Respected Sir,

 

The victim Mr. Firoj Ahmed and his wife Ms. Achma Bibi from District-North 24 Parganas, West Bengal came under the wrath of the perpetrators police personnel of Basirhat Police Station. The perpetrator police personnel of Basirhat Police Station raided the house of the victim at the dead end of the night and forcibly made an entry into his house and brutally assaulted him and his wife. The police took the victim to Basirhat Police Station and again another round of beating continued upon him in police lock up. The victim sustained grievous injuries as a result of the torture. The police did not disclose any reason for his apprehension at the time of his arrest and also did not issue any Memo of Arrest. The present incident is gruesome example of custodial torture perpetrated by the involved police personnel of Basirhat Police Station. All such alleged illegal acts of the police are violation of the established laws and gross dereliction of duty which directly infringed the rights of the victim. Our attached fact finding report gives details of the incidents.  

 

We lodge this present complaint against the perpetrator police personnel of Basirhat Police Station and also against the higher officials of the district who remained inactive on the complaint of the victim and seek your urgent intervention in this matter in the following manner:-

 

·         The whole matter must be investigated by one neutral investigating agency appointed by the Commission preferably not by any one from the district police administration.

·         The complaints made by the victim's wife against the perpetrator police personnel of Basirhat Police Station must be taken due cognizance and the perpetrators must be booked under the law immediately and should be punished strictly under the law.

·         The victim must be relieved from all false and concocted criminal cases forthwith.

·         The victim and his family members must be immediately brought under due protection and they should be provided with proper compensation

Particulars of the victim:- Mr. Firoj Ahmed, son of Faijur Ahmed, aged about-23 years, by faith-Muslim, by occupation-Cultivation, residing at village-Srikati, Police Station-Baduria, District-North 24 Parganas, West Bengal, India.

 

Particulars of the perpetrators:- The involved police personnel of Basirhat Police Station.

 

Date & time of the incident: - On 7.2.2012 at about 2.30 hours

 

Place of incident: - Inside the house of the victim at village-Srikati, Police Station-Baduria, District-North 24 Parganas

 

Fact Finding Details: - It is revealed during the fact finding that on 7.2.2012 at about 2.30 hours about 15 to 16 police personnel from Basirhat Police Station came to the house of the victim with intention to arrest him. At the time of arrest of the victim the police did not issue any memo of arrest and no reason was disclosed for his arrest. The victim's wife tried to save him from the brutality of the police personnel, but one of the police personnel present there hit on her left hand by a wooden button. Instead of that the victim's wife pleaded before the police personnel to free her husband, but the police personnel did not pay any heed and one of the police personnel again thrashed her on the ground by kicking her. The police personnel abused the victim in filthy languages and at the same time he was brutally assaulted by the police personnel. The police personnel assaulted him by kicking on his body indiscriminately and hitting him by rifle butt and wooden button. As a result of the assault the victim sustained severe injuries on his body and he almost lost his ability to stand on his feet and walk properly. The police personnel forcibly took him by dragging his body. Then he was put into a Tata Sumo (four wheeler car) and the car along with a police jeep went away.

 

In the next morning (8.2.2012) at about 10 am the wife and other family members of the victim reached at Basirhat Police Station to meet with the victim. They requested the on-duty police officer to allow them to meet with the victim. But the duty-officer started abusing them in filthy languages and misbehaved with them. After several requests the wife and other family members of the victim was allowed to meet with him. The victim told them that at the police station he was again brutally assaulted by the police personnel and his left hand's fingers were fractured by beating with wooden button. He also told that he was not served with adequate food. The victim was not treated by any medical practitioner since his apprehension. It was learnt that Mr. Firoj was shown arrest by police in Case No. 24 / 2012 under section 20B NDPS (Narcotic Drugs Psychotropic Substances Act.

 

On 20.2.2012 the victim's wife Ms. Achma Bibi lodged one written complaint in over the incident as stated above before the Additional Superintendent of Police, Barasat, North 24 Parganas and sought for legal action against the perpetrators police personnel, but till date no action was taken.
