical'', saying one cannot influence the share prices or the stock market.

He said the CBI''s chargesheets were not only voluminous, but lacked clarity on the charges to be framed against his client. After the arguments, Magistrate B V L N Chakravarti asked the CBI counsel to "submit to the court the material (on the allegations in the chargesheet) you are relying on and be specific on it so that there can be more clarity on the charges even while framing them.

" The judge posted the matter for hearing to tomorrow. The court on Monday had completed the process of examination of prime accused Ramalinga Raju and nine others, though all of them had denied the allegations.

Hindu seer opposes hydro projects on Ganga

Puri Shankaracharya Nishchalanand Saraswati has opposed a move by Uttarakhand to build hydropower projects across the Ganga, describing it as an attempt to destroy the sacred river.

Saraswati Wednesday demanded an immediate stop to the ongoing and upcoming projects, and said that in place of building such projects, Uttarakhand should try to tap alternative available sources such as surplus rain water to produce electricity.

He also extended his support to G.D. Agarwal, a noted environmentalist who has been protesting power projects on the Ganga.

Washington, Aug 18 (IANS) India figures way down at a lowly 78th place in the Newsweek magazine's list of best countries in the world, but Prime Minister Manmohan Singh gets the pride of place.

Hailing him among 'The Leaders Other Leaders Love', the US magazine in its latest cover story notes how 'Manmohan Singh, a sophisticated former economist, has played a key role in the country's emergence as one of the rising powers of the 21st century'.

While crediting him with 'engineering the transition from stagnant socialism to a spectacular takeoff in the global economy', Newsweek says 'it's Singh's unassuming personal style that really inspires awe among his fellow global luminaries, who praise him for being modest, humble, and incorruptible'.

The magazine cites former International Atomic Energy Agency director-general and Egyptian presidential challenger Mohamed ElBaradei as saying that the soft-spoken Manmohan Singh is 'the model of what a political leader should be'.

Next among leaders who 'have managed to win serious respect' is the British prime minister, 'The Ambitious Newcomer: David Cameron'.

He is followed by Maldives President 'The Green Guru: Mohamed Nasheed' and 'The Loved-Abroad-Hated-At-Home' French President Nicolas Sarkozy. Chinese premier Wen Jiabao takes the fifth place as 'The Man of the People'.

But based on five categories of national well-being, education, health, quality of life, economic competitiveness, and political environment, Newsweek's first-ever Best Countries special issue lists India at the 78th place with a score of 55.70 out of 100.

Finland tops the list with 89.31, the US is ranked 11th with 85.51.

In South Asia, Sri Lanka is ranked at 66 with 58.80, higher than India. Neighbours Bangladesh and Pakistan get the 88th and 89th place with scores of 47.40 and 47.70 respectively.

Burkina Faso at 100th place brings up the rear with a score of 33.59.

India to become world's fastest growing economy by 2013-15: Morgan Stanley

NEW DELHI: The two hands to produce count for more than that one mouth to feed, after all. Driven by a sterling demographic dividend, continuing structural reform and globalisation, India is poised to accelerate its growth rate to 9-9.5% over 2013-15, even as China will cool down to a more sedate 9% by 2012 and to 8% by 2015. So finds a new report by Morgan Stanley, authored by Chetan Ahya (managing director for Asia and India economist, who writes a monthly column for ET) and Tanvee Gupta.


India has one of the lowest median ages among the major economies. When an economy prospers, first its death rate and then, its birth rate falls. As this trend proceeds, there is a big bulge in the working age population while the non-working population (the young and the old) shrink as a share of the population. The lowering of the dependent (non-working) population to working age population ratio has twin effects.


One, it allows people to save a large proportion of their income, raising the country's rate of savings; two, it boosts the number of people who work and contribute to growth. Thanks to structural reform, the additional hands available for work find work. Even with stagnant per capita output, the sheer increase in the number of workers would raise GDP growth. With reform pushing up productivity per worker, GDP would rise even faster.




Globalisation gives additional job opportunities, additional capital to augment rising domestic savings and additional know-how. With this happy combination, the report expects India to become the world's fastest-growing economy. The government's chief economic advisor Kaushik Basu has been forecasting such a development as well.


"Real GDP growth in China has averaged 10% annually over the past 30 years, compared with 6.2% in India. During this period, China's GDP grew 16 times to $5 trillion whereas India's rose seven times to $1.2 trillion. China's exports (including services) surged 65 times over this period to $1,330 billion while India's exports increased 22 times to $250 billion" says the report.


China has overtaken Japan to become the world's second-largest economy. China's demographic transition pushed up its savings rate above 30% in 1985, while India's savings rate crossed that level only in 2005. India's consumption level will now come down, even as China's will rise.


Underlying the Morgan Stanley forecast is the assumption that India will significantly jack up its expenditure on infrastructure and in plant and machinery. Infrastructure expenditure has gone up from 5.4% of GDP in 2005 to 7.5% in 2009 and is poised to go up to 8% of GDP in 2010. Over 2012-17, the forecast is that India's infrastructure spend would be $1 trillion as compared with $530 million over the previous five-year period.


Another assumption is on the quantity and quality of the young people coming into the workforce. While India will be the largest contributor to the world's workforce — all of 136 million people — over the next 10 years (fully a quarter of the entire world's additional workforce), China will add just 23 million.

Emerging mkts most favoured investment destinations: Survey

Emerging markets across the world remained the most favoured investment destinations, amid improving investor outlook for global economy and corporate earnings in August, a global survey of fund managers said. As per financial services major BofA Merrill Lynch''s Fund Managers Survey for August, recession fears are easing and investors are boasting of an improved risk appetite.

"Emerging market is by far the most favoured region but positioning remains some way off the highs of last November," the report added. As risk appetite and the growth outlook improve, emerging markets'' positioning increased, a net 38 per cent respondents are ''overweight'' on the region, up from 34 per cent of those surveyed last month, it said.

Overweight refers to a recommendation for investors to increase their investment position in a particular market. "Spotlight of investor pessimism has shifted from China and Europe to Japan and the US. Investors clearly remain cautious, so better news on the US growth and fiscal policy would be a pleasant surprise," BofA Merrill Lynch Global Research Chief Global Equities strategist Michael Hartnett said.

Among the emerging market countries -- Russia and Turkey remain the most favoured country ''overweights''. Fund managers increased their positions in Brazil whilst China positions were cut slightly in August.

Interestingly, the survey did not mention fund managers'' positions on Indian equities in August. The survey noted a net five per cent of respondents predicted that the global economy would improve in the next year, a modest turnaround from July when a net 12 per cent of respondents predicted the world economy would deteriorate.

While the percentage of respondents expecting below-trend growth and inflation, remained unchanged at 73 per cent in August, the survey shows recession fears easing. Among the emerging markets, investors in Asia Pacific countries increased their position in banks, technology and industries, which are now the most favoured sectors in the region.

Defensive sectors of utilities and media remain the least favoured sectors in the Asia-Pacific region. A total of 187 fund managers, managing a total of USD 513 billion, participated in the global survey in August.

No place for India on global high Streets

MUMBAI: A DAY after a new report by Morgan Stanley said India was poised to emerge as the fastest-growing economy by 2012-13, the country does not figure among the most favoured destinations for buying stocks in the eyes of global fund managers, reinforcing the widely-held belief that the local markets are among the most expensive in the world.


According to the BoA Merrill Lynch survey of 187 global fund managers in August, Russia and Turkey are the most favoured markets for a large number of fund managers who invest in emerging markets across the world.


Interestingly, India—perceived to be among the most expensive markets globally—barely finds a mention in the report. So much so that fund managers eyeing Asia-Pacific are underweight on India, though they have reduced their bearish view slightly in August.


These fund managers are 'overweight' on these two markets by a wide margin. Brazil, Indonesia, Thailand and Mexico are their other favourites. Indian is only marginally 'overweight' on this list. Taiwan, Malaysia and China, which has overtaken Japan as the second-largest economy in the world, figure in the list of 'underweights'. Analyst estimates for the earnings per share of the BSE 30-share Sensex in the current financial year range between `950-1,050.


This translates into a forward price earning multiple of 17-19 times, which market participants say is slightly on the higher side compared to historic valuations. And while most of the mid-cap stocks in India have done well, the benchmark indices have been stuck in a narrow range for the past six months.


"China is still the most favoured market for Asia-Pac investors. Hong Kong and Korea have been raised to overweight, whilst positions in Taiwan have been cut to neutral. Australia remains the least favoured markets in the region," the survey said.




At the broader level, fund managers' outlook on the emerging markets has improved this month, largely due to a more positive view on the Chinese economy.


Less bearish on global scene


A net 38% of the respondents are overweight on the region, up from 34% in July. But this is way off the 53% overweight seen in November last year, the survey said.


"A net 39% of EM (emerging market) investors believe global liquidity and domestic demand will be the most important drivers of EM equity prices. The recent run of weak US economic data has also affected their views: a net 78% think US demand will be the least important driver, up from 40% last month and one of the worst readings since April '09," the survey said.


Overall, fund managers are less bearish on the global economy now than they were in June and July. However, they remain cautious on global growth and risk.


"A mere 5% of investors forecast stronger global growth in the next 12 months, but a large 78% majority do not expect another recession," the survey said. In July, 12% of the fund managers had said they expected the global economy to deteriorate.


Among other findings of the survey, there has been a sharp drop in investors' appetite for US and Japanese equities, but a recovery in demand for euro-zone equities.

US hopes visa hike would not hurt India bWASHINGTON: Amid reports that India may take it to the World Trade Organisation (WTO) for a new law to hike worker visa fees, the United States hopes it would not affect their long term economic partnership


"What I can say is that we understand the Government of India's concerns," State Department spokesman Mark Toner told reporters Tuesday when asked to comment on reports that India was considering a complaint to WTO.


"We realise it could impact Indian companies that invest in the United States and we also understand the potential impact on Indians who work in the United States as well as some American businesses," he said.


"But we remain confident that our long-term economic partnership with India will continue to deepen and provide benefits for both societies," Toner said.


"It's within India's purview to do that," he said when pressed about the possibility of India's complaint to WTO. "Again, I think we remain cognizant of the effect that this legislation may have on India, and we're going to try to work with them to mitigate it."


"But beyond that, I don't have a reaction. I mean, we've got a robust economic partnership with India," Toner said.


The spokesman's comments came amid reports that Indian Trade Secretary Rahul Khullar had described the new US visa restrictions as not compatible with WTO regulations.


"Yes, this is WTO incompatible. I have no doubt about it," he was quoted as saying in a (Reuters) news agency report.


The law signed by President Barack Obama Friday steeply hikes H1-B and L worker visa fees in the case of companies whose workforce is less than half American to raise $ 600 million to strengthen security along the border with Mexico.


The Indian government has protested to Washington against what it calls a highly discriminatory law that would largely affect Indian IT firms like Tata Consultancy Services, Infosys Technologies, Wipro and Mahindra Satyam.


Indian Commerce Minister Anand Sharma has said that bill would cost Indian companies an extra $200 million a year and erode the competitiveness of Indian companies that send professionals to undertake projects in the United States.
