WASHINGTON: The US government has given British energy giant BP a 72-hour deadline to produce updated plans to contain and recover the oil spill in the Gulf of Mexico, an official letter said Wednesday. "BP shall provide the plans for these parallel, continuous, and contingency collection processes, including an implementation timeline, within 72 hours of receiving this letter," ordered the letter. India slips to 128th in global peace index! India has slipped to a low of 128 in the Global Peace Index ranking with the country along with Pakistan and Sri Lanka experiencing more incidents of internal conflicts, terrorism and human rights abuses.
Overall the world became less peaceful for the second consecutive year, said the fourth annual GPI released.
As the global economy continues to falter, this year's data shows an intensification of conflicts and growing instability linked to the downturn that began in 2008, with several countries seeing sharp increases in homicides, violent demonstrations and fear of crime, it said.

The move would generate about Rs 1.5 lakh crore in revenues for the Centre.
"In the next five years, we will list 35 PSUs....the government will get almost Rs 1.5 lakh crore as revenue from this listing," Minister of state for Heavy Industry and Public sector enterprises Arun Yadav said at a CII function.
He said that the ministry is waiting for the Finance Ministry's approval. "Once we get the nod from the Finance Ministry, we will start the process," Yadav added.
Last week, disinvestment secretary Sumit Bose had said that Engineers India disinvestment is likely to take place by the middle of July.
Besides, the government is likely to sell stake in 10 PSUs, including MMTC, Coal India, SAIL, RINL and Shipping Corporation of India, in the current financial year. The Cabinet's nod for SAIL disinvestment has already been received.
Last fiscal, the government raised Rs 25,000 crore from stake sale in Oil India, NMDC, REC and NTPC.

Maintaining that the ministry has "renewed the request for an extradition on a number of occasions from the time it was first made in 2003 to September 2008, when the last request was made," a senior official said the MEA will "proceed on the basis of the collective decision of the government" on the issue.
"We will proceed on the basis of the collective decision of the government now. The government of India will take a decision how to move forward, legal authorities will be consulted....Government of India will take a decision, and we will proceed accordingly," the official said when asked if the MEA will renew its request once again.
The official said "it is not one single ministry in isolation" which takes a decision on such issues. Referring to the response of the US to India's request for extradition of former Union Carbide chief Anderson, the official said, "They have been saying that it is not possible to execute our request as it doesn't meet the relevant provisions of India-US extradition treaty and basically it is evidential links they are looking for.
"We have been requesting the investigating agency to give us the needful additional information that would enable us to press for a review of American decision and thereby expedite the case for extradition," the official said.
Then Ambassador to the US, Ronen Sen, had written to the CBI director saying that "we need more information if we are to take this request forward," the official said.
Asked if there was a need to review the whole bilateral extradition treaty with the US, the official said, "I don't think that is germane to the discussion at present."
The official also asserted that "whatever has been done, has been done on the basis of due diligence and consultations."
Asked about the charges made by a senior CBI official involved with the probe into Bhopal gas leak case 26 years ago that a letter was written by MEA asking not to press for extradition of Anderson, the official said, "We are looking at our records and we have not come across any such letter."
Nearly 26 years after world's worst industrial disaster left over 15,000 dead in Bhopal, former Union Carbide India Chairman Keshub Mahindra and six others were sentenced to two years imprisonment on Monday.
89-year-old Anderson, the then Chairman of Union Carbide Corporation of USA, who lives in the United States, appeared to have gone scot-free for the present as he is still an absconder and did not subject himself to trial. There was no word about him in the judgement of the Bhopal court.
The only study to quantify global peacefulness, the GPI is produced by the Institute for Economics and Peace (IEP).
According to the report, South Asia saw the greatest decrease in peacefulness, as a result of increased involvement in conflicts, a rise in deaths from internal conflict and human rights abuses.
The main countries experiencing decreases in peacefulness were India, Sri Lanka and Pakistan.
Three BRIC countries-Russia (143), India (128) and China (80)-saw substantial declines in peacefulness, while Brazil's score remained essentially stable (83) compared to the 2009 Index.
In fact, Russia saw one of the largest drops in peacefulness of any country this year due to its war with Georgia, ongoing acts of terror, and some protests across the country resulting from a deteriorating economic situation.
China saw its score deteriorate because of worsening security in parts of the country, notably Xinjiang province, where violent conflict prompted rises in several measures of societal safety, the report said.
However, the US (85) improved its 2010 GPI score, registering its biggest year-on-year improvement since the first Index was released in 2007.
The improvement came as a result of a decrease in the number of deaths from external conflict and an increase in political stability.
Western Europe continues to be the most peaceful region, with the majority of the countries ranking in the top 20.
All five Scandinavian nations rank in the top ten; however, Denmark dropped five spots to 7 because of decrease in respect for human rights and continuing involvement in Afghanistan.
Iraq, Somalia and Afghanistan were the least peaceful countries for the second consecutive year.
Syria, Georgia, the Philippines, Russia and Cyprus were this year's biggest fallers; the report said.
"How peaceful a country is depends on the internal structures, institutions, and attitudes that sustain and promote peace as well as on external factors," said Clyde McConaghy, board director of the IEP.
"This year's top five countries, and more peaceful countries in general, have certain things in common: well functioning governments, stable business environments, respect for human rights, low levels of corruption, high rates of participation in education, and freedom of information," McConaghy said.
'India Inc may raise up to Rs 2L-cr'
Indian companies are expected to raise up to Rs 2 lakh crore from the primary market over the next three years, the country's top brokerage and investment banking firm ICICI Securities said today."Over the next three years, we will see a lot of companies coming out...there will be additional papers in the market, Rs 1.5-2 lakh crore in the next three years," ICICI Securities' Managing Director and CEO Madhabi Puri-Buch said here on the sidelines of a CII event.
According to Buch, nearly USD 20 billion will be raised from the initial public offers (IPOs) market this fiscal only. We expect that Indian companies will "raise around USD 20 billion from the IPO market this fiscal," she said, adding that of this around Rs 40,000 crore would be from public sector and an equal amount from private companies.
She further said that many firms, especially small ones, may prefer the private equity (PE) route for raising funds.
"Smaller companies will prefer private equity. Liquidity is available in the market for Indian corporates."
When asked whether the new public holding rule will dampen the primary market, Buch said "I would not say it would prove a dampener for the IPO market."
Last week, the government made it mandatory that all the listed firms should ensure a minimum 25 per cent public holding. Analysts said following the new norm, public offers would swarm the market.
Buch added that under the new rule "companies may prefer to go for private equity investors in the initial stage".
Home Minister P Chidambaram will head the reconstituted panel which was earlier having Arjun Singh at the helm. Singh, who was the Chief Minister of Madhya Pradesh when the tragedy took place in 1984, is no longer in the government.
Other members of the panel GoM are Ghulam Nabi Azad, M Veerappa Moily, S Jaipal Reddy, Kamal Nath, Selja, M K Alagiri, Prithviraj Chavan and Jairam Ramesh, sources said.
Madhya Pradesh Minister in-charge of rehabilitation will be a permanent invitee, they said.
The GoM will examine all issues relating to Bhopal gas leakage, including remedial measures and make appropriate recommendations relating to the relief and rehabilitation of the victims of the tragedy and their families.
The reconstitution of the GoM has taken place two days after the court verdict which drew widespread criticism with the political class in unison terming it as "too little, too late".
Nearly 26 years after the disaster left over 15,000 dead, former Union Carbide India Chairman Keshub Mahindra and six others were on Monday sentenced to two years imprisonment.
Madhya Pradesh not entitled to challenge Bhopal verdict
Madhya Pradesh government's plan to challenge the Bhopal gas tragedy verdict in high court is likely to come a cropper as the Supreme Court has held that a state cannot file an appeal in a case probed by the Central Bureau of Investigation (CBI).The CBI was tasked with nvestigating the criminal culpability of various Union Carbide officials into the tragedy, within days of a police complaint being lodged at the city's Hanuman Ganj police station Dec 3, 1984.
Madhya Pradesh Chief Minister Shivraj Singh Chouhan Wednesday told reporters in Bhopal: 'Since the verdict is disappointing, we have decided to file an appeal to get justice for the victims and to get the sentence of the convicts increased.'
He was reacting to the widespread outrage over the trial court awarding two-year jail terms each to seven Union Carbide officials held guilty of criminal negligence in the Carbide pesticide plant, which caused leakage of poisonous gas that killed over 3,500 instantly and thousands later.
'Since people of Bhopal are victims in this case and they are represented by the state government, we have decided to file an appeal to get justice for the victims,' Chouhan said.
He added that his government will constitute a committee to study the legal aspects before going in for an appeal.
However, there seems to be a legal hitch in his plan. A Supreme Court bench headed by former chief justice K.G. Balakrishnan April 1 ruled that a state government was not entitled to go in an appeal against a judgment of a case probed by the CBI.
The bench gave its ruling on a petition of former Bihar chief minister Lalu Prasad and his wife Rabri against a Patna High Court decision to admit an appeal of the Nitish Kumar-led state government against their acquittal in a corruption case the CBI had probed.
The apex court bench, which also included Justice R.M. Lodha and Justice B.S. Chauhan, ruled that 'the appeal by the state government presented before Patna High Court is rejected as not maintainable.'
The apex court held that only the central government was empowered to go in an appeal against a trial court verdict in cases investigated by an agency set up under a central act.
'A case in which the offence has been investigated by the Delhi Special Police Establishment (CBI), or by another agency empowered to make investigation into an offence under any central act, only the central government may direct the public prosecutor to present an appeal to the high court against the sentence on the ground of its inadequacy,' the bench said.
The trial court verdict here Monday came 25 years after the Bhopal Union carbide plant gas leak on the night of Dec 2-3, 1984, spelt one of the worst industrial disasters in the world. Besides jail terms, the court slapped a fine of Rs.100,000 on the seven officials, including Keshub Mahindra who then headed the Union Carbide India Ltd (UCIL).

Posted: Jun 09, 2010 at 0058 hrs ISTNew Delhi The government today sought to end the debate on the civil nuclear liability Bill by agreeing to "periodically review" the Rs 500-crore cap fixed for operators of nuclear power plants as damages in the event of an accident, and increase it, if necessary.
At the same time, it has tried to make it easier for the nuclear operator to demand compensation amount from a foreign supplier in case the accident happens due to a fault in equipment. This has been done by removing a provision in the original Bill that gave the operator the right of recourse only if the accident had resulted from "wilful act or gross negligence" on the part of the supplier.
In significant amendments suggested at the first meeting of the standing committee for science and technology here today where the Civil Liability for Nuclear Damage Bill 2010 was considered, the government made it clear that the compensation cap of Rs 500 crore will not be the upper limit and can be revised upward.
The proposed amendment to Section 6 of the Bill — clearly a significant shift from the government's earlier position — said: "The liability of an operator for each nuclear incident shall be rupees five hundred crore: Provided that the Central government may review the amount of liability periodically and increase it if necessary by issuing orders under the Act."
Another amendment on increasing the liability stated that the amount increased "shall be decided by the Central government based on appraisal by the Nuclear Damage Claims Commission".
In the original Bill, the relevant provision read "The liability of an operator for each nuclear incident shall be rupees five hundred crore: provided that the Central government may, having regard to the extent of risk involved in a nuclear installation, by notification, either increase or decrease the amount of liability of the operator".
It further said that where the amount of liability was decreased "it shall not be less than rupees one hundred crore".
The original Bill did not talk about "periodic reviews".
The amended version also has provisions to decrease the liability of the operator, in case the damage assessment is lower than Rs 500 crore, but it does not have any lower limit of Rs 100 crore.
On the operator's right to recourse, it will ensure that the onus of liability is entirely dependent on the commercial contract and that the supplier does not come under any parliamentary oversight.
The government proposed deletion of subsection (b) of Section 17 of the existing Bill which states: "Operator of a nuclear installation shall have a right of recourse where, the nuclear incident has resulted from the wilful act or gross negligence on the part of the Supplier of the material, equipment or services, or of his employee".
The amendment, instead, now proposes that the Operator "will have right to recourse only if: such right is expressly provided for in a contract in writing". In other words, the onus will be on the Operator (meaning the government) to ensure a foolproof commercial agreement with the supplier, failing which it would have to solely bear the burden of compensation in the event of a nuclear incident.
The government amendments were circulated informally by the Secretary of the Department of Atomic Energy, Srikumar Banerjee who deposed before the standing committee during the meeting this afternoon. In his deposition, Banerjee also assured the standing committee that the government had no intention of opening the atomic energy sector to the private sector.
He also said that victims would still have the option of approaching the courts if they were not satisfied with the compensation package decided by the Nuclear Damage Claims Commission.
The standing committee, headed by Rajya Sabha member T Subbarami Reddy, will be meeting next on June 15.

New York: "We will be meticulous, we will be comprehensive, and we will be aggressive. We will not rest until justice is done," declared US Attorney General Eric Holder earlier this month, as he announced a criminal and civil investigation into the disastrous oil spill in the Gulf of Mexico.
The Obama administration has pledged to hold oil giant BP accountable for billions of dollars in damages and clean-up operations, as well as penalties, in the aftermath of the offshore oil rig accident that killed 11 men and has emptied millions of gallons of crude oil into the sea.
However, the world's worst industrial disaster to date was in Bhopal over 25 years ago. It is believed to have claimed over 15,000 lives and damaged thousands more. It has not merited this attention.
When asked on Monday if the US government would be willing to exert more pressure on Dow Chemical, which acquired Union Carbide Corporation over a decade earlier, to pay for cleaning up the site of the accident, or consider extraditing Union Carbide executives, including former CEO Warren Anderson, who has been declared an absconder in India, State Department official Robert Blake instead expressed the hope that the judgment delivered yesterday by a district court in Bhopal would give closure to the victims.
The judgment - two years in prison and fines of $2,100 each for seven defendants, a $10,600 fine for Union Carbide India Ltd, and no mention of Warren Anderson - has left even American lawyers aghast. "It's an absolute travesty," says Frank A Mayer, III, a Philadelphia-based lawyer with the firm of Pepper Hamilton LLP.
Referring to the out-of-court settlement reached in 1989 between Union Carbide and the government of India, which fixed Union Carbide's liability at $470 million, Mayer points out that such a settlement would not be possible in the US. "The US government would not be able to make a deal on behalf of various individuals. The individuals could pursue their rights under the law and the US Congress could not change their rights through legislation." In contrast, the Indian government took over the representation of all the Bhopal victims by passing the Bhopal Gas Leak Disaster Act.
"The outcome is the bestcase scenario for multinational corporations that want to do business in India," says Brian Mooney, Clinical Associate Professor at New York University. As a young lawyer at the firm of Kelley, Drye & Warren in 1984, Mooney was on the legal team that represented Union Carbide Corporation, but is now a supporter of the Bhopal gas victims.
However, experts feel Indian attempts to bring Warren Anderson to justice are on less solid ground. Mooney says corporate executives are not always held criminally liable for industrial accidents, and believes it's inconceivable that the US government would ever agree to extradite Anderson. He adds that it's especially unlikely at atime when the US wants to export nuclear technology to India and is pushing for liability legislation as part of the civilian nuclear agreement. India Syndicate reports: Twenty five years after a Congress Government lackadaisically allowed CEO and Chairman of Union Carbide Warren Anderson to get bail within six hours after over 15,000 were killed due to a gas leakage at the Union Carbide factory in Bhopal, provided him a government plane to ferry him to Delhi and catch a flight to the US, Union Law and Justice Minister M Veerappa Moily now says that the case against Anderson is not closed and that he will be extradited.
If this is not political methyl-iso-cyanate - the deadly gas that killed 15,000 in Bhopal and maimed many -- what is? There cannot be a more ludicrous governmental answer. Typical case of bolting the stable door after the horses have fled.
One must also remember that it took 19 years for the government to send a chit of paper seeking extradition of Anderson. What did the US do? Just ignored it.
What should be flagged here is that it was the Congress government had deliberately gone soft on Anderson. It allowed Anderson to flee four days after the tragedy occurred. He was arrested on December 7, 1984 on arrival in Bhopal, granted bail in just six hours and flown to Delhi in a plane provided by the then Arjun Singh-led Congress government.

Another example of how the Union government had dealt Anderson with kid's gloves: According to The Indian Express, officials who were in charge of the gas tragedy probe maintained that the central government was never serious about trying Warren Anderson in court. In a written communication from the Ministry of External Affairs, the CBI officer in charge of the investigation from April 1994 to July 1995, B R Lall, was categorically told not to press for Anderson's extradition.
"I received a written document directing me not to press for extradition of Anderson. The CBI is not functionally free and our government was determined to let the culprits walk free. Monday's convictions do not matter as these were foot-soldiers," said Lall, now retired.
Now the government blames the CBI for not doing its work properly in getting Anderson to doorsteps of the law.
Who is to be believed? One big letaway is why and how Anderson was provided a government plane to flee to Delhi? Was the CBI or the government that was soft on Anderson? If the Arjun Singh government was serious in getting to the bottom of the tragedy, it should have opposed the bail plea of Anderson and put him behind bars, not allow him to get bail in four hours flat. As if that was not good enough favour, the government provided him a plane too!!

So, the CBI is to be believed. Why Anderson was left off the hook is subject to speculation. Did he pay someone to flee?
And after allowing Anderson to flee, Mr Moily says the case against the then CEO of Union Carbide is not closed. How long will the case remain open, Mr Moily?
And then, the courts issue a warrant against Anderson and the reply that the Indian authorities get from the US is that he is untraceable. The Indian government accepts that without a murmur when the whole world knows his address. In fact, a few years ago, a Greepeace activist knocked at Anderson's doors and issued an arrest warrant!!
Advisor political estates and public relation officer of Greenpeace, Nirmala Karunan said during a photo exhibition in 2002 in America that an unknown person called them and told about the whereabouts of Anderson.
"On the basis of the information we had gone to his (Anderson) residence but his wife told us that he was not at home. Later we saw Anderson escaping from the back door of his house," she said.
The Greenpeace activist claimed that she shared this information with the US and Indian courts and CBI.

And the government does not know where Anderson is!!
89-year-old Anderson, who lives in the United States, is an absconder and did not subject himself to the trial.
Here are other examples of how India was soft on Union Carbide:
In September 1986, the Government of India files a civil suit for Rs 3900 crore as compensation and punitive damages. A year later, the district judge proposes an interim relief of Rs 350 crore. On appeal, the MP High Court rules in favour of Union Carbide and reduces the amount to Rs 250 crore. Indian judiciary at work!!
On Feb 14, 1989, the Indian Government bends again to Union Carbide. The Government and the company accepts a compensation of Rs 705 crore and all civil and criminal cases are dropped. In the US, the victims of 9/11 got a compensation of $1.8 million. The Bhopal Gas victims? Rs 12,000!!
In 1996, the judiciary does another big favour to Union Carbide by reducing criminal charges from Section 304, culpable homicide that would have attracted 10 years in jail to that of Section 304A - causing death due to negligence - that could attract just 2 years in jail for killing over 15,000 people. As The Hindu rightly headlined it: The court reduced the tragedy of 15,000 deaths to `A traffic accident in Bhopal'.

Section 304A is slapped on drivers who cause death due to negligence. And former Chief Justice of India A H Ahmadi, who headed the 1996 bench that converted the case to that of 304A, has justified the judgment saying there in criminal law there was no scope of vicarious liability.
What a terrible inhumane stand to take. Would the supreme a court in the US, UK, France or any other country taken such a stand when 15,000 people get killed and scores maimed for life?
In 2001, another dodging of the judicial system. Dow Chemicals buys out Union Carbide. The Ministry for Company Affairs keeps quiet. When Dow Chemicals is hauled before the court, it takes the stand that it is not the same as Dow US.
Tonnes of methyl-iso-cyanate (MIC) spewd out of the now shut Union Carbide pesticide plant located in a congested part of Bhopal on Dec 2-3 night in 1984.
In the years that followed, people exposed to the gas kept dying or suffered from life-long ailments and complications. The death toll is believed to be about 25,000.
Twenty five year later, Moily and the government continue to spew tonnes of `political methyl-iso-cyanate' that has and will numb India's conscience and reduce many to helplessness with the gnawing feeling that in India, life has not value.
And yet, Moily is an honourable man.

Who mocks at justice better than judiciary itself?
It shouldn't be; but the fact remains that the idea of justice has always been problematic. Even when the crime committed is as clear as daylight, the nitti-gritties of law provide room for the criminal to offer excuses, seek easy escape routes and parade in the civil society with obscene haughtiness. In some cases, the definition of bizarre is even taken beyond the extreme as it happened when a tragedy that claimed more than 15,00 lives (Bhopal gas tragedy) was termed as death due to 'criminal negligence' -- a section commonly used for traffic accidents. In translation, it means the Bhopal tragedy was 'just a traffic accident which caused 15,000 deaths'. In the aftermath of the verdict on the Bhopal gas tragedy, MSN takes a look at the various cases where justice was delayed (and thus denied), and in the process mocked at, by the judiciary itself.
Bhopal: India's 26 years of shame!
It's the midnight of December 3, 1984 and the people of Bhopal have no idea what has filled the city's air. They wake up aspyxiated, breathe poison, and die. And die in thousands. The reason: methyl isocynate, a deadly toxin, had leaked from the Union Carbide India Pesticide plant. Twenty six years after the incident, tons of toxins leaked form the plant continue to wreak havock. But even deadlier it must have been for the victims, the survivors and the city itself, the verdict issued by the a Bhopal court in June 2010 which convicted the former Union Carbide India Chairman Keshub Mahindra and seven others in the Bhopal gas tragedy case and awarded them a maximum of mere two years imprisonment. Even more lackadaisical has been the political will shown by Indian authorities in going after Warren Anderson, who headed Union Carbide Corp, the parent company in the US. The charges against the executives were reduced by the Supreme Court in 1996 from culpable homicide not amounting to murder to causing death by negligence. If a mascacre that resulted in 15,000 deaths can be written off as an act of neglicence, peace be upon the system!
Ruchika: Molested by cop, then raped by justice for 19 years!
A 14-year-old girl is molested by a high ranking police official who then uses his clout to harass the girl after she has lodged a complaint, and eventually drives her to suicide. This is the story of Ruchika Girhotra and Shambhu Pratap Singh Rathore; a case of atrocity that took the nation by storm. After 19 years, 40 adjournments, and more than 400 hearings, on December 22, 2009 the court pronounced Rathore guilty under Section 354 IPC (molestation) and sentenced him to--guess what?-- six months imprisonment and a fine of Rs 1,000. State and its law are meant to ensure that the weak are protected; that the mighty cannot rule the roost like in barbaric societies. But if the same state uses its apparatuses to protect smug criminals, what meaning does justice hold for the common man? Though the Chandigarh District Court on May 25, 2010, sentenced the disgraced former police official to one and a half years of rigorous imprisonment, enhancing his earlier six-month sentence and though he was immediately taken into custody and taken to the Burail prison, all of that merely serve as poor apologies for the precious life of a girl.
Jessica Lall: Bang, bang! Everyone shot the baby down!
Jessica Lall, a New Delhi based model, was working as a celebrity barmaid at a socialite party when she was shot dead on April 29, 1999. Those who were present at the party said Siddharth Vashisht alias Manu Sharma, the son of Venod Sharma, an influential Congress leader in Haryana, was the murderer. The trial lasted seven years, and in the process the accused exploited their plentiful influence on the powers that control the judicial process and ensured that the witnesses turned hostile. The result: Manu Sharma and a number of others were acquitted on February 21, 2006. But in the wake of fierce pressure mounted by the media and the civil society, the prosecution appealed and the Delhi High Court conducted proceedings on a fast track with daily hearings over 25 days. The lower court judgment was deemed faulty, and Manu Sharma was found guilty of having murdered Jessica Lall. He was sentenced to life imprisonment on December 20, 2006. On 19th April 2010, the Supreme Court of India approved the life sentence for the guilty. In addition to serving as a reminder of the judiciary's obnoxious ways to delay justice, the case also brought to light varios loopholes in investigation processes like the Sections 25-29: 25 of Indian Evidence Act of 1872, which say that 'No confession made by any person whilst he is in the custody of a police officer, unless it be made in the immediate presence of a Magistrate, shall be proved as against such person'. Eminent lawyer Ram Jethmalani, who appeared for the accused, launched a scathing attack on media and condemned it for pressurising the judiciary. But Sir, if we the judiciary is blind to what is just, is it not the media's civic responsibilty to demand justice?
Begum Shakira murder case: A 14-year-long trial
Swami Shraddananda, the main accused in the Begum Shakira murder case, had married Shakira, granddaughter of a former Dewan of Mysore, Sir Mirza Ismail. A native of Madhya Pradesh, Shraddananda, whose real name is Murli Manohar Mishra, decided to murder Shakira as he wanted to acquire her property. With this motive, he poisoned Shakira by administering sleeping pills, put her body in a wooden box, put it into a pit dug up in the bungalow compound and had it covered with the help of servants. Like the coldest of cold blood killers, Shraddananda continued to live in the bungalow thereafter. when questioned about the whereabouts of Shakira, Sharaddananda said she had gone abroad and gave the same answer to Shakira's daughters. Smelling something fishy, one of the daughters of Shakira lodged a complaint with the police who failed to make any progress in the investigation for years. But in 1994, the first breakthrough was made when a constable, Mahadeva, got a servant of Shraddananda drunk and extracted a confession. In April 1994, the skeleton of Shakrira was dug out from the pit. The police arrested Shraddananda and imprisoned him on March 28, 1994. But it was only in 2005 that the accused was convicted for murder.

Oil spill: Obama asks 'whose ass to kick'
Washington: President Barack Obama said he wanted to know whose ass to kick over the Gulf of Mexico oil spill, adding to the pressure on energy giant BP Plc as it sought to capture more of the leak from its gushing well.
"I don't sit around just talking to experts because this is a college seminar. We talk to these folks because they potentially have the best answer so I know whose ass to kick," Obama said in an interview with NBC News' Today to air on Tuesday.
They were the angriest words yet about the catastrophe from Obama. Obama reiterated that all those affected should be adequately compensated.
The stakes remain high for all involved - from Gulf Coast communities devastated by the disaster to Obama and his domestic standing to BP and its battered reputation. A Washington Post/ABC poll found that 69 percent of Americans feel the government had done a not so good or poor job handling the spill. Just over 1,000 people were surveyed in the poll.
While a complete halt to the oil flow is not expected until August at the earliest, Meanwhile, BP said on Tuesday, that a seabed containment cap has collected 14,800 barrels of oil on Monday, the highest capture rates in the system was installed last week.
BP said the total oil collected in four days is about 42,500 barrels. Scientists have estimated the leak spews 12,000 to 19,000 barrels of oil per day, with one estimate as high as 25,000 barrels. Meanwhile, energy giant BP Plc was forging ahead with efforts to capture oil gushing from its stricken Gulf of Mexico well as the spill remained high on Washington's radar screen, with several congressional hearings set for Wednesday.
The political drama in Washington and the containment drive in the Gulf will be keenly watched by investors the day after BP's share price slid 5 percent in London, extending recent losses that have cleaved about a third of its value.
The disaster remains at the top of U.S. President Barack Obama's crowded domestic agenda, a point underscored by his strong comments and his plans to head back to the Gulf next week to inspect operations to grapple with the worst oil spill in U.S. history.
The slick has fouled wildlife refuges in Louisiana and barrier islands in Mississippi and Alabama and also sent tar balls ashore on beaches in Florida. One-third of the Gulf's federal waters remains closed to fishing and the toll of dead and injured birds and marine animals is climbing.
In Washington on Wednesday morning, Interior Secretary Ken Salazar will testify at a Senate hearing on safety issues in off-shore oil development, a day after his department issued stronger safety requirements that companies must meet to drill in waters less than 500 feet/152 meters deep.
On the corporate front, BP Plc shareholders would prefer to sacrifice the company's Chairman Carl-Henric Svanberg rather than Chief Executive Tony Hayward over the ongoing crisis, the Times reported in its Wednesday edition. Citing an unidentified person close to the British company, the Times said shareholders had more confidence in Hayward's ability to supervise BP's response to the crisis than Svanberg, who has been largely invisible.
"The mood within the company and among shareholders is clear -- they are supportive of Tony, who they feel has done his best in a very bad situation, but they are unimpressed by Svanberg," the Times reported the person as saying. A BP spokesman dismissed the claims former Ericsson boss Svanberg, who took over the role of chairman in January, would consider stepping down.
Rising Anger
All of this is taking place against the backdrop of rising public anger and an unfolding ecological catastrophe.
U.S. weather forecasters gave their first confirmation on Tuesday that some of the oil leaking from BP's well has lingered beneath the surface rather than rising to the top. Undersea oil depletes the water's oxygen content and threatens marine life like mussels, clams, crabs, eels and shrimp.
It was the first government confirmation of undersea oil near BP's blown-out well a mile beneath the ocean. Previously, both NOAA and BP have played down the possibility of undersea plumes. Scientists involved in the studies will testify before a House of Representatives Energy and Commerce subcommittee panel that is probing the spill -- one of the several being held on Wednesday's busy day of hearings.
Meanwhile, BP will be striving to contain more of the oil spewing from the ocean floor. BP said on Tuesday it had collected 14,800 barrels of oil from the leaking well on Monday, 33 percent more than the amount collected on Sunday and the highest capture rate since it installed a new system last week to contain the spill.
The company later said it collected 7,850 barrels of oil in the 12-hour stretch ended at noon CDT (1700 GMT) on Tuesday. That brought the total collected since the cap was installed to 51,364 barrels. But the ultimate solution to the leak lies in the drilling of a relief well and that won't be completed before August, meaning there could be a long hot summer of public discontent ahead.
BP faces a criminal investigation and lawsuits over the April 20 explosion aboard the Deepwater Horizon oil rig that killed 11 workers and triggered the spill. The company has already spent more than $1 billion on the clean-up.

Anderson pays higher golf fee than compensation amount
Warren Anderson was the chairman and chief executive of Union Carbide Corporation, once one of the largest chemical polymer companies in the United States. He was born in Brooklyn, New York, in 1921 to Swedish immigrant parents.
At Union Carbide until his retirement in 1986, he was charged with manslaughter in the Bhopal gas leak disaster. He was arrested and later released on bail by the Madhya Pradesh police in Bhopal in December 1984. He was declared afugitive when he refused to return to the country.
Anderson, who was charged with culpable homicide on the tragedy, which is also considered to be the world's worst industrial disaster, currently lives a luxurious life in New York. Named after former president of the US, Warren Harding, he presently lives with wife Lillian Anderson.
According to Greenpeace, Anderson knew about a 1982 safety audit of the Bhopal plant, which identified 30 major hazards. Rather than fixing them in Bhopal, only the company's identical plant in the US was fixed.
After the explosion and the leak of poisonous gas from the Bhopal plant, Anderson flew down to India only to get arrested. He subsequently jumped bail and was flown by a private jet back to the US. Dow Chemicals took over Union Carbide in 2001 but it claims Union Carbide had settled the issue of the Bhopal disaster.
Despite being wanted by India and Interpol, Indian and US authorities have been inactive in the past 18 years. Indian authorities are believed to have filed a formal extradition request with the US after domestic pressure.
It is believed Anderson's yearly golf club membership is three-four times the average compensation of a gas tragedy survivor.

Keshub Mahindra, 85, has held several important positions in the Indian corporate sector. One of those refuses to let him be in peace.
Mahindra, who is ranked 56 by the Forbes list of India's richest, with a net worth of Rs 4,300 crore, was penciled in for the Padma Bhushan in 2002 by the Bharatiya Janata Party-led National Democratic Alliance government. He never got it due to protests over his association with Union Carbide.
The same association came to bite him in the back on Monday, with a two-year prison term and a fine of just over Rs 1 lakh. Mahindra, who was convicted on Monday of negligence in the Bhopal gas tragedy case, was chairman of the offending company, Union Carbide's Indian subsidiary in 1984, when the leak took place.
His most durable position is as chairman of Mahindra & Mahindra Ltd, the country's largest utility vehicles maker. He joined the company in 1947, about two years after it was set up by his father, J C Mahindra, and uncle, K C Mahindra, and became chairman in 1963. His nephew, Anand Mahindra, now runs the company as vice-chairman and managing director.
The company is poised to become the first Indian one to launch its own range of passenger vehicles in the US later this year. The group's information technology arm, Tech Mahindra, out-bid engineering major Larsen & Toubro and private equity company Wilbur Ross to bag Satyam Computer Services last year.
The senior Mahindra, even at this mature age, is on the board of seven organisations, including HDFC, Mahindra Ugine, Mahindra Holdings, and Bombay Dyeing &Manufacturing Company. In the past, he has been associated with the boards of Tata Chemicals and Tata Steel. He is also a member of the Prime Minister's Council on Trade &Industry. Now he may be wishing he had never joined Union Carbide.

Mumbai: The US-based Union Carbide Corporation, now a wholly-owned subsidiary of Dow Chemical International, has said the company and its officials were not part of the case in which a local Indian court on Monday convicted its former Indian arm's chairman Keshub Mahindra and seven others in relation to the 1984 Bhopal gas tragedy, since the charges were divided long ago into a separate case.
"By requirement of the Government of India, the Bhopal plant was in detail designed, owned, operated and managed on a day-to-day basis by Union Carbide India Limited (UCIL) and its employees. All the appropriate people from UCIL -- officers and those who actually ran the plant on a daily basis -- have appeared to face charges," Union Carbide said in a statement on the verdict.
Furthermore, Union Carbide said the company and its officials were not subject to the jurisdiction of the Indian court since they did not have any involvement in the operation of the plant, which was owned and operated by UCIL.
In 1994, Union Carbide had sold its entire stake in UCIL to Kolkata-based MacLeod Russell (India) Ltd, which renamed the company as Eveready Industries India Ltd (Eveready Industries).
In 1998, the Madhya Pradesh government took over the Bhopal site from Eveready Industries.
Meanwhile, Dow Chemical said the Bhopal gas tragedy was an eye-opener for the chemical industry worldwide on the need for improving safety measures.
"Although Dow never owned nor operated the plant, we, along with the rest of industry, have learned from this tragic event, and we have tried to do all we can to assure that similar incidents never happen again," said the company.
The tragedy has led to formation of Responsible Care -- an initiative by the global chemical industry for strengthened focus on safety standards, emergency preparedness and community awareness, says Dow Chemical International on its website on the Bhopal tragedy.
Responsible Care is a programme initiated in 1986 and is actively promoted by the International Council of Chemical Associations (ICCA) and the American Chemistry Council, which actively promotes safety management and review of plants and processes of the $3000-billion plus chemical industry, which employs over 2 million people.
Dow acquired the shares of Union Carbide Corporation more than 16 years after the tragedy, and 10 years after the $470-million settlement agreement -- paid by Union Carbide and UCIL -- was approved by the Indian Supreme Court, noted Dow Chemical.
Union Carbide had maintained that the gas leak could only have been caused by deliberate sabotage. "Someone purposely put water in the gas storage tank, and this caused amassive chemical reaction. Process safety systems had been put in place that would have kept the water from entering into the tank by accident," the company had said, citing the report of engineering consulting firm, Arthur D Little.
Meanwhile, even after 25 years of the mishap, Bhopal is struggling to offer relief and rehabilitation to its victims. A total of 560,000 of the 894,000 people in 36 wards of the city in 1984 were declared gas affected.
According to information on the website of the Madhya Pradesh government's Bhopal Gas Tragedy Relief and Rehabilitation Department, an average 3,583 people visit the outpatient departments of the 24 health institutions from these wards every day. In a year, over 30,000 patients are admitted to the hospitals. The government has spent over Rs 512 crore as of March 2009 in medical, economic, social and environmental rehabilitation of the affected people. Of this, Rs 366.17 crore was for medical rehabilitation.
The data also say that a total of 10,29,517 cases were registered claiming compensation, of which 455,151 were rejected by courts. A total compensation of Rs 1,548.46 crore was awarded and disbursed to the victims as compensation.

Comment: Had the gas tragedy happened in US or China

A disaster occurs and over 15,000 people are killed. What would the US government have done?
A. Arrested the chairman and directors of the Union Carbide of India, try them as expeditiously as possible and give them the toughest punishment. If they were not available in the US, the government would have put pressure on the Indian government and seen to it that the culprits are extradited, even if there was no policy to speak of.
B. Almost declared a war on India, slapped harsh economic sanctions, denied intellectual access to technology, snapped cooperation on the economic front.
C. Stopped all cooperation talks, strategic dialogues and snapped defence deals.
D. To spike India, US would have aided Pakistan with mouthwatering deals, including the latest armaments.
Now to reality. Pray what did India do when the Union Carbide factory killed over 15,000 in Bhopal?
Allowed the CEO and chairman of Union Carbide Corporation, which owns the Indian arm, Warren Anderson to flee four days after the tragedy occurred. He was arrested on December 7, 1984 on arrival in Bhopal, granted bail in just six hours and flown to Delhi in a government plane! What 'hospitality'. From Delhi, he flew out, never to return.
After 19 years, India wakes up and files papers for Anderson's extradition. The US dumps the papers.
In September 1986, the Government of India files a civil suit for Rs 3900 crore as compensation and punitive damages. A year later, the district judge proposes an interim relief of Rs 350 crore. On appeal, the MP High Court rules in favour of Union Carbide and reduces the amount to Rs 250 crore. Indian judiciary at work!!
On Feb 14, 1989, the Indian Government bends again to Union Carbide. The Government and the company accepts a compensation of Rs 705 crore and all civil and criminal cases are dropped. In the US, the victims of 9/11 got a compensation of $1.8 million. The Bhopal Gas victims? Rs 12,000!!
In 1996, the judiciary does another big favour to Union Carbide by reducing criminal charges from Section 304, culpable homicide that would have attracted 10 years in jail to that of Section 304A - causing death due to negligence - that could attract just 2 years in jail for killing over 15,000 people. Again, the great and 'fair' judicial system at work.
In 2001, another dodging of the judicial system. Dow Chemicals buys out Union Carbide. The Ministry for Company Affairs keeps quiet. When Dow Chemicals is hauled before the court, it takes the stand that it is not the same as Dow US.
Will this argument stand if the Union Carbide of India, as alluded in the opening paragraph, takes the stand in the US court that Union Carbide of US has nothing to do with the parent company? The plea would have been thrown out without second thought.
The Union Carbide has taken the stand that it is not governed by Indian laws or the judicial system. Could an Indian company take the same stand in a US court if a disaster of this nature or even lesser one occurs in the US? Never.
How is the Union Carbide not connected with the Indian operations when it siphoned off profits year after year?
Had this happened in China, the officials would have been arrested and shot dead, no questions asked. Of course, this may seem too harsh.
Had this happened in the UK or France, the world would have condemned India and Indian companies and ended all trade deals.
Little wonder that survivors and activists called Monday's verdict a mockery of justice.
IANS reports: The court which tried the seven officials of the Union Carbide India, sentenced them to two years in jail and imposed a fine of Rs.100,000.
The convicted included 85-year-old Keshub Mahindra, who then headed the Union Carbide India Ltd (UCIL) from whose pesticide plant tonnes of lethal gas leaked on the intervening night of Dec 2-3, 1984, killing about 3,500 instantly and thousands later.
The seven were convicted under section 304 (a) of the Indian Penal Code. They included former top brass of Union Carbide, Mahindra, Vijay Gokhale, J. Mukund, S.P. Chaudhary, K.V. Shetty, Kishor Kamdar and S.I. Quireshee. Another accused, R.B Chaudhary, died during the 23-year-long trial.
The company UCIL was fined Rs.500,000.
As all the seven were released on a personal bond of Rs.25,000, the verdict was denounced by activists, environmental and legal experts.
"Today's verdict is a disaster... They've made it look like a traffic accident," said Satinath Sarangi of the Bhopal Group for Information and Action, an NGO representing the survivors and an activist who has been involved with the victims since the 1984 disaster.
"The charges have been diluted. The victims are disappointed," Sarangi said.
The anger was palpable among the survivors of the horrific industrial disaster that grabbed worldwide attention.
Nupur Dhimya, 62, who lost her two children and husband in the disaster, said: "Twenty-five years have passed since the disaster......look what we have got. The accused were convicted only for name's sake and bailed out within minutes."
Ramesh Baghel, 50, who claimed he could not marry because of ailments caused due to exposure to the gases, said: "We have been waiting for 25 years to see that some day those guilty of ruining our lives would be punished but these men have effectively been set free."
Tonnes of methyl-iso-cyanate (MIC) spewed out of the now shut pesticide plant located in a congested part of the city Dec 2-3 night in 1984.
In the years that followed, people exposed to the gas kept dying or suffered from life-long ailments and complications. The death toll is believed to be about 25,000.
Said an angry survivor: "We have lost our kith and kin... our land, water and air remain polluted. Our kids have multiple health disorders. But the accused will manage to get away with a mere two years in jail. Do you call this justice?
"The prime minister and the CBI (Central Bureau of Investigation) should be ashamed of themselves... The government and Union Carbide are hand in glove in this disaster. This is absolute injustice," she fumed.
Sarangi accused the Indian authorities of lacking the political will to go after Warren Anderson, who headed Union Carbide Corp, the parent company in the US.
Anderson, 89, is in the US and described as "absconding" here. There was not a word about him in the judgment delivered by Chief Judicial Magistrate Mohan P. Tiwari.
"The message is going out that peoples' lives don't matter, what matters is foreign direct investment (FDI). You can kill people, maim them for life and get away almost scot-free," he said.
Rashida Bi of the Bhopal Gas Peedit Mahila Stationery Karamchari Sangh told IANS: "This is complete injustice done to the 25,000 dead. It is a shameful verdict. We are extremely disappointed."
Anger, frustration and disappointment were writ large on the faces of the survivors as they heard about the sentencing.
Said Sayed M. Irfan of the Bhopal Gas Peedit Mahila Purush Sangharsh Morcha: "We were eager to know the verdict. But as usual our expectations were futile."
"We have become like footballs... being kicked from Bhopal to Delhi and Delhi to Bhopal."
Another victim, Abdul Sattar said: "Rich and mighty people always get away. There is nothing new in it."
