VANCOUVER – (Updated with documents) Two Canadian men, including a lawyer, continue to be in denial that they have been sued by the Aga Khan for violation of his copyright on material he authored.
Toronto lawyer Alnaz Jiwa and Montreal resident Nagib Tajdin had earlier alleged that the Aga Khan was not the one who filed the infringement suit in the Canadian Federal Court and that a usurper and an impostor had forged his signature on correspondence asking them to stop the publication of a book.
Now, the pair claim a statement signed by the Aga Khan in front of a notary public in Boston that affirmed that he was indeed the plaintiff in the case is also a forgery. Their claim is supposedly based on expert evidence.
Jiwa and Tajdin had earlier submitted a statement of defence in which they claimed they were loyal followers of the Aga Khan and that they did not believe he was the plaintiff. They also vowed in their sworn statement that they would stop the distribution of the Aga Khan's work if they were instructed to do so.
The new claim of a forged notarized statement is likely to focus the attention of the Ontario Bar Association on the lawyer who is being sued as well as the likelihood the court will invoke sanctions against them if it is established they are knowingly misrepresenting the facts.
Brian Gray, the Aga Khan's lawyer, vowed on Tuesday morning to pursue a "vigorous" response against the pair for the continued claim of forgery which is made despite the sworn statement by the Aga Khan signed in front of a Boston notary public and prominent lawyer.
Asked whether the defendants had claimed that the notarized statement was faked, Gray responded: "It is true that they filed a document claiming that the notarized statement is a forgery."
"We will be filing a vigorous response to this. I cannot say more without instructions from my client, but you will see our response in due course," he said.
Gray has previously stated he met with the Aga Khan during a recent visit and was told by the spiritual leader that he had made the decision personally to proceed with a lawsuit.
As well, Ismaili congregations around the world have been told through direct instructions by the Aga Khan why he resorted to a lawsuit. The Aga Khan said his previous correspondence and efforts had failed to stop the two men.
The two men appear to think that they are following a secret divine mission to stop the Aga Khan from being misguided by his aides.
The Aga Khan categorically denied that anyone had forged his signature, denied that anyone else had launched the lawsuit and urged the defendants to stop violating his copyright on his written pronouncements to his followers.
The two defendants have been clamouring for a personal audience with the Aga Khan, even though that was not one of their demands in the statement of defence filed in federal court.
The Aga Khan rejected the request to meet with the two men but left open the option of corresponding with them by mail.
Included in the court filing is a sworn affidavit by a Montreal man who said he presented a book to the Aga Khan in 1992 and received implied consent. The Aga Khan has stated he did not consent to publication of his writings at any time.

How do you know "she" is only personally responsible? Do you know who "she" is or even if it is a "she?'
You know Ismailis are a well knit community. It is not possible for these gangsters to be attacking an Islamic woman without orders from the thug at the top.
Have you noticed any Ismaili contradicting Zina Khan, Sharouq and Yes Sir Khan? [All fake names.]
Mike Ghouse jumps to criticize wrongs done by Muslims in far away places. [Alleged wrongs.] Same with Hasni Essa. He even distributes Hindu and Zionist propaganda for this purpose. They have not rejected sexual assault on an Islamic woman on cyber space.
Are you more loyal than the king.

What makes you think Agha Khan cannot be criticized. Ismaili dogs are criticizing Sahaba, the Qur'an, the wives of the Qur'an, all the mujahideen and imams and you think Agha Khan and his thugs should not be criticized.
The only way out for these dogs is to give an unambiguous apology to Sis. Gulshan and NEVER again insult a Muslim woman.

Agha Khan is a gangster and a thug as can be seen in the behavior of his rep Zina Khan and his propagandist Hasni Essa.
Zina Khan is personally responsible for what she writes and Aga Khan is not involved. Hasni Issa has been very modest. He has never used abusive language himself though, he has appreciated the arguments of ZK.
Facts about Agha khan:
1. Does not support any Islamic movement.
Wrong,he himself is a leader of an Islamic movement . We can not deny his work away from Islam.
2. Supports Israel, the US occupation forces and ALL dictators.
It has been shown that wherever it has been possible, he has tried to mediate.In Palestine, ZK told us that he was prevented because PLO is not interested.
3. Why do AK's gangsters attack this pious woman Sis. Gulshan? because she left the corrupt Ismaili religion and opened the way for many other women to leave too.
Gulshan joined late in the discussion. You have not yet unlearn some of abusive words for Aga Khan. We can not describe religion corrupt without understanding it completely. It has been explained many times that Aga Khan is an Imam and if you are not interested in following him, there is no coercion, but it is unethical to describe the madhhab of Aga Khan as corrupt.
Agha Khan's religion is not a place for women who want to follow Islam.
Those who perpetrated two world wars, dropped atomic bombs and killed a million people in Iraq certainly are in no position to preach morality to anyone.
Aga Khan has nothing to do with all these.
